Yet, without a clear international framework for this practice, it could lead to environmental damage, biodiversity loss and the alteration of the seabed.&nbsp;<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Fearsome-looking machines scrape the seabed in order to separate stones known as <\/span><a href=\"https:\/\/www.nature.com\/articles\/s43017-020-0027-0\"><span style=\"font-weight: 400;\">polymetallic nodules<\/span><span style=\"font-weight: 400;\"> that are <\/span><\/a><span style=\"font-weight: 400;\">rich in cobalt, copper, manganese and nickel and pump the material to the surface through giant tubes. Sediment is returned to the sea via another conduit.&nbsp;&nbsp;&nbsp;<\/span><\/p>\n<div class='cdo-shortcode--image'><\/p>\n<p><figure id=\"attachment_43701\" aria-describedby=\"caption-attachment-43701\" style=\"width: 463px\" class=\"wp-caption aligncenter\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-43701 size-full\" src=\"https:\/\/dialogue.earth\/content\/uploads\/2021\/06\/polymetalic_nodules.png\" alt=\"polymetalic nodules are underwater mineral rich stones\" width=\"463\" height=\"460\"><figcaption id=\"caption-attachment-43701\" class=\"wp-caption-text\">Polymetalic nodules are underwater mineral rich stones (photo: China Dialogue Ocean)<\/figcaption><\/figure><\/p>\n<p><\/div>\n<p><span style=\"font-weight: 400;\">However, these&nbsp; deep waters host species and ecosystems that provide sustenance and ecosystem balance, and &nbsp; are highly vulnerable, according to recent studies by <\/span><a href=\"https:\/\/storage.googleapis.com\/planet4-international-stateless\/2019\/06\/f5458206-in-deep-water-deep-sea-mining.pdf\"><span style=\"font-weight: 400;\">Greenpeace<\/span><\/a><span style=\"font-weight: 400;\"> and <\/span><a href=\"https:\/\/wwfeu.awsassets.panda.org\/downloads\/wwf_intoodeep_what_we_know_and_dont_know_about_deepseabedmining_report_february_2021.pdf\"><span style=\"font-weight: 400;\">WWF<\/span><\/a><span style=\"font-weight: 400;\"> Europe.&nbsp;<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Mexico was initially hesitant about this type of mining but now an international settlement could open the door for extraction in an area inhabited by vulnerable marine species.&nbsp;<\/span><\/p>\n<h2>Mining \u201cDon Diego\u201d<\/h2>\n<p><span style=\"font-weight: 400;\">In 2018, The Secretariat of Environment and Natural Resources (<\/span><a href=\"https:\/\/www.gob.mx\/semarnat\"><span style=\"font-weight: 400;\">Semarnat<\/span><\/a><span style=\"font-weight: 400;\">) denied the environmental license for the \u201cDon Diego\u201d mine, promoted by Exploraciones Oce\u00e1nica S. de RL de CV, a subsidiary of the American Odyssey Marine Explorations, on the grounds that it could damage the habitats of loggerhead turtles, gray and humpback whales and fishing areas. It also noted the lack of a public consultation on the proposed operation.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The <\/span><a href=\"https:\/\/mapa.conflictosmineros.net\/ocmal_db-v2\/conflicto\/view\/920\"><span style=\"font-weight: 400;\">project<\/span><\/a><span style=\"font-weight: 400;\">, which covers an area of \u200b\u200b91,267 hectares in the Bay of Ulloa, planned to dredge the seabed to depths of between 60 and 90 metres to extract 7 million tons of phosphate sand annually over 50 years. This would yield some&nbsp; 3.5 million tonnes of phosphorus.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Faced with this, in 2019 the corporation <\/span><a href=\"https:\/\/www.italaw.com\/sites\/default\/files\/case-documents\/italaw10765.pdf\"><span style=\"font-weight: 400;\">sued<\/span><\/a><span style=\"font-weight: 400;\"><a href=\"http:\/\/stage.dialogochino.net\/en\/countries\/mexico\/\"> Mexico<\/a> for US$3.54 billion of lost investment before an arbitration panel under the then North American Free Trade Agreement (NAFTA, which was replaced that same year by a new trade agreement between Mexico, the US and Canada).&nbsp;&nbsp;<\/span><\/p>\n<blockquote><p><span style=\"font-weight: 400;\">There is no governance framework for the high seas. That means that marine protected areas cannot be established and there are no security measures<\/span><\/p><\/blockquote>\n<p><span style=\"font-weight: 400;\">If Mexico loses, it could lose its ability to veto extractive projects based on the precautionary principle that safeguards against anticipated damage.