They are found only in parts of India, Pakistan and Sri Lanka, where they inhabit dry grasslands and scrub.<\/p>\n\n\n\n<p>They\u2019re attractive, easy to care for and have a long lifespan, Jose Louies, joint director of the wildlife&nbsp;conservation charity Wildlife Trust of India, told&nbsp;<a href=\"https:\/\/dialogue.earth\/en\/\">The Third Pole<\/a>. There\u2019s a belief in parts of Southeast Asia that tortoises bring luck, he added.<\/p>\n\n\n\n<p>It is these qualities that make the Indian star tortoise sought after as a pet. Against a backdrop of habitat loss and degradation, collection for the international pet trade has reached such a scale that the species\u2019 survival in the wild is under threat.&nbsp;<a href=\"https:\/\/www.worldanimalprotection.nl\/sites\/default\/files\/media\/nl_files\/dieren_in_het_wild\/indian_star_tortoise_report_final_eng.pdf\">Research in 2016<\/a>&nbsp;found that the Indian star tortoise is seized from illegal trade more than any other tortoise species. These threats have led the International Union for Conservation of Nature (IUCN) to&nbsp;<a href=\"https:\/\/www.iucnredlist.org\/species\/39430\/123815345\">categorise<\/a>&nbsp;the Indian star tortoise as \u201cvulnerable\u201d \u2013 one step away from endangered \u2013 on its Red List of Threatened Species.<\/p>\n\n\n\n<p>In 2019, international commercial trade in Indian star tortoises was banned when the species was added to <a href=\"https:\/\/cites.org\/eng\/app\/appendices.php\">Appendix I<\/a> of the United Nations Convention on International Trade in Endangered Species of Wild Fauna and Flora, or CITES, following advocacy efforts from India, Sri Lanka, Bangladesh and Senegal.&nbsp;<\/p>\n\n\n\n<div class=\"wp-block-cd-accordion block--accordion\"><span class=\"block--accordion__title\">What is CITES?<\/span><div class=\"block--accordion__content\"><div class=\"block--accordion__content__inner\">\n<p><p>The Convention on International Trade in Endangered Species of Wild Fauna and Flora \u2013 or CITES \u2013 is a legally binding global agreement signed by 183 countries intended to ensure that international trade in wild animals or plants does not lead to the extinction of the species in the wild.<\/p><\/p>\n\n\n\n<p><p>CITES applies to species that are listed on one of its appendices. An Appendix I listing \u2013 meant for the species most threatened by trade \u2013 prohibits international commercial trade. Any movement of these species across borders must be granted permits by both the exporting and importing country.\u00a0<\/p><\/p>\n\n\n\n<p><p>An Appendix II listing allows regulated commercial trade, but only if the country of export grants an export permit. Appendix III listings require permits for trade in that species from a specific country. Countries can face sanctions if they fail to meet their obligations under CITES, including a temporary ban on trade in any CITES-listed species.<\/p><\/p>\n\n\n\n<p><p>Only a small proportion of the world\u2019s animal and plant species are listed on and therefore regulated under CITES. The <a href=\"https:\/\/trade.cites.org\/\">CITES trade database<\/a>, published online, includes records of international movements of CITES-listed species since 1975.<\/p><\/p>\n<\/div><\/div><\/div>\n\n\n\n<p>The Indian star tortoise had previously been on Appendix II, meaning regulated trade was allowed with export permits. But according to the CITES trade database, no permits for the commercial export of Indian star tortoises collected from the wild had been issued by India, Sri Lanka or Pakistan since 1999. Yet star tortoises continued to be traded illegally in their thousands. In 2017 alone, <a href=\"https:\/\/www.traffic.org\/news\/indian-star-tortoise-seizure-in-thailand-brings-years-total-to-over-6000-individuals-seized\/\">6,040 Indian star tortoises<\/a> were seized in 11 incidents across India, Sri Lanka, Cambodia, Malaysia, Singapore and Thailand.