{"id":40077130,"date":"2019-10-25T00:00:00","date_gmt":"2019-10-24T18:30:00","guid":{"rendered":"http:\/\/china-dialogue-ocean-staging.darkbluehq.com\/uncategorized\/11135-china-psma-illegal-fishing\/"},"modified":"2022-02-10T23:01:25","modified_gmt":"2022-02-10T17:31:25","slug":"11135-china-psma-illegal-fishing","status":"publish","type":"post","link":"https:\/\/dialogue.earth\/en\/ocean\/11135-china-psma-illegal-fishing\/","title":{"rendered":"China is key to closing ports to illegally caught fish"},"content":{"rendered":"<p>The United Nations has a straightforward solution to the <a href=\"https:\/\/dialogue.earth\/8991-high-stakes-for-china-as-wto-fishing-subsidies-deadline-looms\/\">illegal fishing<\/a> that is decimating marine life and pushing some species toward extinction: close the world\u2019s ports to vessels engaged in the US$23 billion black market.<\/p>\n<p>Deprived of safe harbours to offload their illicit cargo, the economic incentive to plunder the seas would begin to evaporate. That\u2019s the idea behind the Port State Measures Agreement (<a href=\"http:\/\/www.fao.org\/port-state-measures\/en\/\">PSMA<\/a>), which <a href=\"http:\/\/www.fao.org\/blogs\/blue-growth-blog\/port-state-measures-agreement-enters-into-force-as-international-treaty\/en\/\">came into effect<\/a> in June 2016 and requires participating nations to restrict entry of foreign fishing vessels to designated ports.<\/p>\n<div class='block--pullout-stat block--pullout-stat--float cd-shortcode--factbox'>\n                <p class='block--pullout-stat__title'>What is the Port State Measures Agreement?<\/p>\n                <div class='block--pullout-stat__content'>\n                    <br \/>\nA UN treaty requiring countries to close their ports to illegal fishing vessels, and to share real-time information to make that possible.<br \/>\n\n                <\/div>\n            <\/div>\n<p>Before allowing them to dock, countries must verify where the ship is registered, conduct inspections and take other actions to ensure they are not transporting illegally caught fish. That information is to be shared in real time among port states, casting an electronic net over pirate ships.<\/p>\n<p>But for this remedy to this tragedy of the aquatic commons to be effective, all coastal countries must join the PSMA and enforce its provisions. Otherwise, rogue vessels would likely still be able to find ports of call to get illegal, unregulated and unreported (IUU) seafood to market. To date,\u00a0<a href=\"http:\/\/www.fao.org\/port-state-measures\/resources\/detail\/en\/c\/1113476\/\" target=\"_blank\" rel=\"noopener noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=http:\/\/www.fao.org\/port-state-measures\/resources\/detail\/en\/c\/1113476\/&amp;source=gmail&amp;ust=1574244820543000&amp;usg=AFQjCNGWreiYuar7-WVSmmla1Oa-qRq3Fg\">62 nations plus the European Union<\/a>\u00a0are party to the PSMA. That leaves 77 coastal nations not yet involved, including the world&#8217;s fishing superpower \u2013 China.<\/p>\n<p>China deploys the world\u2019s biggest fishing fleet and catches the most fish. It also operates 14 of the 15 busiest ports, according to a <a href=\"https:\/\/cbe.miis.edu\/cgi\/viewcontent.cgi?article=1097&amp;context=joce\">study<\/a> ranking the risk of illegally caught fish passing through the biggest ports.<\/p>\n<p>\u201cObviously, China is an important player,\u201d says <a href=\"https:\/\/www.pewtrusts.org\/en\/about\/experts\/dawn-borg-costanzi\">Dawn Borg Costanzi<\/a>, an officer with the <a href=\"https:\/\/www.pewtrusts.org\/en\/projects\/international-fisheries\">Pew international fisheries programme<\/a> in the United Kingdom. \u201cNeighbouring countries have already signed up to the PSMA so we need to close off the remaining gap as it\u2019s important that they cannot look to China as a lax port they can enter with their IUU-caught fish.\u201d<\/p>\n<p>She noted that China\u2019s participation is crucial for another reason.<\/p>\n<p>The PSMA, which is administered by the UN Food and Agriculture Organisation (FAO), <a href=\"http:\/\/www.fao.org\/port-state-measures\/resources\/detail\/en\/c\/1111616\/\">mandates<\/a> that countries require vessels that fly their flag to submit to port inspections. If a port state denies a ship entry because of suspected illegal fishing, it must notify the flag state \u2013 the country where the vessel is registered. If the flag state is a party to the PSMA, that country then has the duty to investigate the vessel and, if it finds evidence of illicit fishing, take action to penalise the ship, such as by levying fines or revoking its registration.<\/p>\n<p>The flag state must then report the result of that investigation and the actions it has taken to the FAO, relevant port states and regional fisheries management organisations.<\/p>\n<p>With nearly 3,000 vessels, China\u2019s overseas fleet is the world\u2019s largest. \u201cSo having China even as a flag state is important for things like information exchange and inspection of Chinese vessels in other ports subject to the Port State Measure Agreement,\u201d says Borg Costanzi.<\/p>\n<div class='cdo-shortcode--image'><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-9021 size-article-inline-full\" src=\"https:\/\/dialogue.earth\/content\/uploads\/2019\/07\/6a_IUU_chinas_fleet-logo-1440x900.png\" alt=\"China's distant water fishing fleet (1985-2013)\" width=\"1440\" height=\"900\" \/><\/div>\n<p>The port study, which was conducted with financial support from the Pew Charitable Trusts, ranked China as among the countries most at risk of illegal fishing vessels passing through its ports. That\u2019s both due to the volume of foreign-flagged ships and a lack of internal controls designed to detect illegal fishing.