{"id":40090187,"date":"2021-06-09T13:00:36","date_gmt":"2021-06-09T07:30:36","guid":{"rendered":"http:\/\/china-dialogue-ocean-staging.darkbluehq.com\/uncategorized\/175930-can-joe-biden-kickstart-ocean-conservation\/"},"modified":"2022-02-10T23:02:20","modified_gmt":"2022-02-10T17:32:20","slug":"175930-can-joe-biden-kickstart-ocean-conservation","status":"publish","type":"post","link":"https:\/\/dialogue.earth\/en\/ocean\/175930-can-joe-biden-kickstart-ocean-conservation\/","title":{"rendered":"Can Joe Biden kick-start stalled progress on ocean conservation?"},"content":{"rendered":"<p>In the opening months of President Joe Biden\u2019s administration there has been a sea change in ocean policy as the United States moves to re-engage with the international community to tackle climate change.<\/p>\n<p>This engagement could have significant consequences for a host of marine issues, from harmful fishing subsidies and a high seas biodiversity treaty, to efforts to create marine protected areas (MPAs) in Antarctica. To achieve progress, though, observers say the Biden administration must work with China, given the country\u2019s influence on ocean policy.<\/p>\n<p>\u201cChina is working on climate change, they participated in <a href=\"https:\/\/dialogue.earth\/en\/climate\/has-the-biden-summit-jump-started-climate-action\/\">the Biden summit<\/a> on that, and so it seems like they\u2019re really interested in engaging in these multilateral forums on ocean issues,\u201d said Andrea Kavanagh, project director for the Pew Charitable Trusts\u2019 Protecting Antarctica&#8217;s Southern Ocean initiative.<\/p>\n<div class='block--pullout-stat block--pullout-stat--float cd-shortcode--factbox'>\n                <p class='block--pullout-stat__title'>26%<\/p>\n                <div class='block--pullout-stat__content'>\n                    Biden's proposed year-on-year increase in funding for NOAA, a key government agency responsible for understanding climate change, oceans and coasts \n                <\/div>\n            <\/div>\n<p>The details of many Biden policies remain to be announced. But the administration has signalled its strong support of ocean issues by appointing respected scientists and environmentalists to key positions at agencies such as the National Oceanic and Atmospheric Administration (NOAA), which had been demoralised, defunded and politicised <a href=\"https:\/\/www.independent.co.uk\/climate-change\/news\/trump-noaa-craig-mclean-science-fact-climate-denial-influence-b1425030.html\">under the previous president<\/a>, Donald Trump.<\/p>\n<p>Biden, for instance, has proposed a record US$6.9 billion budget for NOAA (a 26% increase on the previous year) and has nominated a former top NOAA scientist, oceanographer <a href=\"https:\/\/www.aip.org\/fyi\/2021\/noaa-nominee-rick-spinrad-has-deep-roots-agency\">Rick Spinrad, to run the agency<\/a>. John Kerry, the administration\u2019s climate envoy, founded the <a href=\"https:\/\/www.ourocean2020.pw\/\">Our Ocean conference<\/a> when he served as secretary of state in the Barack Obama administration. Marine ecologist Jane Lubchenco, <a href=\"https:\/\/www.reuters.com\/article\/us-usa-biden-science-lubchenco-idUSKBN2BB2DW\">who has become<\/a> the deputy director for climate and environment at the White House Office of Science and Technology Policy, served as NOAA\u2019s chief under Obama.<\/p>\n<p>The Biden administration <a href=\"https:\/\/edition.cnn.com\/2021\/05\/06\/politics\/conservation-plans-biden-administration\/index.html\">has pledged<\/a> to protect 30% of US land and waters by 2030. In May, it tried to globalise that \u201c30&#215;30\u201d commitment when it joined a <a href=\"https:\/\/www.gov.uk\/government\/publications\/g7-climate-and-environment-ministers-meeting-may-2021-communique\/g7-climate-and-environment-ministers-communique-london-21-may-2021\">communiqu\u00e9<\/a>\u00a0issued by G7 nations calling for protection of 30% of the world\u2019s oceans, also by 2030.<\/p>\n<p>The communiqu\u00e9 committed the nations to work toward concluding negotiations over a <a href=\"https:\/\/theconversation.com\/how-a-global-ocean-treaty-could-protect-biodiversity-in-the-high-seas-139552\">high seas biodiversity treaty<\/a> by the end of 2021 and supported efforts to expand a network of marine protected areas in Antarctica.