<\/p>\n\n\n\n<div class=\"wp-block-cd-pull-quote block--pull-quote\"><div class=\"block--pull-quote__wrapper\"><blockquote class=\"block--pull-quote__quote\">In most countries, targeting crimes involving Appendix I species is prioritised, and penalties are commensurately higher<\/blockquote><cite class=\"block--pull-quote__cite\">Kanitha Krishnasamy, TRAFFIC<\/cite><\/div><\/div>\n\n\n\n<p>The successful <a href=\"https:\/\/cites.org\/sites\/default\/files\/eng\/cop\/18\/prop\/060319\/E-CoP18-Prop-36.pdf\">proposal<\/a> to uplist the species to Appendix I highlighted a significant population decline and a sharp increase in illegal trade. In one example, over 55,000 star tortoises are <a href=\"https:\/\/natureconservation.pensoft.net\/article\/5625\/\">reported<\/a> to have been illegally collected from a single area in the Indian state of Andhra Pradesh during 2014.<\/p>\n\n\n\n<div class=\"wp-block-cd-pullout-stat alignleft undefined block--pullout-stat\"><p class=\"block--pullout-stat__title\">6,040 Indian star tortoises<\/p><div class=\"block--pullout-stat__content\"><p>seized in 11 incidents across India, Sri Lanka, Cambodia, Malaysia, Singapore and Thailand in 2017<\/p><\/div><\/div>\n\n\n\n<p>An Appendix I listing can lead to stronger action to control commercial trade in the species, explained Kanitha Krishnasamy, director for conservation NGO TRAFFIC in Southeast Asia, in an email to The Third Pole.<\/p>\n\n\n\n<p>\u201cIn most countries, targeting crimes involving Appendix I species is prioritised, and penalties are commensurately higher, in the hopes of creating a deterrent effect. Unfortunately, this hasn&#8217;t quite happened in most consumer states [of the Indian star tortoise], resulting in India\u2019s population of the species continuing to face immense pressure,\u201d said Krishnasamy.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-star-tortoise-trade-continues\">Star tortoise trade continues<\/h2>\n\n\n\n<p>In India, data collated by the non-profit the Wildlife Protection Society of India and shared with The Third Pole shows that authorities seized 3,500 star tortoises in 24 incidents across 2020 and 2021 \u2013 after the CITES ban came into effect. In 2022 so far, there have been two reported seizures in the country, involving a total of 1,498 star tortoises. Given that only a small proportion of smuggling attempts are likely intercepted by authorities, the true number of tortoises in ongoing illegal trade is likely far higher.<\/p>\n\n\n\n<iframe src=\"https:\/\/flo.uri.sh\/visualisation\/8484524\/embed\" title=\"Interactive or visual content\" class=\"flourish-embed-iframe\" frameborder=\"0\" scrolling=\"no\" style=\"width:100%;height:600px;\" sandbox=\"allow-same-origin allow-forms allow-scripts allow-downloads allow-popups allow-popups-to-escape-sandbox allow-top-navigation-by-user-activation\"><\/iframe><div style=\"width:100%!;margin-top:4px!important;text-align:right!important;\"><\/div>\n\n\n\n<p>Their journey usually begins, according to Louies who has worked undercover identifying star tortoise trade routes, with a local person spotting the tortoise in the wild and passing it on to a collector in exchange for a small finder\u2019s fee. It is then given to an exporter who packs numerous tortoises together, hiding them in vegetable cartons, suitcases, or cargo. Tape is wrapped around the star tortoises\u2019 legs to limit movement before they are flown out of the country, most often to a destination in Southeast Asia.<\/p>\n\n\n\n<p>Airport staff, trained to look for narcotics or metal objects rather than reptiles, tend to miss the tortoises, Louies explained.&nbsp;<\/p>\n\n\n\n<p>Once landed, traders might sell them locally. Alternatively, they might be sent on to another country further afield for higher prices. With the kind of distress, disease and respiratory problems [they experience], can come cracked shells and suffocation,\u201d D\u2019Cruze said.<\/p>\n\n\n\n<p>The eventual owners will be likely unaware of their new pet\u2019s backstory, Louies said. \u201cIt\u2019s like a camera or mobile phone. You purchase but you don\u2019t worry about whether your iPhone is manufactured in a sweatshop in China or Vietnam or Bangladesh,\u201d he added.