{"id":40077022,"date":"2018-07-19T00:00:00","date_gmt":"2018-07-18T18:30:00","guid":{"rendered":"http:\/\/china-dialogue-ocean-staging.darkbluehq.com\/uncategorized\/3787-bohai-oil-leak-china-marine-law\/"},"modified":"2022-02-10T23:00:32","modified_gmt":"2022-02-10T17:30:32","slug":"3787-bohai-oil-leak-china-marine-law","status":"publish","type":"post","link":"https:\/\/dialogue.earth\/en\/ocean\/3787-bohai-oil-leak-china-marine-law\/","title":{"rendered":"Bohai legacy highlights weakness in China\u2019s marine law"},"content":{"rendered":"<p align=\"left\">A long and hard-fought lawsuit brought by a group of Chinese tourist operators against United States oil giant ConocoPhillips has quietly ended with an out-of-court settlement behind closed doors.<\/p>\n<p>Despite the absence of media attention on the ruling, to ignore it would be a mistake. The drawn-out litigation, which has lasted six years, holds important lessons for the development of China\u2019s maritime law, particularly how to legislate the thorny of issue of accountability.<\/p>\n<p>The tourist operators\u2019 case started in November 2012 following the Bohai Bay oil leak in 2011, one of China\u2019s most serious maritime spills.\u00a0Between June 4 and 17, 2011, <a href=\"https:\/\/www.chinadialogue.net\/article\/show\/single\/ch\/4592-The-battering-of-the-Bohai\">several major oil leaks<\/a> occurred in the Bohai Sea\u00a0from offshore oilfields only 80 kilometres from the nearest city on China\u2019s east coast. The drilling companies, the China National Offshore Oil Company (CNOOC) and ConocoPhillips China, reacted slowly and the leak spread, polluting 6,200 square kilometres of water \u2013 an area <a href=\"https:\/\/www.chinadialogue.net\/article\/show\/single\/en\/4418-Transparency-test-in-the-Bohai-Sea\">six times<\/a> the size of Singapore \u2013 around the main oil field, Penglai 19-3.<\/p>\n<figure style=\"width: 731px\" class=\"wp-caption alignnone\"><a href=\"https:\/\/chinadialogue-production.s3.amazonaws.com\/uploads\/content_image\/content_image\/4236\/Screen_Shot_2018-06-26_at_13.37.57_EN_new.jpg\"><img loading=\"lazy\" decoding=\"async\" style=\"border-width: 0px; border-style: solid; width: 100%; height: 100%;\" src=\"https:\/\/chinadialogue-production.s3.amazonaws.com\/uploads\/content_image\/content_image\/4236\/Screen_Shot_2018-06-26_at_13.37.57_EN_new.jpg\" alt=\"Officially determined spread of the oil leak. The petrochemical pollution stretched 200 kilometres north-west to the island of Yuetuo, a scenic area known commercially as Tangshan Bay International Tourism Island, home to the tourist companies that brought the case.<\/p>\n<h2>Economic disaster<\/h2>\n<p>One month after the incident, a <a href=\"http:\/\/www.mlr.gov.cn\/xwdt\/hyxw\/201206\/t20120626_1114099.htm\">report by<\/a> the former State Oceanic Administration (SOA) showed that a 500-metre oil slick still coated the beaches of Tangshan. In April 2012, a <a href=\"https:\/\/dialogue.earth\/3365-tianjin-oil-spill-fishermen\/\">final agreement<\/a> was reached between the SOA, CNOOC and ConocoPhillips to pay 1.683 billion yuan into a compensation fund.<\/p>\n<p>The agreement provided compensation for aquaculture and fishing sectors in certain parts of Hebei and Liaoning provinces. However, Shandong and Tianjin received nothing. Nor was there any provision for the tourism sector.<\/p>\n<p>There is no public information available detailing if and how the money was distributed by the local provincial authorities.<\/p>\n<p>Having been left out of the compensation deal, and with\u00a0livelihoods damaged, the Tangshan tourism operators bandied together to seek reparation.