{"id":60014869,"date":"2024-04-25T12:18:37","date_gmt":"2024-04-25T11:18:37","guid":{"rendered":"https:\/\/dialogue.earth\/?post_type=photo_story&#038;p=60014869"},"modified":"2025-04-04T15:07:37","modified_gmt":"2025-04-04T14:07:37","slug":"chile-revives-controversial-punilla-reservoir-project","status":"publish","type":"photo_story","link":"https:\/\/dialogue.earth\/en\/water\/chile-revives-controversial-punilla-reservoir-project\/","title":{"rendered":"Chile revives controversial Punilla reservoir project"},"content":{"rendered":"\n<p class=\"has-drop-cap\">On 21 November 2018, five families were forcibly <a href=\"https:\/\/cooperativa.cl\/noticias\/pais\/region-de-nuble\/punilla-familias-desalojadas-por-proyecto-de-embalse-anuncian-demanda\/2018-12-08\/195510.html\">evicted<\/a> from their homes near San Fabi\u00e1n, a commune in the mountainous province of Punilla, in central Chile. Police <a href=\"https:\/\/www.youtube.com\/watch?v=vmFT083SUfs&amp;ab_channel=NubleLibre\">arrived<\/a> unannounced to inform residents of their fate, and guarded workers linked to the Italian construction company Astaldi, as heavy machinery reduced their houses to rubble.<\/p>\n\n\n\n<p>These acts were in the name of Nueva La Punilla, a long-planned, multi-purpose reservoir project. Designed for hydropower and irrigation purposes, the Punilla reservoir could flood an area of 1,700 hectares behind a 136-metre-high retaining wall on the \u00d1uble River. Should it be realised, the project would also flood parts of the Nevados de Chill\u00e1n-Laguna del Laja Biological Corridor, a <a href=\"https:\/\/www.unesco.org\/en\/mab\/corredor-biologico-nevados-de-can-laguna-del-laja\">Unesco Biosphere Reserve<\/a>. <\/p>\n\n\n\n<p>In December 2018, residents secured an injunction to <a href=\"https:\/\/3ta.cl\/noticias\/tribunal-ambiental-de-valdivia-ordena-suspender-desalojos-del-proyecto-embalse-punilla\/\">suspend<\/a> the eviction orders through an environmental tribunal in the city of Valdivia, in southern Chile, while a lawsuit was being prepared against the reservoir project. The Chilean state ultimately paid an unknown amount to Astaldi in compensation.<\/p>\n\n\n\n<p>Chile\u2019s public works ministry has since <a href=\"https:\/\/www.terram.cl\/2023\/06\/mop-define-adjudicar-el-embalse-la-punilla-en-el-primer-semestre-de-2024-y-anuncia-que-apurara-nuevas-represas\/\">issued<\/a> a new tender for the Punilla reservoir, initially setting a 19 April 2024 <a href=\"https:\/\/concesiones.mop.gob.cl\/proyectos\/Paginas\/detalle_adjudicacion.aspx?item=258\">deadline<\/a> for technical offers, but which has now been <a href=\"https:\/\/www.ladiscusion.cl\/mop-posterga-ocho-meses-licitacion-del-embalse-la-punilla\/\">extended<\/a> until December. Once you\u2019ve gotten old, it\u2019s difficult to be taken away from where you\u2019ve made your life,\u201d says H\u00e9ctor L\u00f3pez Benavides, a 57-year-old livestock herder who has lived in San Fabi\u00e1n since his late twenties. He raised his family here and built a life raising cows, sheep and horses. During the evictions, his house was the first to be destroyed.<\/p>\n\n\n\n<p>The evicted residents had rejected a displacement plan drawn up by the public works ministry in 2018. L\u00f3pez says his community deemed the compensation offered to be insufficient. Without land of his own, he says his typical way of life and income stream has become impossible.<\/p>\n\n\n\n<p>Iv\u00e1n Labr\u00edn Villalobos says he has suffered similarly. Another local livestock herder, Labr\u00edn kept hundreds of goats before the evictions, which he was forced to sell; some were lost. He now lives with relatives.<br><br>L\u00f3pez recounts the project\u2019s citizen participation process: the public works ministry, he says, \u201cthought we were ignorant people from the mountains, but I never allowed them to treat us like that.