{"id":20068274,"date":"2021-03-16T13:05:40","date_gmt":"2021-03-16T07:35:40","guid":{"rendered":"https:\/\/www.thethirdpole.net\/?p=68274"},"modified":"2021-03-23T17:39:52","modified_gmt":"2021-03-23T12:09:52","slug":"disaster-safety-ignored-himalayan-state","status":"publish","type":"post","link":"https:\/\/dialogue.earth\/en\/justice\/disaster-safety-ignored-himalayan-state\/","title":{"rendered":"Disaster looms as safety norms are ignored in Himalayan state"},"content":{"rendered":"\n<p>After years of legal tug of war, the mountain state of Himachal Pradesh could see a new relaxation of its urban planning rules, despite repeated warnings about the dangers of unfettered development on its cities\u2019 fragile terrains.<\/p>\n\n\n\n<p>According to a 2015 <a href=\"https:\/\/hpsdma.nic.in\/admnis\/admin\/showimg.aspx?ID=2671\" target=\"_blank\" rel=\"noreferrer noopener\">report<\/a> on landslide vulnerability, most of the built-up areas in Himachal Pradesh, northern India, are in a high-risk zone. Seven out of 12 districts of the state fall in <a href=\"https:\/\/moes.gov.in\/writereaddata\/files\/LS_US_1780_26072017.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">seismic zone V<\/a>, the most vulnerable.\u00a0<\/p>\n\n\n\n<p>The state\u2019s capital Shimla was planned by the British for a <a href=\"http:\/\/www.hpenvis.nic.in\/ViewGeneralLatestNews.aspx?format=Print&amp;Id=941\" target=\"_blank\" rel=\"noreferrer noopener\">population<\/a> of 16,000 but now has a <a href=\"https:\/\/cdn.s3waas.gov.in\/s3b534ba68236ba543ae44b22bd110a1d6\/uploads\/2018\/03\/2018030797.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">population<\/a> of 201,500, according to the last census carried out in 2011. Other cities and towns have also far exceeded their carrying capacity. Facilities such as water supply, sanitation, waste disposal and traffic management have not kept pace with rapid growth. These new parts of the city end up lacking essential services and face increased risks,\u201d Negi added.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-flurry-of-regularisation-schemes\">Flurry of regularisation schemes<\/h2>\n\n\n\n<p>In 2019, India\u2019s environmental court, the National Green Tribunal (NGT), acknowledged the lack of basic amenities and <a href=\"http:\/\/www.indiaenvironmentportal.org.in\/files\/file\/air-monitoring-Manali-report-NGT.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">banned<\/a> new construction other than residential structures in Manali and McLeodganj towns until facilities for waste management and water supply were developed.\u00a0<\/p>\n\n\n\n<p>The apex body for disaster management, the National Disaster Management Authority, mandates regular monitoring of the safety of lifeline buildings such as hospitals, schools, and fire service stations, but in Himachal Pradesh an <a href=\"https:\/\/cag.gov.in\/webroot\/uploads\/download_audit_report\/2017\/Himachal_Pradesh_Report_No_3_of_2017_Social_General_Economic_Sectors_Non_PSUs.pdf\">audit has been pending<\/a> for five years.<\/p>\n\n\n\n<p>Despite the warnings, the government has recently issued <a href=\"http:\/\/rajpatrahimachal.nic.in\/OPENFILE1.aspx?ID=%20174\/GAZETTE\/2020-15\/12\/2020%20&amp;etype=SPECIAL\" target=\"_blank\" rel=\"noreferrer noopener\">a new amendment of urban rules,<\/a> proposing to authorise local authorities and state governments to further relax safety norms, both for government buildings and private constructions.\u00a0<\/p>\n\n\n\n<p>Ashwani Sharma, a senior journalist from Shimla, <a href=\"https:\/\/citizenmatters.in\/climate-crisis-in-tier-2-cities-a-discussion-23765\">links<\/a> this amendment to municipal elections, which were held shortly after the draft was published. These rules set parameters such as maximum height, number of floors, minimum open space around a building and parking space. The <a href=\"http:\/\/tcp.hp.gov.in\/Application\/uploadDocuments\/content\/HP_TCP_Act_1977-2015_V4_1-converted_1.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Himachal Pradesh Town and Country Planning Act<\/a> (TCPA) dates back to 1977.\u00a0<\/p>\n\n\n\n<p>In almost all cities \u2013 including those in the Himalayas \u2013 such rules are frequently ignored. Authorities say that the city is extremely vulnerable to landslides and prone to earthquakes.&nbsp;<\/p>\n\n\n\n<p>In 2017, the National Green Tribunal banned the construction of any new buildings in core, green and forest areas in Shimla, which has the <a href=\"https:\/\/www.tribuneindia.com\/news\/archive\/himachal\/25-000-illegal-structures-in-himachal-cry-out-for-comprehensive-solution-589624\" target=\"_blank\" rel=\"noreferrer noopener\">highest<\/a> number of illegal structures in the state, and <a href=\"https:\/\/www.casemine.com\/judgement\/in\/5c060b3eb338d16e11efe601\" target=\"_blank\" rel=\"noreferrer noopener\">restricted<\/a> the number of storeys to two floors and an attic for buildings in other areas. The court did so as a preventive measure in the absence of scientific assessments and risk evaluation in different areas of the city.