<\/p>\n<p>While the Covid-19 pandemic has significantly slowed international negotiations, 2021 could prove a pivotal year to finalise long-running talks on damaging fishing subsidies, the high seas biodiversity treaty and the creation of vast new marine protected areas in Antarctica.<\/p>\n<h2>Fisheries subsidies<\/h2>\n<p>For two decades, the World Trade Organisation (WTO) has <a href=\"https:\/\/dialogue.earth\/15886-wto-fails-to-meet-fishing-subsidies-deadline\/\">attempted to reach an agreement<\/a> by its 164 member states to ban harmful fisheries subsidies that promote overfishing and <a href=\"https:\/\/dialogue.earth\/11813-explainer-illegal-unreported-and-unregulated-fishing\/\">illegal, unreported and unregulated<\/a> (IUU) fishing.<\/p>\n<p>During that time, China\u2019s overseas fishing fleet has expanded and become the world\u2019s largest, at nearly 3,000 vessels. <a href=\"https:\/\/www.sciencedirect.com\/science\/article\/abs\/pii\/S0308597X16000026\">Researchers in 2016 determined that<\/a> US$20 billion of US$35 billion in annual global fisheries subsidies were harmful. The result: one-third of fish species are being harvested at biologically unsustainable levels, <a href=\"http:\/\/www.fao.org\/state-of-fisheries-aquaculture\/en\/\">according to the United Nations Food and Agriculture Organisation<\/a>.<\/p>\n<p><iframe class=\"flourish-embed-iframe\" style=\"width: 100%; height: 600px;\" title=\"Interactive or visual content\" src=\"https:\/\/flo.uri.sh\/visualisation\/4682795\/embed\" frameborder=\"0\" scrolling=\"no\" sandbox=\"allow-same-origin allow-forms allow-scripts allow-downloads allow-popups allow-popups-to-escape-sandbox allow-top-navigation-by-user-activation\"><\/iframe><\/p>\n<div style=\"width: 100%!; margin-top: 4px!important; text-align: right!important;\"><\/div>\n<p>Rashid Sumaila, a University of British Columbia fisheries expert and close observer of the WTO, is optimistic that a deal may finally be in sight \u2013 for two reasons. One is that the new director-general, <a href=\"https:\/\/www.wto.org\/english\/thewto_e\/dg_e\/dg_e.htm\">Ngozi Okonjo-Iweala<\/a> of Nigeria, has <a href=\"https:\/\/news.mongabay.com\/2021\/03\/first-female-leader-signals-new-day-for-wto-commentary\/\">made fisheries subsidies a priority<\/a>. She is convening a <a href=\"https:\/\/www.wto.org\/english\/news_e\/news21_e\/fish_21apr21_e.htm\">ministerial conference in July<\/a> with the aim of finalising negotiations. The other reason is the new environmentally friendly US administration.<\/p>\n<p>\u201cHopefully, these two recent events might just help the WTO and the world get the job done after 20 years of trying,\u201d he said. \u201cThat would be a big win for marine biodiversity, fish and fishers who want to fish sustainably.\u201d<\/p>\n<p>The Biden administration\u2019s specific stance on the negotiations remains to be seen. \u201cSo far the administration has been focusing on climate change and have not said much about the WTO negotiation on fisheries subsidies,\u201d noted Sumaila, adding that it \u201cseems to be holding to the US position that the country wants an ambitious agreement. I hope they are pushing for this behind the scenes.\u201d<\/p>\n<p>Cooperation between China and the US, two of the biggest subsidisers, is key to breaking the stalemate at the WTO, according to Sumaila. For years, negotiations have been hampered by disagreements over whether developing countries would be given more time to phase out subsidies. WTO member states are allowed to declare themselves as developing nations, as China has done.<\/p>\n<p>\u201cOne single action that would help is for the US to work with China and come up with a joint communiqu\u00e9 stating that the nations will support reaching an agreement at the upcoming WTO Ministerial [conference],\u201d he said. \u201cI think such an agreement between the US and China would incentivise other countries to sign on.