\u201d During this consultation, the ministry collected livestock data to calculate compensation payments for their expropriation. She says their housing payment was therefore not enough for her family to conserve their lifestyle. \u201cWe refused for a long time to sign the agreement to receive the amount they offered us,\u201d she says. \u201cWe finally did it in 2022, out of necessity.\u201d<\/p>\n\n\n\n<p>Labr\u00edn says he recently signed the agreement for the same reason. Near the expropriated area, he now maintains a plot of land on a hillside behind his former home. He was told he could receive compensation to build a new house here, but on the condition that he self-fund the construction of an access road to the site. \u201cI shouldn\u2019t have to do that,\u201d Villalobos points out. \u201cIt was up to them to relocate me.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-legal-proceedings-and-risks\">Legal proceedings and risks<\/h2>\n\n\n\n<p>After the Astaldi contract collapsed in 2021, the public works ministry assumed ownership of the project \u2013 the announcement of this year\u2019s new auction was made by its minister, Jessica L\u00f3pez. The official public <a href=\"https:\/\/concesiones.mop.gob.cl\/proyectos\/Paginas\/detalle_adjudicacion.aspx?item=258\">details<\/a> confirm the project to be fundamentally unchanged since its progress during Chile\u2019s previous administration, under former president Sebasti\u00e1n Pi\u00f1era (2018-2022).<\/p>\n\n\n\n<a class=\"wp-block-cd-related-news alignright block--related-news loading\" data-post-id=\"50051018\"><div class=\"block--related-news__image\"><\/div><div class=\"block--related-news__content\"><span class=\"block--related-news__heading\">Recommended<\/span><span class=\"block--related-news__title\"><\/span><\/div><\/a>\n\n\n\n<p>This lack of change has disappointed local community advocates who hoped for something different under current president Gabriel Boric. \u201cAt the beginning we had high expectations with the new government,\u201d confirms C\u00e9sar Uribe, a spokesperson for \u00d1uble Libre. We are talking about a project from the 1960s \u2013 that is, almost 70 years ago. In that sense, it obviously does not meet today\u2019s standards and reality.\u201d<\/p>\n\n\n\n<p>In the aftermath of the Astaldi debacle, SMA, Chile\u2019s environmental regulator, commenced proceedings to <a href=\"https:\/\/snifa.sma.gob.cl\/Sancionatorio\/Ficha\/2766\">sanction<\/a> the project. This process is considering 10 separate areas of investigation, three of which have been categorised as serious; these include the failure to update relocation plans for evictees and the failure to consider issues concerning livestock. The proceedings continue. <\/p>\n\n\n\n<p>San Fabi\u00e1n lawyer Ricardo Frez Figueroa has guided the evictees through the SMA sanctioning process. (Image: Nicole Kramm \/ Dialogue Earth)<\/div><\/div><\/div><meta itemprop=\"contentUrl\" content=\"https:\/\/dialogue.earth\/content\/uploads\/2024\/04\/20240213_electrical-substation-Coihueco_Nuble-Chile_Nicole-Kramm_Dialogue-Earth.jpg\"\/><meta itemprop=\"contentSize\" content=\"2 MB\"\/><meta itemprop=\"height\" content=\"1440\"\/><meta itemprop=\"width\" content=\"2560\"\/><meta itemprop=\"author\"\/><meta itemprop=\"representativeOfPage\" content=\"true\"\/><\/div>\n\n\n\n<p>The incoming company will also have to tackle electricity transmission hurdles: the project requires a new <a href=\"https:\/\/seia.sea.gob.cl\/expediente\/ficha\/fichaPrincipal.php?modo=normal&amp;id_expediente=2132497539\">23 km power line<\/a> to distribute an anticipated annual <a href=\"https:\/\/seia.sea.gob.cl\/seia-web\/ficha\/fichaPrincipal.php?id_expediente=6295&amp;idExpediente=6295\">525 GWh<\/a> to the national electricity grid.