\u00a0<\/p>\n\n\n\n<p>The Comptroller and Auditor General of India, the government auditor, <a href=\"https:\/\/cag.gov.in\/webroot\/uploads\/download_audit_report\/2017\/Himachal_Pradesh_Report_No_3_of_2017_Social_General_Economic_Sectors_Non_PSUs.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">warned<\/a> that\u00a0 \u201chaphazard construction of buildings with no space for providing relief and rehabilitation [in Shimla] may result in abnormally high casualties during disaster\u201d and found that the disaster preparedness of the state was weak. As recently as June last year, a five-storey building <a href=\"https:\/\/www.tribuneindia.com\/news\/himachal\/building-collapses-in-shimla-95610\" target=\"_blank\" rel=\"noreferrer noopener\">collapsed<\/a> in Chhota Shimla due to <a href=\"https:\/\/himachalwatcher.com\/2020\/06\/06\/shimla-multi-storey-building-in-kasumpti-area-collapsed-on-june-6-2020\/\" target=\"_blank\" rel=\"noreferrer noopener\">a weak foundation<\/a>.\u00a0<\/p>\n\n\n\n<p>But the state government circumvented court-imposed restrictions. In 2018, it granted a year to offenders to demolish illegal structures, and eventually legalised them; and in 2019 it <a href=\"https:\/\/www.tribuneindia.com\/news\/archive\/himachal\/govt-amends-tcp-rules-violators-to-benefit-828529\">authorised<\/a> structures initiated without an approved plan by altering the Town and Country Planning rules.\u00a0<\/p>\n\n\n\n<p>Even court decisions have been viewed critically.<\/p>\n\n\n\n<p>\u201cThis limit of 2.5 storeys doesn\u2019t allow cities to grow. This has a direct impact on people\u2019s livelihoods,\u201d said Deven Khanna, an advocate and resident of Shimla. \u201cIf vertical growth is not allowed, it will translate into destruction of the environment as the constructions will spread horizontally.\u201d Urban planners too have not found the court-imposed blanket restrictions helpful.&nbsp;<\/p>\n\n\n\n<div class=\"wp-block-cd-article-image aligncenter block--article-image\" itemscope itemtype=\"http:\/\/schema.org\/ImageObject\"><div class=\"block--article-image__column\"><div class=\"block--article-image__image\"><img class=\"lazy\" data-src=\"https:\/\/dialogue.earth\/content\/uploads\/2021\/03\/shimla.jpg\" data-srcset=\"https:\/\/dialogue.earth\/content\/uploads\/2021\/03\/shimla-768x512.jpg 768w, https:\/\/dialogue.earth\/content\/uploads\/2021\/03\/shimla-1024x683.jpg 1024w, https:\/\/dialogue.earth\/content\/uploads\/2021\/03\/shimla.jpg 1500w\" data-sizes=\"(max-width: 600px) 768px, (max-width: 1024px) 1024px, 1500px\" alt=\"urban development in Shimla\"\/><\/div><div class=\"block--article-image__content\"><div itemprop=\"caption\" class=\"block--article-image__caption\">Urban development in Shimla [Image by: Lou Del Bello]<\/div><\/div><\/div><meta itemprop=\"contentUrl\" content=\"https:\/\/dialogue.earth\/content\/uploads\/2021\/03\/shimla.jpg\"\/><meta itemprop=\"contentSize\" content=\"842 KB\"\/><meta itemprop=\"height\" content=\"1000\"\/><meta itemprop=\"width\" content=\"1500\"\/><meta itemprop=\"author\"\/><meta itemprop=\"representativeOfPage\" content=\"true\"\/><\/div>\n\n\n\n<p>Tikendar Panwar, former deputy mayor of Shimla and convenor of the National Coalition for Inclusive Sustainable Urbanisation, feels that the court\u2019s approach is arbitrary. \u201cCertain parts of Himachal can withstand more storeys than two and a half and some need to be restricted at an even lower number,\u201d he said. \u201cTraditional Himachali homes have two storeys, for instance, and many buildings built in the British era have five-six storeys.\u201d&nbsp;<\/p>\n\n\n\n<p>The 2015 land use <a href=\"http:\/\/tcp.hp.gov.in\/Application\/uploadDocuments\/devlopmentPlan\/PlanDoc020150127_173301.pdf\">map<\/a> of the Shimla Planning Area shows that only a tiny portion of\u00a0the land is occupied by open spaces and parks. This may compromise relief and evacuation measures in the event of natural disasters. Due to the rapid growth of the city, Shimla is also falling short on water supply: the city now needs around 39 million litres a day, <a href=\"http:\/\/tcp.hp.gov.in\/Application\/uploadDocuments\/devlopmentPlan\/PlanDoc020150127_173301.pdf\">but only 30 million is available<\/a>. Rural settlements, which are now part of the planning area, still depend on natural water sources for their needs.\u00a0<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-is-there-a-way-out\">Is there a way out?<\/h2>\n\n\n\n<p>Urban planners, local residents and scholars agree that one-size-fits-all approaches will not work for Himachal Pradesh. \u201cWe need distinct guidelines for different areas factoring in the vulnerability of sites, their geology and stability,\u201d Panwar suggested.<\/p>\n\n\n\n<p>The episode of acute water scarcity Shimla witnessed in 2018, which led the city to close its doors to tourists for the season, made news internationally. It was a sign of the challenges posed by unfettered urban development. \u201cWe need to rethink the philosophy of development so that it incorporates the aspects of human health, environment and climate vulnerability,\u201d Negi said. On a practical level, \u201cWe need to engage the youth and locals in a democratic rethinking of their cities.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Authorities in Himachal