\u201d<\/p>\n<h2>Antarctic marine protection<\/h2>\n<p>Antarctica is one of the regions most impacted by climate change and fishing. It\u2019s also where the international community, even at its most divided, has come together to protect the continent\u2019s unique biodiversity. At the height of the Cold War in 1959, the US, Soviet Union and 10 other countries signed the <a href=\"https:\/\/www.ats.aq\/e\/antarctictreaty.html\">Antarctica Treaty<\/a>, committing the parties to peaceful exploration.<\/p>\n<p>An international convention established the Commission for the Conservation of Antarctic Marine Living Resources (<a href=\"https:\/\/www.ccamlr.org\/en\">CCAMLR<\/a>) in 1982. CCAMLR currently has 26 member states, including China and the US. The parties\u2019 approval of the 1.57 million km<sup>2<\/sup>\u00a0Ross Sea marine protected area, which came into effect in 2017 and banned commercial fishing for 35 years, created the world\u2019s largest MPA.<\/p>\n<blockquote><p>Temperatures in Antarctica are rising three times faster than the global average, according to a 2020 study<\/p><\/blockquote>\n<p>It was to be part of a network of protected zones to limit the effects of climate change and a burgeoning krill fishing industry. <a href=\"https:\/\/www.antarctica.gov.au\/news\/explore-antarctica\/krill\/\">Krill<\/a>, a small crustacean, is considered a \u201ckeystone\u201d species because it converts energy from the sun \u2013 by eating single-celled plants called phytoplankton \u2013 into food for larger marine species including penguins and whales. Commercial fishing turns hundreds of thousands of tonnes of krill into fish meal to feed farmed fish and pets, as well as krill oil for human health supplements.<\/p>\n<p>Krill populations are also being affected by climate change, with temperatures in Antarctica rising three times faster than the global average, a 2020 <a href=\"https:\/\/www.nature.com\/articles\/s41558-020-0815-z\">study<\/a> found.<\/p>\n<p>However, efforts to address these two threats through the establishment of three additional MPAs \u2013 in East Antarctica, the Weddell Sea, and around the Antarctic Peninsula \u2013 <a href=\"https:\/\/dialogue.earth\/15754-nations-fail-to-agree-on-expanding-protection-southern-ocean\/\">have foundered in recent years<\/a>, largely due to objections from China and Russia. China deploys a <a href=\"https:\/\/dialogue.earth\/3891-krill-fishers-agree-to-partial-ban-in-antarctic\/\">krill fishing fleet<\/a> in the Southern Ocean and Russia has taken steps to establish its own krill fishery. Other nations fishing for krill in the past decade include Norway, South Korea, Japan, Chile, Poland and Ukraine. A proposed MPA requires unanimous approval by member states.<\/p>\n<div class='cdo-shortcode--image'><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone wp-image-15582 size-full\" src=\"https:\/\/dialogue.earth\/content\/uploads\/2020\/10\/20201019_Antarctica_MPAs_English_2560.png\" alt=\"Antarctica MPAs map\" width=\"2000\" height=\"1429\" \/><\/p>\n<p><\/div>\n<p>Efforts to break the impasse received a boost in April when <a href=\"https:\/\/www.pewtrusts.org\/en\/about\/news-room\/press-releases-and-statements\/2021\/04\/28\/pew-applauds-us-decision-to-co-lead-on-southern-ocean-marine-protected-areas\">Kerry announced the US would join other CCAMLR states<\/a> to press for the approval of the East Antarctica and Weddell Sea MPAs. The proposed Antarctica Peninsula MPA is still being evaluated by CCAMLR\u2019s scientific committee.<\/p>\n<p>\u201cThe US coming on as an official co-sponsor is great news,\u201d said Kavanagh of the Pew Charitable Trusts. \u201cIt\u2019s just showing that there\u2019s this global push and a global awareness that we need to have these protections.\u201d<\/p>\n<p>She noted that negotiations over the Ross Sea MPA dragged on for years until a group of nations coordinated a campaign to persuade China and Russia to sign off on it. \u201cObama himself got involved, especially when talking with China,\u201d said Kavanagh.<\/p>\n<blockquote><p>In virtual negotiations, you don\u2019t have any of the hallway meetings or the receptions and dinners where most of the work gets done.