{"id":20049136,"date":"2020-10-21T12:30:47","date_gmt":"2020-10-21T07:00:47","guid":{"rendered":"https:\/\/www.thethirdpole.net\/?p=39853"},"modified":"2021-03-24T17:26:01","modified_gmt":"2021-03-24T11:56:01","slug":"indigenous-rights-undermined-for-hydropower-in-himachal-pradesh","status":"publish","type":"post","link":"https:\/\/dialogue.earth\/en\/justice\/indigenous-rights-undermined-for-hydropower-in-himachal-pradesh\/","title":{"rendered":"Indigenous rights undermined for hydropower in Himachal Pradesh"},"content":{"rendered":"<p>Imagine having to fight four legal battles over 10 years for what is yours even according to the <a href=\"https:\/\/www.india.gov.in\/sites\/upload_files\/npi\/files\/coi_part_full.pdf\">Indian Constitution<\/a>. This is what has happened in the case of the <a href=\"http:\/\/www.indiaenvironmentportal.org.in\/content\/428673\/judgement-of-the-national-green-tribunal-regarding-kashang-hydro-electric-project-in-kinnaur-district-himachal-pradesh-04052016\/\">Kashang Integrated Hydro Electric project<\/a> located in the district of Kinnaur in Himachal Pradesh. Kinnaur is recognised as <a href=\"https:\/\/tribal.nic.in\/declarationof5thSchedule.aspx\">Schedule V<\/a> (with special rights) under the Constitution, because its population is predominantly comprised of forest-dwelling communities.<br \/>\n\u201cWe are frustrated with this project,\u201d said Bhagat Singh Kinnar, a resident of Rarang, an affected village in the district. Kinnar is also the sole petitioner in one of the legal battles.<br \/>\n\u201cPeople have been shouting and screaming, running to the courts and holding protests but this has had no impact\u2026 it seems like the <a href=\"http:\/\/www.hppcl.in\/(X(1)S(djelvt1zx3xrthwimpq0kpqk))\/content\/499_1_Overview.aspx\">Himachal Pradesh Power Corporation<\/a> [HPPCL] has the full support of the [state] government and the bureaucracy,\u201d he added.<br \/>\n<strong>Read:<\/strong> <a href=\"https:\/\/dialogue.earth\/2020\/07\/22\/opinion-himalayan-hydropower-is-not-a-green-alternative\/\">Hydropower projects ruining lives in the Himalayas<\/a><br \/>\nHPPCL is a state-owned company that is executing the Kashang project.<br \/>\nIt was envisaged over a decade ago as a run-of-the-river project on the Kashang and Kerang tributaries of the Sutlej river. It aims to generate 243 megawatts (MW) of hydropower, of which only Stage 1 (65 MW) has been commissioned. Stage II and III (130 MW in total) and Stage IV (48 MW) are yet to be constructed.<\/p>\n<p><figure id=\"attachment_39855\" aria-describedby=\"caption-attachment-39855\" style=\"width: 911px\" class=\"wp-caption alignnone\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-39855 size-full\" src=\"https:\/\/dialogue.earth\/content\/uploads\/2020\/10\/Kashang-hydroelectric-project-Kinnaur-Himachal-Pradesh.jpg\" alt=\"Kashang hydroelectric project, Sumit Mahar, Himdhara\" width=\"911\" height=\"639\"><figcaption id=\"caption-attachment-39855\" class=\"wp-caption-text\">The Kashang Hydro Electric project is a run-of-the-river project on the Kashang and Kerang tributaries of the Sutlej river. Work has not started on Stage II and III, on the Kerang river [Image by: Sumit Mahar, Himdhara]<\/figcaption><\/figure>The Kashang project is one of four HPPCL projects <a href=\"https:\/\/www.financialexpress.com\/archive\/india-signs-591-million-deal-with-adb\/590838\/\">&nbsp;<\/a><a href=\"https:\/\/www.financialexpress.com\/archive\/india-signs-591-million-deal-with-adb\/590838\/\">funded<\/a> by a USD 800 million loan from the Asian Development Bank.<br \/>\nThe problem, Kinnar pointed out, is \u201conce work starts, it is very difficult to stop it because they [HPPCL] tell courts that they have already invested crores of rupees.\u201d<br \/>\nPeople from the district are protesting against the forest clearance granted to Stage II and III.