{"id":35141,"date":"2017-10-11T15:25:00","date_gmt":"2017-10-11T15:25:00","guid":{"rendered":""},"modified":"2020-07-02T19:23:53","modified_gmt":"2020-07-02T19:23:53","slug":"10141-opposition-to-extractive-industries-growing-in-colombia","status":"publish","type":"post","link":"https:\/\/dialogue.earth\/en\/business\/10141-opposition-to-extractive-industries-growing-in-colombia\/","title":{"rendered":"Opposition to extractive industries growing in Colombia"},"content":{"rendered":"<p>Peace remains illusory for many Colombians a year on from the <a href=\"https:\/\/www.theguardian.com\/world\/2016\/nov\/24\/colombia-signs-historic-peace-deal-with-farc-rebels\">signing<\/a> of a historic deal with guerrilla group the Revolutionary Armed Forces of Colombia (FARC).<\/p>\n<p>Tensions over land and natural resources persist in rural areas despite an end to the conflict. This is in part because the government continues to prioritise the extraction and export of commodities such as oil without properly consulting affected communities, according to Camilo Gonz\u00e1lez Posso, director of Colombia\u2019s <a href=\"https:\/\/www.indepaz.org.co\/\">Institute for Peace and Development Studies<\/a> (INDEPAZ).&nbsp;<\/p>\n<p>\u201cThe economic model has helped reproduce violence over the past 60 years,\u201d he says.<\/p>\n<p>Gonz\u00e1lez Posso recently told an <a href=\"https:\/\/calendar.boell.de\/en\/event\/por-que-defender-el-territorio-cuesta-la-vida\">audience<\/a> at the Javeriana University in Colombia\u2019s capital Bogot\u00e1 that conflict persists because the state remains susceptible to capture by private interests. The Colombian government has exclusive authority to award concessions for extractives projects through the <a href=\"https:\/\/www.anm.gov.co\/sites\/default\/files\/DocumentosAnm\/publication_exploring_opportunities.pdf\">National Mining Agency<\/a> (ANM).<\/p>\n<p>Colombia is now entering a phase of \u201clow-intensity\u201d conflict, Gonz\u00e1lez Posso says. While the frequency of conflict may have diminished and the perpetrators of violence may be changing, rural communities still suffer the consequences, he added. Earlier this month, another left-wing guerrilla group, the National Liberation Army (ELN), agreed a first ever <a href=\"https:\/\/www.reuters.com\/article\/us-colombia-rebels-eln\/colombia-and-eln-rebels-begin-first-ever-ceasefire-idUSKCN1C61CT\">ceasefire<\/a>.<\/p>\n<p>Since the 1940\u2019s, Colombia has experienced complex and bloody civil conflicts involving security forces, left-wing guerrilla groups and right-wing paramilitaries that have left hundreds of thousands dead and millions more internally displaced.<\/p>\n<p><strong>Oil conflict<\/strong><\/p>\n<p>The <a href=\"https:\/\/dialogue.earth\/business-church-and-ngos-united-against-oil-exploitation-in-colombia\/\">Nogal<\/a> oil block in the southern former FARC stronghold of Caquet\u00e1 is an example of resource-related conflicts taking place all over the country, says Joel Ross, Latin America analyst at UK consultancy <a href=\"https:\/\/maplecroft.com\/\">Verisk Maplecroft<\/a>.<\/p>\n<p>Drilling in the Nogal block, which is owned by Emerald Energy, a British subsidiary of China\u2019s Sinochem, will cause irreparable damage to the water and soil that sensitive Amazon ecosystems and communities depend on, opponents say.<\/p>\n<p>\u201cSocietal opposition to extractives projects is reaching an all-time high in Colombia,\u201d says Ross. He recommends that investors looking at post-peace deal Colombia carry out a \u201cthorough and exhaustive\u201d assessment of potential environmental, social, and policy risks, which also include violence associated with drug-trafficking and illegal gold mining.<\/p>\n<p>Engaging in early dialogue with local communities and understanding communities\u2019 concerns and demands will help mitigate the risk of unrest or social opposition to projects, Ross adds.<\/p>\n<p>Carlos Andr\u00e9s Santiago, a spokesperson for the Defense Corporation for Water, Territory and Ecosystems (CORDATEC), says: \u201cWe\u2019re moving towards conflicts in defence of water, resources and territory.\u201d<\/p>\n<p>The organisation, which opposes fracking in the northern department of C\u00e9sar, demands an alternative development model that considers the principle of &#8220;<a href=\"https:\/\/dialogue.earth\/buen-vivir-a-manifesto-for-the-rights-of-nature\/\">buen vivir<\/a>&#8221;&nbsp;(\u2018living well\u2019 or \u2018good living\u2019) and respects the rights of nature.&nbsp; &nbsp;<\/p>\n<p>With the departure of the FARC, the biggest fear for some communities living around the sites of new development projects is what comes next, as the armed group\u2019s presence provided a form of authority and control.<\/p>\n<p>\u201cWe are not closed to foreign investment, we are not against development\u201d says Ernesto Ramirez Flores, of the Association of Community Councils and Organisations of Bajo Atrato (ASCOBA), a densely forested river basin in the north-west Choc\u00f3 department of Colombia that borders Panama.<\/p>\n<p>\u201cWhat we\u2019re asking is that investment agrees with our culture and our vision, and above all, with the wishes and permission of our communities,\u201d he adds.<\/p>\n<p>Ramirez says that the state has had little presence in the region and that communities co-existed with FARC. He stresses that communities retain the legal right to be consulted on projects in their territory.