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Several other exploration ventures are underway in the Clarion-Clipperton Zone (ZCC), an offshore area outside Mexico\u2019s <\/span><a href=\"http:\/\/www.cuentame.org.mx\/hipertexto\/zona_economica.htm\"><span style=\"font-weight: 400;\">national Exclusive Economic Zone<\/span><\/a><span style=\"font-weight: 400;\"> which extends over 4.5 million square kilometers &#8211; twice the size of Mexico. The zone <\/span><a href=\"https:\/\/isa.org.jm\/files\/files\/documents\/tstudy6.pdf\"><span style=\"font-weight: 400;\">contains<\/span><\/a><span style=\"font-weight: 400;\"> almost 6,000 million tons of manganese, 270 million tons of nickel, 234 million tons of copper and 46 million tons of cobalt.&nbsp;<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Mexico did not object to the granting of these permits, according to requests for information made by Di\u00e1logo Chino to Semarnat and the ministry of Foreign Relations despite environmental activists and academics&nbsp; warning of possible damage to the seabed and fisheries. They urge a moratorium on permits for exploration and extraction.&nbsp;<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Meanwhile, there is still no binding agreement for the environmental protection of the high seas.&nbsp;<\/span><\/p>\n<h2>Lack of clarity in legislation<\/h2>\n<p><span style=\"font-weight: 400;\">For Gladys Mart\u00ednez, a lawyer for non-governmental organisation the <\/span><a href=\"https:\/\/aida-americas.org\/es\"><span style=\"font-weight: 400;\">Inter-American Association for the Defense of the Environment<\/span><\/a><span style=\"font-weight: 400;\">, it is &#8220;worrying&#8221; that the International Seabed Administration (ISA) provides concessions without scientific rigour.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cThere is no governance framework for the high seas. That means that marine protected areas cannot be established and there are no security measures. There are a lot of activities that are carried out without being organised,\u201d Mart\u00ednez told Di\u00e1logo Chino.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Created in 1994 under the United Nations Convention on the Law of the Sea (UNCLOS), ISA, headquartered in Jamaica, controls activities carried out on the seabed of waters outside national jurisdiction and has declared nine areas of environmental interest where permits cannot be granted. UNCLOS stipulated that the ZCC and its mineral resources are &#8220;the common heritage of humanity&#8221;.&nbsp;<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Yet, ISA has also signed 31 contracts for the exploration of polymetallic nodules, sulfides and cobalt crusts with 22 companies in areas adjacent to those protected. The total area granted for exploration covers one million square kilometres.&nbsp;<\/span><\/p>\n<div class='block--pullout-stat block--pullout-stat--float cd-shortcode--factbox'>\n                <p class='block--pullout-stat__title'>Did you know\u2026?<\/p>\n                <div class='block--pullout-stat__content'>\n                    <br \/>\n<span style=\"font-weight: 400;\">The International Seabed Administration&nbsp;controls activities carried out on the seabed of waters outside national jurisdiction<\/span><br \/>\n\n                <\/div>\n            <\/div>\n<p><span style=\"font-weight: 400;\">Of these contracts, the Beijing-based China Ocean Mineral Resources Research and Development Association (<\/span><a href=\"http:\/\/www.comra.org\/en\/\"><span style=\"font-weight: 400;\">COMRA<\/span><\/a><span style=\"font-weight: 400;\">) owns three, as does the South Korean government. Beijing-based<\/span><a href=\"http:\/\/www.minmetals.com\/english\/\"><span style=\"font-weight: 400;\"> China Minmetals Corporation<\/span><\/a><span style=\"font-weight: 400;\">, which is overseen by the State-owned Assets Supervision and Administration Commission, has one, as does <\/span><a href=\"https:\/\/www.isa.org.jm\/node\/19337\"><span style=\"font-weight: 400;\">Beijing Pioneer Hi-Tech Development Corporation<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Little is known about these projects. In 2019, Liu Feng, COMRA&#8217;s general secretary, revealed that <\/span><a href=\"https:\/\/dialogue.earth\/10891-china-deep-sea-exploration-comra\/\"><span style=\"font-weight: 400;\">China<\/span><\/a><span style=\"font-weight: 400;\"> makes about five exploratory trips each year to test technologies and take mineral samples. The Chinese government also agreed to create a training center for delegates from developing nations in partnership with ISA, and to design a system for environmental impact assessments.