<br \/>\nThey are entitled to forest rights under the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act (FRA), 2006, but forest land has been diverted in violation of the FRA law&nbsp;to build the hydropower project.<br \/>\nThe communities are also concerned about the project\u2019s downstream impacts such as landslides and flooding, and the springs they depend on for irrigation drying up.<br \/>\n<strong>Legal debate<\/strong><br \/>\nThey are more worried now, after a meeting of the Expert Appraisal Committee (EAC) in June 2020. The EAC met to deliberate a proposal by HPPCL to extend the environmental clearance (EC) granted to the Kashang project in 2010. The EC expired in April 2020 and HPPCL sought an eight-year extension, claiming \u201cwork on other stages [apart from State I] could not be taken up due to pending litigation by the local inhabitants in the NGT [National Green Tribunal].\u201d<br \/>\nRitwick Dutta, an environmental lawyer and founder of the NGO Legal Initiative for Forest and Environment (LIFE), told <a href=\"https:\/\/dialogue.earth\/\">The Third Pole<\/a> this argument is false because \u201cthe NGT never issued stay orders in this case\u201d. \u201cHPPCL misled the EAC by claiming that the delay [in construction] was because of litigation,\u201d Dutta added.<br \/>\nNevertheless, the EAC ruled that the clearance granted a decade ago is \u201cperpetual\u201d. It based this on the fact that since all the four stages are integrated, \u201cthe project is treated as a single project\u201d wherein Stage 1 was completed and commissioned in 2016.<br \/>\nBut others say this interpretation is absurd.<br \/>\n\u201cAll the stages [of the project] are not interdependent,\u201d said Manshi Asher, a researcher at <a href=\"http:\/\/www.himdhara.org\">Himdhara<\/a>, a Himachal Pradesh-based environmental research and action collective. \u201cStage II and III are on a different river [Kerang], the land that they need now, the river that they are disrupting and the villages that will ultimately be affected are different,\u201d she noted, adding that with the construction of Stage II and III, \u201ca whole new valley will be affected.\u201d<br \/>\n<strong>Read:<\/strong> <a href=\"https:\/\/dialogue.earth\/2020\/07\/22\/opinion-himalayan-hydropower-is-not-a-green-alternative\/\">Himachal Pradesh offers lessons about risks of building large dams in the Himalayas<\/a><br \/>\n\u201cWe have seen the impacts of Stage I,\u201d Asher said referring to <a href=\"https:\/\/www.outlookindia.com\/newsscroll\/nepali-dies-in-massive-landslides-in-hps-kinnaur-apple-orchards-damaged\/1819972\">landslides<\/a> and <a href=\"https:\/\/www.hindustantimes.com\/punjab\/dams-brimming-in-himachal-pradesh-water-being-released-without-warning\/story-Rz0XzopYoBapjrYlhm2A6N.html\">flooding<\/a>. \u201cThese same issues will come up for Stage II and III and our [signatories to <a href=\"http:\/\/www.himdhara.org\/hydropower\/stop-ec-kashang-hep\/\">this<\/a> petition to the EAC] demand is that Stage II and III should not be allowed to be built.\u201d<\/p>\n<p><figure id=\"attachment_35753\" aria-describedby=\"caption-attachment-35753\" style=\"width: 1020px\" class=\"wp-caption alignnone\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-35753\" src=\"https:\/\/dialogue.earth\/content\/uploads\/2020\/07\/House-damged-at-Pangi-village-during-2013-monsoon.-PHOTO-CREDIT-Sumit-Mahar-JPG.jpg\" alt=\"\" width=\"1020\" height=\"765\"><figcaption id=\"caption-attachment-35753\" class=\"wp-caption-text\">House damaged during the 2013 monsoon in Pangi, a village in Kinnaur, Himachal Pradesh affected by slope failure following construction for the Kashang stage 1 hydroelectricity project [Image by: Sumit-Mahar]<\/figcaption><\/figure><strong>Forest rights undermined <\/strong><br \/>\nPeople from Lippa, another village in Kinnaur, are fighting a legal battle against the forest clearance granted to Stage II and III of the Kashang project by the Ministry of Environment, Forest and Climate Change (MoEFCC) in 2011.