<\/p><\/blockquote>\n<p>She said a similar approach is needed to reach consensus on the East Antarctica and Weddell Sea MPAs. Kerry\u2019s involvement is an encouraging sign, given his former position as secretary of state and his <a href=\"https:\/\/www.state.gov\/u-s-china-joint-statement-addressing-the-climate-crisis\/\">experience in negotiating with China<\/a>.<\/p>\n<p>\u201cJohn Kerry in his role as the climate envoy knows how important MPAs are to provide resilience against climate change,\u201d said Kavanagh.<\/p>\n<p>Prospects for face-to-face negotiations, however, look dim. CCMALR is headquartered in Tasmania, Australia, where its annual meeting is held. But in May, the <a href=\"https:\/\/www.reuters.com\/world\/asia-pacific\/australia-sticks-by-plan-re-open-border-mid-2022-2021-05-16\/\">Australian government announced<\/a> it would keep its borders closed to international visitors until mid-2022.<\/p>\n<p>\u201cIt\u2019s just tough because in the virtual meetings you don\u2019t have as much time for negotiations because of time differences,\u201d Kavanagh said. \u201cAnd you don\u2019t have any of the hallway meetings or the receptions and dinners where most of the work gets done.\u201d<\/p>\n<h2>High seas biodiversity treaty<\/h2>\n<p>In early March 2020, Kerry helped facilitate a \u201cHigh Seas Treaty Dialogue\u201d with government leaders in Monaco. The event highlighted issues to be taken up three weeks later at the United Nations when delegates were to convene for what was to be a final session to complete a landmark <a href=\"https:\/\/www.un.org\/bbnj\/\">treaty<\/a> to protect biodiversity on the high seas.<\/p>\n<p>Among other provisions, the treaty would allow for the creation of marine protected areas in the 58% of the ocean that lies beyond national jurisdiction, provide for the <a href=\"https:\/\/dialogue.earth\/9644-high-seas-treaty-race-for-rights-to-oceans-genetic-resources\/\">sharing of marine genetic resources<\/a> among nations and require environmental impact assessments for certain high seas activities.<\/p>\n<figure id=\"attachment_17602\" aria-describedby=\"caption-attachment-17602\" style=\"width: 250px\" class=\"wp-caption alignright\"><a href=\"https:\/\/dialogue.earth\/9644-high-seas-treaty-race-for-rights-to-oceans-genetic-resources\/\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-17602\" src=\"https:\/\/dialogue.earth\/content\/uploads\/2021\/06\/sea-stars-on-pinnacle.jpg\" alt=\"brisingid sea stars\" width=\"250\" height=\"230\" \/><\/a><figcaption id=\"caption-attachment-17602\" class=\"wp-caption-text\"><strong>See also:<\/strong> <a href=\"https:\/\/dialogue.earth\/9644-high-seas-treaty-race-for-rights-to-oceans-genetic-resources\/\">High seas treaty: race for rights to ocean\u2019s genetic resources<\/a><\/figcaption><\/figure>\n<p>There was little consensus, though, on the specific terms of those provisions or how they would be implemented as delegates prepared to gather in New York last year. Then, days before negotiations were to begin, the United Nations and the rest of New York City went into lockdown as the pandemic spread.<\/p>\n<p>With in-person negotiations postponed, delegates began meeting virtually in monthly video sessions, according to Peggy Kalas, coordinator of the\u00a0<a href=\"https:\/\/highseasalliance.org\/\">High Seas Alliance<\/a>, a coalition of\u00a0<a href=\"https:\/\/highseasalliance.org\/member-info\">major environmental groups<\/a>\u00a0founded in 2011 to advocate for a high seas biodiversity treaty. The talks are informal, which means they don\u2019t carry the weight of formal negotiations.<\/p>\n<p>Kalas said it\u2019s too early to know how the Biden administration\u2019s environmental policies will affect the treaty negotiations, noting that ocean-related senior positions in the US State Department remain vacant.<\/p>\n<p>But observers view Kerry\u2019s interest in the high seas biodiversity treaty as promising.<\/p>\n<p>\u201cWe\u2019re hoping that we can perhaps get Kerry to engage\u201d in treaty negotiations, Kalas said.<\/p>\n<p>In-person negotiations currently are set to resume in August, though some observers expect talks to be postponed as other UN negotiations have been recently.