<\/p>\n<p>Vanessa Torres, a researcher at non-governmental organisation <a href=\"https:\/\/www.ambienteysociedad.org.co\/en\/\">Ambiente y Sociedad<\/a> (Environment and Society) says many development projects had stalled in Colombia because of the presence of guerrillas. \u201cIt\u2019s not just oil, but also mining and infrastructure too,\u201d she says.<\/p>\n<p>The peace deal with FARC set out new norms for the development of the territory the group formerly controlled, including fast-tracking the approval of many projects. The Colombian government says that this facilitates the arrival of foreign investment.&nbsp;<\/p>\n<p>\u201cWe have a more attractive destination for business, for the arrival of more tourists to areas of the country that were isolated by war, and for more investors to establish themselves in the country,\u201d Felipe Jaramillo, president of trade promotion agency ProColombia, recently <a href=\"https:\/\/es.presidencia.gov.co\/noticia\/170922-Colombia-vive-hoy-un-proceso-de-paz-cargado-de-innumerables-retos-pero-aun-mas-oportunidades-senala-El-Pais-de-Espana\">told<\/a> Spanish newspaper <em>El Pa\u00eds<\/em>.<\/p>\n<p>However, Torres says that plans to grant the executive branch of government more decision-making power over new projects by bypassing the legislature are dangerous. Many of the projects require detailed technical analyses to determine what their impacts will be.<\/p>\n<p>\u201cGoing through Congress doesn\u2019t guarantee that a proper approval procedure will take place. But it does give you time,\u201d says Torres, who has had access to some of the proposed projects.<\/p>\n<p>In May this year, Colombia\u2019s constitutional court declared that a 2016 law aimed at streamlining the approval of development projects was <a href=\"https:\/\/cnnespanol.cnn.com\/2017\/05\/18\/corte-constitucional-de-colombia-dicta-nuevas-reglas-para-implementar-acuerdo-de-paz-con-las-farc\/\">unconstitutional<\/a>. The court ruled that the <a href=\"https:\/\/www.mininterior.gov.co\/sala-de-prensa\/noticias\/aprobado-en-primer-debate-el-proyecto-de-acto-legislativo-de-jurisdiccion-especial-para-la-paz\">Legislative Act for Peace<\/a>, known locally as the Fast Track law, threatened the democratic principle of separation of powers.<\/p>\n<p><strong>Chinese presence intensifies<\/strong><\/p>\n<p>In May 2015, Chinese premier Li Keqiang <a href=\"https:\/\/dialogue.earth\/china-and-latin-america-treat-environment-as-goodwill-gesture\/\">travelled<\/a> to Colombia in the first trip by such a senior ranking politician from China in 35 years.<\/p>\n<p>Shortly before Li\u2019s visit the two countries <a href=\"https:\/\/www.cancilleria.gov.co\/newsroom\/news\/colombia-y-china-suscribieron-convenio-cooperacion-economica-y-tecnica\">signed<\/a> an economic and technical cooperation agreement that would see China disburse funds to Colombia to assist in the country\u2019s process of territorial re-ordering in the post-conflict period. However, this type of agreement does not contain any provisions on social and environmental management.<\/p>\n<p>Colombia is something of an anomaly for an Andean country in terms of its <a href=\"https:\/\/dialogue.earth\/what-next-colombia-peace-farc-santos\/\">relations with China<\/a>, according to Torres, who has been following the arrival of Chinese investment in the country.&nbsp;<\/p>\n<p>Unlike Peru and Ecuador, investment has arrived more slowly owing to long and costly processes and accusations by Chinese companies that the Colombian government has <a href=\"https:\/\/dialogue.earth\/corruption-and-crisis-in-latin-america-open-door-for-more-chinese-investment\/\">favoured<\/a> Brazilian competitors.<\/p>\n<p>With graft-tainted Brazilian infrastructure giant Odebrecht selling assets in Colombia, China\u2019s presence is \u201cintensifying\u201d, Torres says, but points out that until now investment has focused mainly on hydrocarbons.<\/p>\n<p>Wu Guoping, a Latin America expert at the <a href=\"https:\/\/casseng.cssn.cn\/\">Chinese Academy of Social Sciences<\/a>, says that oil is an important source of revenue for Colombia, and that China\u2019s interest in Colombia\u2019s oil meets the needs of both countries.<\/p>\n<p>However, Wu says that around ten years ago, the Colombian embassy in Beijing tried to lobby Chinese companies to invest in its oil sector, but with little success. At the time, Colombia was looking to expand the oil sector and belie the perception that it was only an exporter of coffee.<\/p>\n<p>Today, Colombia needs to diversify its exports to China to include products like fruit, Wu said in <a href=\"https:\/\/www.portafolio.co\/negocios\/comercio-electronico-facilitara-ventas-hacia-china-509780\">an interview<\/a> with local business publication <em>Portafolio<\/em>. Wu said the drop in the price of oil has hit the overall value of trade between China and Colombia, and that the latter should look at countries like <a href=\"https:\/\/dialogue.earth\/fruit-boom-thrusts-old-partners-chile-and-china-into-new-territory\/\">Chile<\/a> and Peru, which sell a wider variety of products to the Chinese market.&nbsp;<\/p>\n<p>But with such strong social opposition, extractive industries face more than economic challenges in Colombia. Ross points out that some local authorities are planning to hold popular votes that could ban mining activities in their jurisdiction.<\/p>\n<p>\u201cAny legally binding precedent would be catastrophic for the sector,\u201d he says.<\/p>\n<p><em>This article is republished from <a