<br \/>\nAccording to <a href=\"http:\/\/nromoef.gov.in\/Proforma\/Format%2520of%2520Forests%2520%2520Right%2520Act.pdf\">guidelines and clarifications<\/a> issued by the MoEFCC regarding the Forest (Conservation) Act (FCA), 1980, forest rights have to be settled and a No Objection Certificate (NOC) has to be obtained from the village council or gram sabha for forest clearance.<br \/>\nAdditionally, given that Kinnaur is a Schedule V area, special provisions like the <a href=\"https:\/\/tribal.nic.in\/actRules\/PESA.pdf\">Panchayats (Extension to Scheduled Areas) Act, 1996<\/a> say that the consent of the gram sabha is necessary if local natural resources are to be diverted towards \u2018development projects\u2019.<br \/>\nHPPCL, however, did not get an NOC from the gram sabha. This was one of the main grounds on which the clearance was challenged in the NGT in 2011 by Paryavan Sanrakshan Sangarsh Samiti, an organisation formed by the villagers of Lippa. Other grounds include concerns regarding ecological fragility, dam safety and impact on livelihoods and cultural rights.<br \/>\nHPPCL did not respond to queries sent by <a href=\"https:\/\/dialogue.earth\/\">The Third Pole<\/a> on why, when multiple laws call for gram sabha consent, it has not been obtained.<br \/>\nIn the forest clearance case, the NGT ruled in 2016 that both the individual and community forest rights have to be settled and that all socio-cultural impacts of the project have to be placed before the gram sabha.<br \/>\nAfter the NGT order, both individual and community forest rights claims were filed. \u201cThey rejected all [47] claims for individual forest rights and the people have challenged the rejection in the Shimla High Court,\u201d said Tashi Chewang, secretary of the forest rights committee for Lippa\u2019s gram sabha.<br \/>\nThe community forest rights were approved in August 2018, but \u201ctitle [deeds] have not been given to the people yet,\u201d Chewang said. While the FRA processes were underway, in October 2018 the Himachal Pradesh government issued orders for the diversion of land for Stage II and III.<br \/>\n\u201cNot granting the title deeds raises questions\u2026 if they verified the claims and found them to be adequate, why haven\u2019t they issued deeds yet?\u201d Asher asked.<br \/>\nThe Himachal Pradesh government also did not obtain consent from the gram sabha before issuing orders for land diversion, which is mandatory according to the <a href=\"https:\/\/himachal.nic.in\/WriteReadData\/l892s\/13_l892s\/1394019302.pdf\">&nbsp;<\/a><a href=\"https:\/\/himachal.nic.in\/WriteReadData\/l892s\/13_l892s\/1394019302.pdf\">Himachal Pradesh Lease Rules, 2013<\/a>.<br \/>\nBut Gopal Chand, deputy commissioner for Kinnaur, said \u201cwe are in full compliance of the NGT order and the [Himachal Pradesh] Lease Rules\u201d and added that he sees \u201cno violation\u201d.<br \/>\nAnd so, in the fourth legal battle taken on by local communities \u2013 the third being the case against the rejection of individual forest rights \u2013 the lease granted to the Kashang project was challenged in the Shimla High Court in January, 2019.<br \/>\nChewang is the sole petitioner in this case. The matter is pending hearing.<br \/>\nSince the forest rights are yet to be settled, the move by the Himachal Pradesh government to issue orders for land diversion violates the NGT ruling, in addition to being a violation of the FRA and FCA.<br \/>\n\u201cThere\u2019s no respect for the [FRA] law because there\u2019s no implementation,\u201d Kinnar said. \u201cThey make laws just to fool