<\/p>\n<figure style=\"width: 693px\" class=\"wp-caption alignnone\"><a href=\"https:\/\/chinadialogue-production.s3.amazonaws.com\/uploads\/content_image\/content_image\/4218\/Screen_Shot_2018-06-26_at_13.37.48.png\"><img loading=\"lazy\" decoding=\"async\" style=\"width: 100%; height: 100%;\" src=\"https:\/\/chinadialogue-production.s3.amazonaws.com\/uploads\/content_image\/content_image\/4218\/Screen_Shot_2018-06-26_at_13.37.48.png\" alt=\"white SOA vessel sails near an oil rig in the bohai sea\" width=\"693\" height=\"453\" \/><\/a><figcaption class=\"wp-caption-text\">An SOA vessel\u00a0monitoring of the water near the Penglai 19-3 oil platform, November\u00a02011, five months after the oil leak\u00a0(Image by: <a href=\"http:\/\/www.soa.gov.cn\/xw\/ztbd\/2011\/pl193ytyysg\/201211\/t20121130_18256.htm\">SOA website<\/a>)<\/figcaption><\/figure>\n<p>&nbsp;<\/p>\n<h2>A long wait for justice<\/h2>\n<p>In August 2012 the tourism operators, including some from Yuetuo, submitted an <a href=\"http:\/\/www.yicai.com\/news\/2039819.html\">application for mediation<\/a> to the SOA, which is formerly responsible for managing compensation for marine oil leaks, with the hope of obtaining compensation from ConocoPhillips.<\/p>\n<p>This was the first time in China that companies united to seek compensation in the wake of an oil spill.<\/p>\n<p>The operators claimed that the leak had caused business losses amounting to 26.2 million yuan (US$4 million) due to a decline in visitor numbers.<\/p>\n<p>Initially the SOA rejected the request on the basis that the companies were ineligible, the claimants&#8217; lawyer Huo Zhijian told <em>chinadialogue<\/em>. But they persevered and took the case to a senior Tianjin Marine Court, where it was formally accepted in May 2015. It would be another three years before any agreement was reached.<\/p>\n<h2 align=\"left\"><a href=\"https:\/\/chinadialogue-production.s3.amazonaws.com\/uploads\/content_image\/content_image\/4230\/EN_Timeline_of_the_Tangshan_Bay___ConocoPhillips_Case__1_.jpg\"><img decoding=\"async\" style=\"width: 100%; height: 100%;\" src=\"https:\/\/chinadialogue-production.s3.amazonaws.com\/uploads\/content_image\/content_image\/4230\/EN_Timeline_of_the_Tangshan_Bay___ConocoPhillips_Case__1_.jpg\" alt=\"Timeline of the Tangshan Bay \u2013 ConocoPhillips Case\" \/><\/a> How to assess oil leak losses?<\/h2>\n<p>One challenge for the claimants\u00a0was establishing a direct link between the pollution and the losses suffered. Under <a href=\"http:\/\/www.court.gov.cn\/fabu-xiangqing-14615.html\">Chinese law<\/a>, the claimant is responsible for providing evidence of the link between the pollution and any resultant losses.<\/p>\n<p>\u201cLegally, the hardest thing to prove is the cause-and-effect relationship,\u201d said lawyer Zhao Jingwei, who <a href=\"http:\/\/www.legaldaily.com.cn\/direct_seeding\/content\/2011-08\/23\/content_2895500.htm?node=32630\">successfully<\/a> represented a number of Bohai aquaculture operators.<\/p>\n<p>The <a href=\"https:\/\/www.iopcfunds.org\/\">International Oil Pollution Compensation Funds<\/a> hold that while not directly due to an oil leak, such losses are a foreseeable result of one and so can be regarded as arising from the leak. But in practice Chinese courts\u00a0tend to reject such claims.<\/p>\n<p>While direct losses from tourism may be more difficult to determine compared to fishing, for example, where the loss of fish stocks is easier to prove, it is\u00a0likely that a major pollution incident would deter tourists travelling to places formerly known for their natural beauty.