<\/p>\n<p>\u201cSurely it will be helpful for combating IUU fishing worldwide if China joins and implements the PSMA,\u201d says <a href=\"https:\/\/www.ictsd.org\/about-us\/yi-tang\">Tang Yi<\/a>, dean of the College of Marine Culture and Law at Shanghai Ocean University.<\/p>\n<p>He says he expects China to ratify the PSMA \u201cno later than 2020.\u201d<\/p>\n<p>\u201cI actually know that the Fisheries Bureau of the Ministry of Agriculture and Rural Affairs, which is the central government agency in charge of fisheries in China, is trying its best to promote China\u2019s accession to the agreement,\u201d he wrote in an email from New York City, where he was attending the UN negotiations to <a href=\"https:\/\/dialogue.earth\/9644-high-seas-treaty-race-for-rights-to-oceans-genetic-resources\/\">draft a treaty<\/a> to protect the biodiversity of the high seas.<\/p>\n<p>\u201cBefore China is ready to join the PSMA, the coordination mechanism between the fisheries agency and the maritime agency and the custom sector must be established,\u201d he adds. \u201cThe possible ports [that] could be designated for the\u2026 entrance of the vessels not entitled to fly China\u2019s flag are managed by the maritime agency.\u201d<\/p>\n<p>Coordination between the various agencies within countries with jurisdiction over fishing is one obstacle to the implementation of the PSMA. Another is the creation of an electronic information mechanism to share port inspection data in real time to prevent ships denied entry in one country from going \u201cport shopping\u201d in others.<\/p>\n<p>\u201cSo far it\u2019s still a challenge for port states to get in contact with some of the flag states to validate the information the vessels are providing,\u201d notes Borg Costanzi. \u201cWhen a port state finds something amiss, it\u2019s not easy for other port states to know if the vessel shows up in their ports.\u201d<\/p>\n<p>A prototype of an online information-sharing system is set to be unveiled in May 2020.<\/p>\n<p>Developing countries \u2013 particularly small island states \u2013 face financial challenges in implementing the PSMA, though the agreement does provide for the provision of resources to help those nations develop inspection and data systems.<\/p>\n<div class='cdo-shortcode--image'><a href=\"https:\/\/dialogue.earth\/content\/uploads\/2019\/10\/PSMA_world_map-EN.png\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone wp-image-11756 size-article-inline-full\" src=\"https:\/\/dialogue.earth\/content\/uploads\/2019\/10\/PSMA_world_map-EN-1440x1079.png\" alt=\"which countries are party to PSMA (Port State Measures Agreement)?\" width=\"1440\" height=\"1079\" \/><\/a><\/div>\n<p>According to the FAO, 40 countries are receiving assistance and US$15.5 million has been allocated to 10 current projects to build the capacity of developing nations to carry out the PSMA.<\/p>\n<p>A <a href=\"http:\/\/www3.weforum.org\/docs\/WEF_Ending_Illegal_Fishing_Report_2019.pdf\">white paper<\/a> issued in May by <a href=\"https:\/\/oceansolutions.stanford.edu\/\">Stanford University\u2019s Centre for Ocean Solutions<\/a> and the World Economic Forum concluded that: \u201cTransitioning historically secretive and paper-based systems to ones that support near real-time data sharing \u2026 is central to the PSMA\u2019s effectiveness.\u201d<\/p>\n<p>So far, the pace of that transition is slowing the rollout of the PSMA, according to lead author <a href=\"https:\/\/oceansolutions.stanford.edu\/team\/annie-brett\">Annie Brett.<\/a> \u201cDespite the PSMA\u2019s increasing number of ratifications, there remain significant questions about how the agreement\u2019s mandates to collect fisheries data and facilitate data sharing between countries can be carried out\u201d she wrote in the paper.<\/p>\n<p>Brett notes that some of the regional fisheries management organisations have already implemented electronic information systems that could serve as a model for the PSMA. The <a href=\"https:\/\/iotc.org\/\">Indian Ocean Tuna Commission<\/a>, for instance, operates a technology platform that allows its 32 member states to share data in real time.<\/p>\n<p>Given the ongoing implementation of the PMSA, experts say it\u2019s difficult to assess the agreement\u2019s impact on illegal fishing to date. But when the Pew-funded researchers analysed 14 ports \u2013 two from each of the FAO\u2019s seven geographical regions \u2013 they found that only three countries had legally identified ports for the entry of overseas fishing vessels.<\/p>\n<p>Records of previous vessel visits could be found at only four ports. Ten ports, however, have put into effect the PMSA requirement that foreign fishing vessels provide advance notification before entering a harbour and only do so after receiving authorisation.<\/p>\n<p>Jose Graziano da Silva, who recently stepped down as director-general of the FAO, has noted the rapid adoption of the PSMA, with 100 countries so far pledging to join the accord.<\/p>\n<p>\u201cThe PSMA is only as strong as the number of ports it closes to IUU fishing; these numbers are crucial,\u201d he said in a statement earlier this year. \u201cWhen you consider that the parties to the PSMA comprise over 50% of total coastal states globally, this is a remarkable achievement in such a short time.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The