<\/span><\/p>\n<h2>Uncertain future<\/h2>\n<p><span style=\"font-weight: 400;\">Promoters of underwater mining say that the energy transition, which depends upon the manufacture of wind turbines, solar panels and electric batteries, requires cobalt, copper, lithium, nickel and so-called \u201crare earths\u201d. These are a set of 17 metals and China and the US are the world&#8217;s largest producers.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Violeta N\u00fa\u00f1ez, an academic at the state Metropolitan Autonomous University, says these operations are happening at great magnitude.<\/span><\/p>\n<div class='block--pullout-stat block--pullout-stat--float cd-shortcode--factbox'>\n                <p class='block--pullout-stat__title'>17<\/p>\n                <div class='block--pullout-stat__content'>\n                    <br \/>\nRare earths exist and are used in a variety of technologies<br \/>\n\n                <\/div>\n            <\/div>\n<p><span style=\"font-weight: 400;\">\u201cThere is interest from companies to move towards the sea, because the world is going to require it. This is crucial for the clean energy industry. The interest is to advance on those spaces where the world&#8217;s greatest mining wealth is,\u201d said N\u00fa\u00f1ez, who is the author of <\/span><a href=\"http:\/\/dcsh.xoc.uam.mx\/repdig\/index.php\/libros-dcsh\/produccion-economica\/item\/383-el-capital-rumbo-al-mar-una-nueva-era-minera-mineria-marina\"><i><span style=\"font-weight: 400;\">Capital towards the sea<\/span><\/i><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">While ISA must approve environmental standards for eventual exploitation permits, the future of the Global Treaty of the Oceans, which will mandate&nbsp; the protection and sustainable use of biodiversity in areas outside of national laws, under the UNCLOS, has been stalled by the pandemic.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Next August will see the fourth meeting of UNCLO\u2019s Intergovernmental Conference which will be held in New York, following <\/span><a href=\"https:\/\/www.un.org\/bbnj\/\"><span style=\"font-weight: 400;\">talks<\/span><\/a><span style=\"font-weight: 400;\"> that began in 2019. One of the issues that generates friction among countries is environmental impact assessments and the role of a scientific and technical body within the treaty.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The pact is going to create a global framework, which is what is needed, according to Mart\u00ednez. \u201cYou cannot talk about marine mining without a global standard, you have to talk about areas outside of national jurisdictions. In Latin America there are several key areas for marine protection, but they require a global standard,\u201d she said.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In 2019 the international campaign for a <\/span><a href=\"http:\/\/www.deepseaminingoutofourdepth.org\/\"><span style=\"font-weight: 400;\">moratorium<\/span><\/a><span style=\"font-weight: 400;\"> on underwater exploration and exploitation gained strength.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Motion <\/span><a href=\"https:\/\/www.iucncongress2020.org\/es\/motion\/069\"><span style=\"font-weight: 400;\">69<\/span><\/a><span style=\"font-weight: 400;\"> of the world congress of the International Union for Conservation of Nature, to be staged next September in the French city of Marseille in face-to-face and virtual format, promotes this break for the protection of deep-sea ecosystems and biodiversity. If approved, the moratorium will be part of the agenda for the next four years.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">N\u00fa\u00f1ez wonders what will happen when exploitation begins. \u201cWe don&#8217;t know yet what is going to stop those permits. The business focus is on profit, there is no idea about sustainability. The only options that the mining industry sees are the ocean floor,\u201d she said.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">M\u00f3nica Franco, director of&nbsp;<a href=\"https:\/\/costasalvaje.org\/\">Costa Salvaje NGO<\/a>,&nbsp;stresses the importance of moratoria:&#8221;We have to question whether we want short-term benefits or to invest in areas where benefits are not seen immediately, but over the next generations.&#8221;<\/span><\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The transition to clean energy requires minerals and companies are looking to the bottom of the sea.