<br><br>While the construction of this line had previously been approved, in February the environmental court of Valdivia <a href=\"https:\/\/www.sancarlosonline.cl\/2024\/02\/tribunal-acoge-reclamaciones-en-contra.html\">annulled<\/a> its environmental authorisation. The ruling cited concerns of possible impacts for the huemul deer, endemic to Chile and Argentina; the \u00d1uble region, of which Punilla is a part, is the species\u2019 last remaining habitat in central Chile. <\/p>\n\n\n\n<p>In addition to Nueva La Punilla\u2019s reservoir and accompanying transmission line, another local project of concern is the \u00d1uble de Pasada reservoir, also known as <a href=\"https:\/\/radio.uchile.cl\/2018\/03\/30\/el-controversial-proyecto-hidroelectrico-del-cunado-del-presidente\/\">Hidro\u00f1uble<\/a>. Although construction of the project was started, works have been stalled for more than eight years because it will rely upon Nueva La Punilla\u2019s transmission line. The area became a Unesco Biosphere Reserve in 2011, with the aim of protecting the huemul deer.<\/p>\n\n\n\n<p>Two forest biomes converge here, making the area particularly biodiverse: the <a href=\"https:\/\/laderasur.com\/articulo\/el-bosque-esclerofilo-chileno-un-ecosistema-en-peligro-lleno-de-beneficios-para-el-ser-humano-y-la-naturaleza\/\">sclerophyllous<\/a> forest of Chile\u2019s central region, which is adapted to drier conditions and home to hundreds of endemic species already threatened by urbanisation, agricultural expansion and fires; and the Valdivian temperate forests that stretch from the country\u2019s south-west, one of Earth\u2019s oldest forests and characteristically similar to a tropical rainforest.&nbsp;<\/p>\n\n\n\n<p>Intentionally flooding such a celebrated site has inevitably attracted controversy. <\/p>\n\n\n\n<p>Bernardo Reyes, an ecologist and director of the Chilean NGO Ethical Foundation of the Forests (<a href=\"https:\/\/eticaenlosbosques.cl\/\">EEB<\/a>), says the consequences of flooding this area would be manifold: \u201cIt\u2019s going to be similar to a gigantic logging race across 1,700 hectares. (Image: Nicole Kramm \/ Dialogue Earth)<\/div><\/div><\/div><meta itemprop=\"contentUrl\" content=\"https:\/\/dialogue.earth\/content\/uploads\/2024\/04\/20240213_tributary-Sauce-River-mountains_La-Punilla-dam-Nuble-Chile_Nicole-Kramm_Dialogue-Earth.jpg\"\/><meta itemprop=\"contentSize\" content=\"2 MB\"\/><meta itemprop=\"height\" content=\"1440\"\/><meta itemprop=\"width\" content=\"2560\"\/><meta itemprop=\"author\"\/><meta itemprop=\"representativeOfPage\" content=\"true\"\/><\/div>\n\n\n\n<p>In addition, Reyes says increasingly extreme, climate-driven disasters make the mitigatory qualities of biodiversity hotspots ever more crucial: \u201cIn Chile, we have <a href=\"https:\/\/dialogochino.net\/en\/climate-energy\/389148-chile-forest-fires-five-factors-that-led-to-devastating-impacts\/\">increasingly intense droughts and fires<\/a>, and these 1,700 hectares act synergistically with this, and can therefore have a much more intense impact on the biodiversity of the area.\u201d<\/p>\n\n\n\n<p>Meanwhile, others are highlighting how mega-dam projects can lead to greater water scarcity. According to the environmental public policy expert Pamela Poo, \u201cyou&#8217;re going to have water for some irrigation, but then what starts to happen is the expansion of the extractive frontier.