The new administration has so far pursued an economic agenda that echoes the playbook of other far-right governments across Latin America: shrink the state, loosen regulations and prioritise investment above all else.<\/p>\n\n\n\n<p>President Kast inherited a country with a meaningful environmental record built over three decades. Chile\u2019s institutional framework, whilst imperfect, has steadily adapted to the challenges it faces.<\/p>\n\n\n\n<p>The country is a party to both the <a href=\"https:\/\/dialogue.earth\/en\/justice\/42377-historic-escazu-agreement-enters-into-force\/\">Escaz\u00fa<\/a> and Paris agreements, and is leading negotiations for global treaties on plastics and the high seas. Domestically, the <a href=\"https:\/\/www.sea.gob.cl\/noticias\/presidente-gabriel-boric-puso-en-marcha-el-servicio-de-biodiversidad-y-areas-protegidas\">launch<\/a> of the Biodiversity and Protected Areas Service (SBAP) in 2023 consolidated the protection of the country\u2019s ecosystems. Taken together, these actions represent the progressive spirit of the country.<\/p>\n\n\n\n<p>That legacy is now under threat.<\/p>\n\n\n\n<p>In the brief time since Kast\u2019s inauguration on 11 March, his administration has taken at least three alarming actions that risk dismantling that which took decades to build \u2013 each dressed up as economic recovery or administrative efficiency.<\/p>\n\n\n\n<p>Environmental decrees have been trashed, and new protected areas have been delayed. Environmental advocates including myself have been shocked at the pace of change.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-setbacks-in-environmental-regulation\">Setbacks in environmental regulation<\/h2>\n\n\n\n<p>On its second day in office, the new government <a href=\"https:\/\/es.mongabay.com\/2026\/03\/chile-kast-frena-areas-protegidas-salares-normas-ambientales-boric\/\">withdrew<\/a> 43 supreme decrees approved by Kast\u2019s predecessor, Gabriel Boric. These would have introduced a host of new environmental protections including pollutant emission standards, the designation of new protected areas, and other instruments related to Chile\u2019s governance of climate change.<\/p>\n\n\n\n<div class=\"wp-block-cd-pull-quote block--pull-quote block--pull-quote--no-citation\"><div class=\"block--pull-quote__wrapper\"><blockquote class=\"block--pull-quote__quote\">These decrees were not drafted in isolation <br\/>by the previous government [&#8230;] Treating them <br\/>as administrative drafts to be quietly revised <br\/>ignores the democratic processes behind them<\/blockquote><cite class=\"block--pull-quote__cite\"><\/cite><\/div><\/div>\n\n\n\n<p>As winter sets in, the air quality in Chilean cities has worsened, making the case for minimum standards \u2013 a feature of one of the withdrawn decrees \u2013 more pressing.<\/p>\n\n\n\n<p>The Ministry of the Environment has said halting these decrees is part of a \u201c<a href=\"https:\/\/www.ex-ante.cl\/quien-es-la-mano-derecha-de-la-ministra-toledo-que-revisara-los-43-decretos-ambientales-retirados-por-el-gobierno\/\">broader operational review<\/a>\u201d and has committed to resubmit them. But only after they have been \u201ccorrected\u201d.<\/p>\n\n\n\n<p>This framing obscures an important reality: these decrees were not drafted in isolation by the previous government. They were the product of public participation processes involving communities, civil society organisations and businesses. Treating them as administrative drafts to be quietly revised ignores the democratic processes behind them. <\/p>\n\n\n\n<p>Months later, only six have been <a href=\"https:\/\/chilesustentable.net\/wp-content\/uploads\/2026\/06\/GOB_EVA.pdf\">reintroduced<\/a>. Over time, it has been strengthened to expand the state\u2019s powers in both environmental assessment and enforcement. Environmental governance has been embedded into national decision-making.<\/p>\n\n\n\n<p>While previous governments have attempted to reform this legislation, they sought to achieve consensus on contentious issues such as investment permitting and project assessment.<\/p>\n\n\n\n<p>Kast has chosen a different approach. Rather than seeking consensus, sweeping environmental reforms were rolled into a broader \u201comnibus\u201d bill \u2013 the <a href=\"https:\/\/www.elmostrador.cl\/noticias\/pais\/2026\/03\/14\/presidente-kast-presenta-su-reconstruccion-nacional-incluye-cae-y-medidas-economicas\/\">National Reconstruction Plan<\/a> \u2013 alongside tax and labour measures. The bill has been fast-tracked through congress, where the government commands a majority.<\/p>\n\n\n\n<a class=\"wp-block-cd-related-news alignright block--related-news loading\" data-post-id=\"60133545\"><div class=\"block--related-news__image\"><\/div><div class=\"block--related-news__content\"><span class=\"block--related-news__heading\">Recommended<\/span><span class=\"block--related-news__title\"><\/span><\/div><\/a>\n\n\n\n<p>The bundling of these issues makes scrutiny harder and democratic debate easier to bypass.<\/p>\n\n\n\n<p>On environmental matters, the reforms are explicitly regressive. They would subordinate public protection to business investment in ways that contradict the foundational principles of the General Environmental Framework.<\/p>\n\n\n\n<div class=\"wp-block-cd-did-you-know alignleft block--did-you-know\"><p class=\"block--did-you-know__title\">Environmental Qualification Resolutions (RCAs)<\/p><div class=\"block--did-you-know__content\"><p>In Chile, this <a href=\"https:\/\/snifa.sma.gob.cl\/Instrumento\">document<\/a> of conditions, requirements or measures is issued to a project upon completion of its environmental impact assessment\u00a0<\/p><\/div><\/div>\n\n\n\n<p>Specifically, the plan proposes a state insurance scheme that would use public funds to compensate companies whose Environmental Qualification Resolutions are overturned by courts \u2013 in effect, socialising the cost of environmental violations.<\/p>\n\n\n\n<p>It also seeks to abolish administrative annulment, a process by which communities can challenge development, and to shrink the window of time during which appeals can be made. The effect of these changes is that environmental governance would be easier to override.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-setbacks-in-biodiversity-protection\">Setbacks in biodiversity protection<\/h2>\n\n\n\n<p>Chile\u2019s biodiversity is exceptional. It boasts diverse geography spanning the world\u2019s driest desert, island ecosystems, Mediterranean valleys and Patagonian mountain ranges.<\/p>\n\n\n\n<p>After more than 10 years of debate, proposals to protect this diverse ecosystem were finally introduced with the creation of the SBAP, which has merged multiple areas of nature protection management into one body. Chile currently has <a href=\"https:\/\/snap.mma.gob.cl\/\">more than 160<\/a> official protected areas, representing approximately <a href=\"https:\/\/data.worldbank.org\/indicator\/ER.PTD.TOTL.ZS?locations=CL\">37%<\/a> of its land and marine area. On paper, the SBAP has extensive powers for the management of biodiversity in the country.<\/p>\n\n\n\n<p>The Kast government is supposed to continue this work, introducing the legal frameworks and identifying the sites to be protected. Instead, two government-backed bills (the National Reconstruction Plan and a bill to change the SBAP) are now seeking to do the opposite: stalling the SBAP\u2019s implementation by delaying its regulations and the identification of priority sites.<\/p>\n\n\n\n<p>The SBAP is essential for determining where investment projects can or cannot be established in the country, protecting precious, biodiverse areas from development. Chile cannot afford to continue delaying its implementation.<\/p>\n\n\n\n<p>Chile\u2019s environmental gains have been hard won over many decades.
