{"id":34581,"date":"2017-02-03T15:55:00","date_gmt":"2017-02-03T15:55:00","guid":{"rendered":""},"modified":"2020-09-22T14:38:12","modified_gmt":"2020-09-22T14:38:12","slug":"9581-local-and-central-government-differ-over-gmo-policy","status":"publish","type":"post","link":"https:\/\/dialogue.earth\/en\/food\/9581-local-and-central-government-differ-over-gmo-policy\/","title":{"rendered":"Local and central government differ over GMO policy"},"content":{"rendered":"<p dir=\"ltr\"><span id=\"docs-internal-guid-29f2b582-ffe6-3a36-9119-e0b5a0e3ce4a\">Heilongjiang province, the bread basket of north-east China, has banned the planting of genetically modified (GM) crops <\/span>\u2013\u00a0the country\u2019s first such ban at the provincial level. Given that Heilongjiang produces\u00a0<a href=\"https:\/\/www.stats.gov.cn\/tjsj\/zxfb\/201612\/t20161208_1439012.html\">one tenth<\/a>\u00a0of China\u2019s staple food crops, the move has sparked controversy and raised questions about the future of GM\u00a0foods policy in the world\u2019s biggest consumer market.<\/p>\n<p><span id=\"docs-internal-guid-29f2b582-ffe6-3a36-9119-e0b5a0e3ce4a\"><strong>An illegal law?<\/strong><\/span><\/p>\n<p>The legitimacy of Heilongjiang\u2019s law has been questioned. The ban took the form of an amendment to the <a href=\"https:\/\/www.hlj.gov.cn\/zwfb\/system\/2016\/12\/26\/010804838.shtml\">Heilongjiang Food Safety Regulation<\/a>\u00a0by the national legislative body (called the Standing Committee of the Provincial People\u2019s Congress), <a href=\"https:\/\/www.npc.gov.cn\/npc\/zfjc\/zfjcelys\/2016-06\/01\/content_1990740.htm\">which added the following phrase<\/a>:<\/p>\n<p><span id=\"docs-internal-guid-29f2b582-ffe6-3a36-9119-e0b5a0e3ce4a\">\u201cThe planting of GM staple crops including corn, rice and soya is banned in this province in accordance with the law,\u201d along with, \u201cthe illegal production, processing, trading and import of GM foods or products containing GM ingredients.\u201d<\/span><\/p>\n<p dir=\"ltr\">While the ban took the form of a regulatory amendment it has the full force of a provincial law.<\/p>\n<p>China has neither officially approved the planting of GM corn, rice or soya nor banned it outright. So far, no GM staple crops have been granted a\u00a0license\u00a0for commercial planting. However, China does allow the <a href=\"https:\/\/www.moa.gov.cn\/ztzl\/zjyqwgz\/spxx\/\">import<\/a> of 80 different types of GM product for use in food processing, and large quantities of GM corn and soya are regularly imported.<br \/>\n<span id=\"docs-internal-guid-29f2b582-ffe6-3a36-9119-e0b5a0e3ce4a\">\u200b<br \/>\nBlogger and science writer <\/span><a href=\"https:\/\/en.wikipedia.org\/wiki\/Fang_Zhouzi\">Fang Zhouzi<\/a> holds a PhD in biochemistry and is one of China\u2019s most prominent GM technology advocates. He says Heilongjiang is outlawing something that <a href=\"https:\/\/www.agrogene.cn\/info-3617.shtml\">has not been banned at the national level<\/a>. If the central government approves the planting of GM staple crops then Heilongjiang\u2019s provincial regulations will raise a conflict of interest.<\/p>\n<p><span id=\"docs-internal-guid-29f2b582-ffe6-3a36-9119-e0b5a0e3ce4a\">Similarly, Liu Xuxia, a professor of law at Huazhong Agricultural University in Hubei province, central China,\u00a0<\/span><a href=\"https:\/\/www.agrogene.cn\/info-3708.shtml\">argues<\/a> that without a ban at the national level\u00a0Heilongjiang cannot claim to be acting in accordance with the law.