The world\u00a0rightly\u00a0celebrated when\u00a0195\u00a0countries\u00a0signed onto a new international climate agreement<\/a>\u00a0at COP21 in Paris late last year.\u00a0The Paris Agreement\u00a0is a critical turning point\u2014a fundamental pivot toward a zero-carbon and climate-resilient world.\u00a0But\u00a0some key steps lie ahead\u00a0to take the momentum from Paris forward and ensure that\u00a0the\u00a0Agreement\u00a0quickly\u00a0comes into effect\u00a0and is\u00a0fully implemented.<\/p>\n

We answer\u00a0questions on the\u00a0important steps countries must take\u00a0to ensure\u00a0that\u00a0the Paris Agreement comes into force.<\/p>\n

At COP21, countries agreed to the Paris Agreement. Does that mean the Agreement is now in effect?\u00a0<\/strong><\/p>\n

No, countries still need to take steps so that it\u00a0takes effect.\u00a0What occurred\u00a0on December 12<\/a>\u00a0at COP21 was the \u201cadoption\u201d of the Paris Agreement by the Conference of the Parties\u00a0(COP)\u00a0to the\u00a0UN Framework\u00a0Convention\u00a0on Climate Change (UNFCCC).\u00a0\u00a0Adoption\u00a0is the formal act\u00a0that\u00a0establishes\u00a0the form and content of an\u00a0agreement.<\/p>\n

In addition\u00a0to\u00a0adopting the\u00a0Paris\u00a0Agreement, the Parties made a\u00a0number of key decisions\u00a0about what\u2019s necessary for the Agreement to enter into force.\u00a0 They also agreed on a process\u00a0for\u00a0how countries will finalize their\u00a0current national climate plans\u00a0and shift them from being\u00a0Intended Nationally Determined Contributions\u00a0(INDCs)<\/a>\u00a0into Nationally Determined Contributions (NDCs).<\/p>\n

What needs to happen now?<\/strong><\/p>\n

Broadly speaking, countries must now\u00a0actually\u00a0join the Paris Agreement\u00a0and become Parties to it.\u00a0\u00a0To do this,\u00a0each country\u00a0must\u00a0now\u00a0sign and indicate their consent to be bound by\u00a0the Agreement.\u00a0Only after at least 55\u00a0Parties\u00a0representing\u00a0at least\u00a055 percent of\u00a0total\u00a0global greenhouse gases sign on\u00a0and indicate their consent\u00a0to be bound, will the Agreement\u00a0\u201center into force”. Only after this will it become\u00a0legally binding.<\/p>\n

\"\"<\/a><\/p>\n

After coming\u00a0into force,\u00a0the first meeting of Parties to the Paris Agreement\u00a0will be held. This will be an important\u00a0time\u00a0to adopt many of the more detailed rules and procedures necessary to\u00a0make the Agreement effective.<\/p>\n

What\u2019s the timeline for countries to ratify the Agreement?\u00a0<\/strong><\/p>\n

On April 22,\u00a02016, all heads of state\u00a0will sign the Agreement at a high-level signing ceremony\u00a0at\u00a0the United Nations in New York.\u00a0 The Agreement will then be open for signature for one year,\u00a0until April\u00a021,\u00a02017.\u00a0 Given the importance of the Paris Agreement and the political momentum created at COP21,\u00a0experts expect\u00a0many countries\u00a0will\u00a0attend\u00a0the high-level signing\u00a0event.<\/p>\n

While signing\u00a0indicates\u00a0a\u00a0commitment\u00a0to refrain from acts that would defeat the\u00a0object and purpose of the Agreement, a signature\u00a0alone\u00a0does not mean that\u00a0a country\u00a0becomes a\u00a0\u201cParty\u201d to the Paris\u00a0Agreement.\u00a0As with many other international agreements, joining\u00a0the Paris Agreement\u00a0follows a two-step process:\u00a0countries must sign the Agreement,\u00a0and then also\u00a0indicate their consent to\u00a0join and\u00a0be bound\u00a0by it as Parties.<\/p>\n