\u201d This is especially pertinent considering the nearly 15-year <a href=\"https:\/\/dialogochino.net\/en\/climate-energy\/46221-chile-seeks-to-guarantee-water-rights-amid-severe-drought\/\">mega-drought affecting much of Chile<\/a> that has brought consequences for \u00d1uble: the region is already subject to a water shortage <a href=\"https:\/\/dga.mop.gob.cl\/administracionrecursoshidricos\/decretosZonasEscasez\/Documents\/DTR_66_2023.pdf\">decree<\/a>, enforced by the public works ministry until at least April 2024, and which lays out a collection of special measures in an attempt to ease water scarcity.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-project-beneficiaries\">Project beneficiaries<\/h2>\n\n\n\n<p>In the context of Chile\u2019s mega-drought, the Punilla project is triggering important conversations about water use among affected communities.<\/p>\n\n\n\n<a class=\"wp-block-cd-related-news alignright block--related-news loading\" data-post-id=\"50046221\"><div class=\"block--related-news__image\"><\/div><div class=\"block--related-news__content\"><span class=\"block--related-news__heading\">Recommended<\/span><span class=\"block--related-news__title\"><\/span><\/div><\/a>\n\n\n\n<p>Chile\u2019s 1981 water code separated out the ownership of water from land, then gave full authority for water use to the state \u2013 it can grant water rights to private parties free of charge and in perpetuity. The code was reformed in <a href=\"https:\/\/www.bcn.cl\/leychile\/navegar?idNorma=1174443&amp;idVersion=2023-07-13&amp;idParte=\">2022<\/a> and again in <a href=\"https:\/\/www.bcn.cl\/leychile\/navegar?idNorma=1194150&amp;idParte=10442757\">2023<\/a>, but the privatisation and commodification of Chile\u2019s water remains a significant problem for many communities.<\/p>\n\n\n\n<p>Alexander P\u00e1nez Pinto, a social sciences academic at the University of B\u00edo-B\u00edo, conducted a soon-to-be-published study into the water rights holders in the reservoir\u2019s proposed location. In an advance copy seen by Dialogue Earth, the agricultural company Cruz del Sur is named as a major rights holder that consumes 294 litres of water per second. <\/p>\n\n\n\n<p>P\u00e1nez says Chile has conjured a \u201cperfect storm\u201d between the overexploitation of watersheds for productive uses, the privatisation of water under the code, and the impacts of climate change.<\/p>\n\n\n\n<div class=\"wp-block-cd-pull-quote block--pull-quote\"><div class=\"block--pull-quote__wrapper\"><blockquote class=\"block--pull-quote__quote\">We are at the end of our rope. The company that wins this project will also buy this conflict<\/blockquote><cite class=\"block--pull-quote__cite\">Humberto Illanes Sep\u00falveda, president of Mesa Punilla<\/cite><\/div><\/div>\n\n\n\n<p>Humberto Illanes Sep\u00falveda is the president of Mesa Punilla, a network of 16 rural and urban organisations that are based in the area of the Punilla project. According to him, the main beneficiaries of the project will be those with the water rights \u2013 large companies like Cruz del Sur. \u201cThe rest of us receive nothing, only damages,\u201d he says. \u201cWe bear the sacrifices.\u201d<\/p>\n\n\n\n<p>In September 2022, Mesa Punilla submitted 299 petitions to the Ministry of Public Works regarding the Punilla project. Concerned with mitigation and compensation demands mainly related to water use, road designs and the future of the biosphere reserve, the petitions remain under evaluation and unresolved.<\/p>\n\n\n\n<p>Illanes Sep\u00falveda says the project has \u201cgaps everywhere\u201d and is generating uncertainty. \u201cWe still don\u2019t have concrete answers and we want legal certainty. We have been patient, prudent and flexible. But people have had enough and there is no more confidence in the ministry. We are at the end of our rope. The company that wins this project will also buy this conflict.\u201d<\/p>\n\n\n\n<p>The San Fabi\u00e1n provincial government and the Ministry of Public Works both declined to comment on the issues