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-law-enforcement-failing-to-protect-tortoises\">Law enforcement failing to protect tortoises<\/h2>\n\n\n\n<p>In India, where the star tortoise is protected under Schedule IV of the Wildlife (Protection) Act 1972, anyone found in possession of the species could face criminal charges, with sentences of up to six months\u2019 imprisonment. But in reality, the punishment is likely to be only a small fine and a shorter jail sentence, even for those who are known to be seasoned smugglers, Louies said. One man in particular, he said, flew between Chennai and Bangkok with star tortoises in his possession over 34 times in two years before he was caught. While his case is still ongoing, Louies believes he is unlikely to receive a sentence longer than three to six months.<\/p>\n\n\n\n<p>The lack of clear punishment for illegal trade of the star tortoise means there isn\u2019t enough of a deterrent for traders, according to Louies. \u201cIt boils down to intelligence-led investigations to crack down on criminal networks and enforcement of regulations and laws,\u201d Krishnasamy said.<\/p>\n\n\n\n<div class=\"wp-block-cd-pull-quote block--pull-quote\"><div class=\"block--pull-quote__wrapper\"><blockquote class=\"block--pull-quote__quote\">I send you star tortoises, you give me fish<\/blockquote><cite class=\"block--pull-quote__cite\">Jose Louies, Wildlife Trust of India<\/cite><\/div><\/div>\n\n\n\n<p>Another challenge is the fact that in many countries, legal protections are limited to native species. While the act of smuggling an Indian star tortoise into a country itself is illegal thanks to CITES, once a star tortoise has entered many countries \u2013 including Thailand and Indonesia \u2013 it is not protected. This means authorities may be unable to investigate and prosecute buying, selling and possession of the smuggled animals.<\/p>\n\n\n\n<p>In Indonesia, loopholes mean \u201cif you make it past customs you\u2019re basically home free and can sell them openly in the shops\u201d, said Chris Shepherd, executive director at Monitor Conservation Research Society, a non-profit dedicated to preventing a decline in species impacted by wildlife trade through research.&nbsp;<\/p>\n\n\n\n<p>NGOs such as TRAFFIC have <a href=\"https:\/\/www.traffic.org\/news\/legal-loopholes-leave-non-native-wildlife-unprotected-in-thailand\/\">encouraged<\/a> Thailand to expand its laws to cover non-native species. Campaigners have also urged the <a href=\"https:\/\/www.prowildlife.de\/wp-content\/uploads\/2016\/11\/Illegal-wildlife-trade-and-the-EU_legal-approaches.pdf\">European Union<\/a> to follow the example of the United States, where the <a href=\"https:\/\/www.fws.gov\/international\/laws-treaties-agreements\/us-conservation-laws\/lacey-act.html\">Lacey Act<\/a> makes it illegal to buy or sell any species that was collected in violation of laws in its native country.<\/p>\n\n\n\n<p>Malaysia\u2019s listing of the star tortoise as a protected species under its Wildlife Conservation Act 2010 has meant its removal from pet shops. Yet even when laws do exist to protect species like the star tortoise, Shepherd warned in many places they are \u201calmost a bad joke\u201d. He called for countries failing to enforce CITES to be penalised.<\/p>\n\n\n\n<p>Trade sanctions are supposed to be enforced on countries if they don\u2019t fulfil their duties under CITES, but in practice these have been few and far between, said Alice Hughes, professor at the Chinese Academy of Sciences, focusing on Southeast Asian conservation science. \u201cEven the tools it [CITES] does have are not being used,\u201d said Hughes.&nbsp;<\/p>\n\n\n\n<div class=\"wp-block-cd-pullout-stat alignright undefined block--pullout-stat\"><p class=\"block--pullout-stat__title\">55,000 Indian star tortoises<\/p><div class=\"block--pullout-stat__content\"><p>reported to have been illegally collected from a single area in the Indian state of Andhra Pradesh during 2014<\/p><\/div><\/div>\n\n\n\n<p>Embedding heavy fines or year-long prison sentences into national frameworks alongside proper investigations into supply chains could help tackle persistent illegal trade in Indian star tortoises, said Louies.