{"id":60004292,"date":"2024-03-14T09:27:49","date_gmt":"2024-03-14T09:27:49","guid":{"rendered":"https:\/\/dialogue.earth\/?post_type=news_digest&#038;p=60004292"},"modified":"2024-04-30T09:30:29","modified_gmt":"2024-04-30T08:30:29","slug":"china-explores-blue-carbon-justice","status":"publish","type":"news_digest","link":"https:\/\/dialogue.earth\/en\/digest\/china-explores-blue-carbon-justice\/","title":{"rendered":"China explores \u2018blue carbon justice\u2019"},"content":{"rendered":"\n<p>Two people found guilty of fishing with prohibited gear have purchased \u201cblue carbon\u201d credits rather than paying to restore the fish stocks they had damaged.<\/p>\n\n\n\n<p>\u201cBlue carbon\u201d is the carbon stored by the world\u2019s ocean and coastal ecosystem.<\/p>\n\n\n\n<p>This is the latest case in which purchases of carbon credits, including blue ones, have entered China\u2019s judicial system as an alternative means of ecological restoration.<\/p>\n\n\n\n<p>The two people caused 6,352 yuan (approximately US$883) of damage and purchased 242 tons of  credits to make up for it, according to the People\u2019s Procuratorate of Wenzhou City, as reported by <a href=\"https:\/\/zj.cnr.cn\/mlnb\/nbpd\/20240311\/t20240311_526623604.shtml\">China National Radio Network<\/a>.<\/p>\n\n\n\n<p>The law states they should bear responsibility for fixing the damage within a reasonable time period. Fish stocking would be the main method, but requires specific technical skills and timing, <a href=\"https:\/\/tidenews.com.cn\/news.html?id=2737215&amp;source=1\">Zhejiang Daily<\/a> explained.<\/p>\n\n\n\n<p><a href=\"https:\/\/tidenews.com.cn\/news.html?id=2654560&amp;source=1\">Zhejiang Daily<\/a> had last year reported that the \u201cblue carbon justice\u201d transaction funds will go to a special blue carbon account and be used for maintaining mangroves, fish stocking and improving the quality of river water.<\/p>\n\n\n\n<p>Courts in some coastal provinces have begun to explore this idea blue carbon justice. <a href=\"https:\/\/www.cnr.cn\/fj\/fjgd\/20211022\/t20211022_525640188.shtml\">China National Radio Network<\/a> reported in 2021 that the country\u2019s first blue carbon ecological protection tribunal had been established in Fujian.<\/p>\n\n\n\n<p>According to the <a href=\"http:\/\/gongbao.court.gov.cn\/Details\/fdd7cf0c9e3988c2c437626d7dbb9d.html\">judicial interpretation<\/a> of the Supreme People\u2019s Court, when direct ecological restoration is not feasible, buying credits can be used as an alternative.<\/p>\n\n\n\n<p>However, the interpretation only clarifies that forest carbon credits can replace liability for forest damage compensation. According to the <a href=\"https:\/\/newspaper.jcrb.com\/2023\/20230705\/20230705_004\/news-zgjcb-10263-20230705-m-004-300.pdf\">Procuratorate Daily<\/a>, China has not yet established a national marine ecological compensation mechanism.