\"\"<\/a><\/p>\n

How do countries indicate their\u00a0consent\u00a0to\u00a0be bound and\u00a0become Parties?<\/strong><\/p>\n

Most countries will sign the Agreement \u201csubject to ratification, acceptance and approval,\u201d\u00a0making their signature\u00a0conditional on\u00a0obtaining\u00a0the required\u00a0domestic\u00a0approval for\u00a0joining the\u00a0Agreement. In some cases, they will\u00a0also\u00a0enact\u00a0any\u00a0national\u00a0legislation\u00a0necessary to implement the Agreement.\u00a0For example,\u00a0in Australia,\u00a0the only requirement is formal notification and\u00a0introduction of the Agreement\u00a0in Parliament,\u00a0whereas in Mexico,\u00a0the consent of the Senate is\u00a0also\u00a0required.\u00a0In the United States, many international agreements are joined as \u201cexecutive agreements\u201d\u00a0based\u00a0on presidential authority.<\/p>\n

When\u00a0a country fulfils its\u00a0necessary domestic processes,\u00a0it\u00a0will come back and deposit an\u00a0\u201cinstrument of ratification, acceptance or approval”.\u00a0This is a formal document\u00a0indicating that it has completed all necessary processes and can now join the Agreement.\u00a0This can be done as soon after signing as a country chooses, and there\u00a0is\u00a0no\u00a0time limit\u00a0for when\u00a0countries submit\u00a0these\u00a0forms.\u00a0A country might deposit its instrument of ratification, acceptance or approval on the same day it signs,\u00a0or\u00a0submit\u00a0it separately\u00a0much\u00a0later.<\/p>\n

Can Parties still join the\u00a0Paris\u00a0Agreement after April\u00a022,\u00a02017\u00a0if they didn\u2019t sign\u00a0it\u00a0before then?<\/strong><\/p>\n

Yes. After the one-year signing period, the Agreement will be open for\u00a0what is called\u00a0\u201caccession.\u201d\u00a0Accession is simply the term for when a country becomes a\u00a0Party to an international agreement that\u00a0other countries have\u00a0already\u00a0signed.\u00a0Depositing an instrument of accession after April\u00a022,\u00a02017 will have the same legal effect as\u00a0if that country had\u00a0signed and deposited an instrument of ratification, acceptance or approval\u00a0\u2013 but it is distinct from those.<\/p>\n

So when will the Paris Agreement\u00a0actually\u00a0enter into force?<\/strong><\/p>\n

The\u00a0Paris Agreement will be in full legal force\u00a0and effect\u00a0when at least 55 Parties to the\u00a0UNFCCC\u00a0that account for at least 55 percent of the total global greenhouse gas emissions have deposited their instruments of ratification, acceptance, approval or accession.\u00a0At this point in time,\u00a0it is not possible to accurately\u00a0predict when this will occur,\u00a0as\u00a0it depends on how quickly\u00a0individual\u00a0countries are able to\u00a0complete\u00a0their domestic\u00a0approval processes.\u00a0Once the Agreement enters into force, the first meeting of the Parties to the Agreement will occur in conjunction with the next COP.<\/p>\n

The figure\u00a0below illustrates three possible combinations\u00a0of countries\u00a0for meeting the 55% percent\u00a0threshold.\u00a0\u00a0While\u00a0a\u00a0range of country combinations exist, based on the most recent emissions data communicated by countries to the UNFCCC, our analysis shows that the 55 percent threshold cannot be\u00a0achieved\u00a0without the acceptance\u00a0of\u00a0at least one of the top four emitting Parties,\u00a0China, the United\u00a0States, the European\u00a0Union, or\u00a0Russia.\u00a0The timing for when each of these countries might join the Agreement depends on each of their unique domestic legal systems.<\/p>\n

Taking the action needed to bring the Paris Agreement into force is an essential next step for countries to build on the momentum from COP21. If they do so quickly, countries can ensure that the critically important provisions and requirements of the Paris Agreement\u00a0are fully put into motion.<\/p>\n