<\/p>\n<h2>The slow arm of the law<\/h2>\n<p>All known compensation cases brought as a result of the Bohai oil leak have been protracted and problematic. A case brought by <a href=\"http:\/\/www.chinanews.com\/sh\/2017\/11-08\/8370982.shtml\">Tianjin fishermen<\/a> was rejected by the government courts, and 500 Shandong fishermen are <a href=\"http:\/\/www.jiemian.com\/article\/431656.html\">still waiting<\/a> for their case to be heard. This reflects the weakness of the Chinese legal system in dealing with oil pollution accidents in the marine environment.<\/p>\n<blockquote>\n<p align=\"left\">This reflects the weakness of the Chinese legal system in dealing with oil pollution accidents in the marine environment<\/p>\n<\/blockquote>\n<p align=\"left\">After the 2010 Deepwater Horizon leak in the Gulf of Mexico the US stepped up regulation of marine energy development. The Penglai 19-3 leak was an opportunity for China to revise and improve the Marine Environmental Protection Law.<\/p>\n<p>In 2012 China\u2019s legislative body, the National People\u2019s Congress, indicated on its <a href=\"http:\/\/www.npc.gov.cn\/wxzl\/gongbao\/2013-04\/17\/content_1811066.htm\">website<\/a> that in response to the Bohai oil leak the Congress and the State Council would work on revising that law together with the Ministry of Environmental Protection, Ministry of Agriculture and the State Ocean Administration.<\/p>\n<p>The Marine Environmental Protection Law has since gone through two revisions, in 2013 and 2016, with new content added on coastal engineering and environmental pollution.<\/p>\n<p>The <a href=\"http:\/\/www.npc.gov.cn\/npc\/xinwen\/2013-12\/30\/content_1821988.htm\">2013 revision<\/a> ruled that an environmental impact assessment must be submitted during feasibility studies for coastal engineering projects, and that oil prospectors must submit emergency plans in the event of oil leaks.<\/p>\n<p>In 2016 <a href=\"http:\/\/www.mlr.gov.cn\/xwdt\/jrxw\/201611\/t20161108_1421231.htm\">more detailed methods<\/a> for calculating compensation for pollution were added, as were fines for major pollution incidents.<\/p>\n<p>Local governments have also sent encouraging signals. In 2016 the Shandong government published <a href=\"http:\/\/www.soa.gov.cn\/xw\/dfdwdt\/dfjg\/201602\/t20160222_50125.html\">rules<\/a> for managing marine compensation \u2013 the first such document in China.<\/p>\n<p>The principle of that method means that victims of pollution can claim damages through harm to a regional ecosystem, without having to prove a cause-and-effect link. This is regarded as a step forward in the development of a marine <a href=\"http:\/\/www.chinadialogue.net\/article\/show\/single\/en\/8018-Interpreting-ecological-civilisation-part-one-\">ecological civilisation<\/a>.<\/p>\n<p>However, governance issues continue to impede justice.\u00a0Losses to marine wildlife, for example, are under the remit of the fisheries authorities and whereas mineral resources fall\u00a0under the mining authorities. This split approach to governance makes\u00a0it\u2019s hard to identify where to attribute losses.<\/p>\n<p>Feng Jie, a journalist who <a href=\"http:\/\/www.infzm.com\/content\/62747\">reported<\/a> in depth on the Penglai 19-3 leak, says that current\u00a0structures are failing to guarantee justice for\u00a0victims of pollution.<\/p>\n<p>Whilst the enormous environmental costs of the Bohai leak\u00a0have spurred improvements to China\u2019s marine environmental protection law, legislators\u00a0still have much to do.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Seven years after