<\/p>\n\n\n\n<p>Investigations that tackle players higher up the trade chain \u2013 rather than simply penalising often vulnerable (and replaceable) smaller players \u2013 have been repeatedly emphasised by wildlife trafficking experts as a key missing piece of the enforcement puzzle. But following the money to unearth such groups can be difficult, Louies said, as traders often negotiate in terms of product rather than any money being exchanged. \u201cI send you star tortoises, you give me fish.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-is-cites-failing-reptiles\">Is CITES failing reptiles?<\/h2>\n\n\n\n<p>Calling the treaty \u201cnot fit for purpose\u201d, specifically for reptiles, Hughes highlighted persistent issues in the implementation of CITES, including the fact that less than <a href=\"https:\/\/natureneedsmore.org\/wp-content\/uploads\/2019\/05\/CITES-Fix-the-System-version-2.pdf\">8% of CITES records<\/a> are free of discrepancies, which hinders its effectiveness.&nbsp;<\/p>\n\n\n\n<p>For example, between 2000 and 2015, <a href=\"https:\/\/cites.org\/sites\/default\/files\/eng\/cop\/18\/prop\/060319\/E-CoP18-Prop-36.pdf\">CITES data<\/a> listed over 70,000 Indian star tortoises as being traded internationally. Jordan, Ukraine, Hong Kong and Slovenia were identified as the biggest exporters. The lack of reports listing imports into these countries \u2013 which have no wild star tortoises \u2013 raised questions as to how they could hold such high numbers, particularly given the species does not breed well in captivity.<\/p>\n\n\n\n<p>&#8220;There are severe concerns that the star tortoises exported from Jordan, Ukraine, Hong Kong and Slovenia during that time were not bred legally in captivity,\u201d D\u2019Cruze said, adding that none appeared to have the proper CITES import records in place. \u201c[This] raises important questions about the legality of their founding stock.\u201d<\/p>\n\n\n\n<iframe src=\"https:\/\/flo.uri.sh\/visualisation\/8527490\/embed\" title=\"Interactive or visual content\" class=\"flourish-embed-iframe\" frameborder=\"0\" scrolling=\"no\" style=\"width:100%;height:600px;\" sandbox=\"allow-same-origin allow-forms allow-scripts allow-downloads allow-popups allow-popups-to-escape-sandbox allow-top-navigation-by-user-activation\"><\/iframe><div style=\"width:100%!;margin-top:4px!important;text-align:right!important;\"><a class=\"flourish-credit\" href=\"https:\/\/public.flourish.studio\/visualisation\/8527490\/?utm_source=embed&amp;utm_campaign=visualisation\/8527490\" target=\"_top\" style=\"text-decoration:none!important\" rel=\"noopener\"><\/a><\/div>\n\n\n\n<p>Six years later, discrepancies continue to exist. CITES trade data shows that, in 2020, Sri Lanka, Germany and the UK reported the export of captive-bred Indian star tortoises, but no reports of imports were received, despite import permits being required for Appendix I species.<\/p>\n\n\n\n<p>\u201cGetting real numbers [of CITES-listed species traded internationally] can be hard, submissions may be late \u2013 if ever \u2013 and it\u2019s harder to cross-reference between countries. So if one country said it exported X units to another, you can&#8217;t check in a realistic timeframe how many were received. This makes tracking and monitoring trade harder,\u201d Hughes said.&nbsp;<\/p>\n\n\n\n<p>The CITES system also only offers protections to a small subset of species \u2013 particularly mammals \u2013 while neglecting reptiles and amphibians, Hughes added. <a href=\"https:\/\/cites.org\/eng\/disc\/species.php\">CITES Appendix I<\/a> lists 325 mammal species, compared with 98 reptiles.<\/p>\n\n\n\n<p>Countries also have to prove that a species is threatened by trade in order to get it listed. This can be a slow process, whereas trade trends in the pet industry can <a href=\"https:\/\/news.mongabay.com\/2019\/01\/new-species-of-leaf-mimicking-lizard-could-already-be-victim-of-pet-trade\/\">lead swiftly<\/a> to overharvesting from the wild. But, \u201cat the moment, CITES is the only legislative tool that deals with international wildlife trade and its impacts from a sustainability and conservation perspective on a global scale.\u201d It needs to be supplemented with human behaviour change while the root causes of consumer demand are addressed, he added.&nbsp;<\/p>\n\n\n\n<p>For the Indian star tortoise, this will mean reducing demand