<\/p>\n<p><span id=\"docs-internal-guid-29f2b582-ffe6-3a36-9119-e0b5a0e3ce4a\">But other legal experts disagree. Yu Wenxuan, head of the Environmental and Resources Law Institute at the <\/span><a href=\"https:\/\/www.cupl.edu.cn\/\">China University of Politics and Law<\/a>, says that Heilongjiang\u2019s amendment raises no problems in terms of legal principle and legislative process.<\/p>\n<p><span id=\"docs-internal-guid-29f2b582-ffe6-3a36-9119-e0b5a0e3ce4a\">Heilongjiang\u2019s food safety regulations are based on China\u2019s Food Safety Law, which does not preclude provinces from putting their own tougher rules in place\u00a0as long as they do not conflict with national laws relating to food safety.<\/span><\/p>\n<p>Yu also pointed out precedents in which local governments have acted independently to go beyond standards required by national legislation. One example is the tougher air quality regulations Beijing put in place for the 2008 Beijing Olympics, which were stricter than those applied elsewhere.<\/p>\n<p><strong>Also see:<\/strong> <a href=\"https:\/\/dialogue.earth\/en\/food\/8535-illegal-gm-crops-found-in-china-s-breadbasket\/\">Illegal GM crops found in China&#8217;s breadbasket<\/a><\/p>\n<p><strong>Protectionism<\/strong><\/p>\n<p>Regardless of the dispute around legality, Heilongjiang may be hoping to use the new rules to protect local crop producers from competition posed by GM importers.<\/p>\n<p>For example, GM soya shipped in from the US is cheaper than locally grown non-GM soya. And although import licenses are only issued for a small number of types of corn and soya, illegal imports do happen, undercutting local producers. In 2015, an investigation by environmental NGO Greenpeace found that some <a href=\"https:\/\/www.chinadialogue.net\/article\/show\/single\/en\/8535-Illegal-GM-crops-found-in-China-s-breadbasket\">foods sold in Liaoning<\/a>, one of Heilongjiang\u2019s neighbours, contained GM corn of a type not approved for import.<\/p>\n<p>Huang Dafang, a researcher at the Chinese Academy of Agricultural Sciences\u2019 <a href=\"https:\/\/www.bricaas.cn\/index.aspx\">Biotechnology Research Institute<\/a>, said that imported GM soya is beating Heilongjiang\u2019s non-GM crops on price, and that the ban is legal cover for a protectionist policy.<\/p>\n<p><span id=\"docs-internal-guid-29f2b582-ffe6-3a36-9119-e0b5a0e3ce4a\">Liu Denggao, deputy head of the China Soya Industry Association, told <\/span>China Dialogue that there\u2019s a difference between protectionism and protecting the interests of local farmers. As China\u2019s major grower of soya beans, Heilongjiang needs to be clear in its support for the purity of local products.<\/p>\n<p><span id=\"docs-internal-guid-29f2b582-ffe6-3a36-9119-e0b5a0e3ce4a\">Globally, there are distinct markets and prices for GM and non-GM soya. Heilongjiang\u2019s non-GM crop is much cheaper than non-GM\u00a0soya on the international market, and this is what it should be competing with.<\/span><\/p>\n<p>China\u2019s <a href=\"https:\/\/www.npc.gov.cn\/npc\/zfjc\/zfjcelys\/2015-04\/25\/content_1992458.htm\">Food Safety Law<\/a> currently requires that GM food products be clearly labelled\u00a0but lax law enforcement means that cheap unlabelled imported soya is dominating the Chinese market and damaging the interests of non-GM soya farmers and processors.<\/p>\n<p><span id=\"docs-internal-guid-29f2b582-ffe6-3a36-9119-e0b5a0e3ce4a\">\u201cThe fact that GM soya masquerades as non-GM shows a lack of confidence in farmers\u2019 own product,\u201d said Liu. \u201cChinese soya should be proudly labelled as such, and Heilongjiang has opted to mark its products with their source.\u201d<\/span><\/p>\n<p>In other words, once the regulations come into effect, consumers can be sure that products\u00a0from Heilongjiang are GM free.<\/p>\n<p><strong>Opinions divided<\/strong><\/p>\n<p>The new regulation appears popular in Heilongjiang. In October, before it came into effect, the National Bureau of Statistics carried out a public opinion <a href=\"https:\/\/news.xinhuanet.com\/2016-12\/16\/c_1120134366.htm\">survey<\/a> across 13 cities and some counties on attitudes towards a GM crop ban. More than 90% of respondents opposed the planting of GM crops in the province.<\/p>\n<blockquote>\n<p dir=\"ltr\">More than 90% of respondents opposed the planting of GM crops<\/p>\n<\/blockquote>\n<p dir=\"ltr\">According to a <a href=\"https:\/\/www.stdaily.com\/ruidongyuan\/rdy\/2016-12\/22\/content_491701.shtml\">Science and Technology Daily<\/a> report, one provincial official said at a hearing on\u00a0the rules that, \u201cthis has come from a rejection of GM foods by the majority of consumers.\u201d<\/p>\n<p><span id=\"docs-internal-guid-29f2b582-ffe6-3a36-9119-e0b5a0e3ce4a\">According to <\/span><a href=\"https:\/\/www.legaldaily.com.cn\/Food_Safety\/content\/2016-12\/21\/content_6926261.htm?node=70441\">survey data<\/a> from the <a href=\"https:\/\/www.casted.org.cn\/\">Chinese Academy of Science and Technology for Development<\/a>, and the <a href=\"https:\/\/www.ssap.com.cn\/c\/2016-12-21\/1048295.shtml\">Society Blue Paper:<em> Analysis and Prediction of Social Trends in China 2017<\/em><\/a>, public levels of acceptance of GM technology are low and falling. Seven in ten respondents said they were unwilling to eat GM foods, while less than two in ten said they were willing to do so. (One in ten had no preference).<\/p>\n<p><span id=\"docs-internal-guid-29f2b582-ffe6-3a36-9119-e0b5a0e3ce4a\">Those in favour of GM foods are mostly scientists, particularly biotechnologists, whose arguments are largely couched in academic discussion. <\/span><\/p>\n<p dir=\"ltr\">Xu Zhihong, a member of the Chinese Academy of Sciences and a professor at Peking University\u2019s School of Life Sciences, <a href=\"https:\/\/tech.gmw.cn\/scientist\/2016-07\/20\/content_21046460.htm\">thinks<\/a> the ferocity\u00a0of the debate and rejection of scientific argument is largely due to the public&#8217;s deep-seated insecurity about the state&#8217;s grip on\u00a0food security, caused by a litany of past food scandals.<\/p>\n<p dir=\"ltr\">Recent years have seen frequent food safety scares leaving the public sceptical of whether food in China is safe. That scepticism is manifested in\u00a0attitudes towards GM foods.<\/p>\n<p>So far there are no signs that China\u2019s central government objects to Heilongjiang\u2019s move. But it is worth noting that Beijing is promoting the commercialisation of GM crops.<\/p>\n<p dir=\"ltr\">In April 2016, Liao Xiyuan, head of the Ministry of Agriculture\u2019s Science, Technology and Education Department, said at a press conference that the <span id=\"docs-internal-guid-29f2b582-ffe6-3a36-9119-e0b5a0e3ce4a\">13<\/span>th Five-Year Plan period (2016-2020) would see China push forward with commercialisation of GM pest-resistant corn. This\u00a0suggests\u00a0that the\u00a0clash between local and state laws is likely to be an ongoing issue.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A provincial ban on genetically modified
