{"id":50059301,"date":"2022-10-12T14:34:21","date_gmt":"2022-10-12T13:34:21","guid":{"rendered":"https:\/\/stage.dialogochino.net\/?p=59301"},"modified":"2023-08-16T20:31:42","modified_gmt":"2023-08-16T19:31:42","slug":"59301-ecuador-indigenous-groups-oil-mining-moratorium","status":"publish","type":"post","link":"https:\/\/dialogue.earth\/en\/justice\/59301-ecuador-indigenous-groups-oil-mining-moratorium\/","title":{"rendered":"Ecuador\u2019s indigenous groups accept oil and mining freeze, but await new law"},"content":{"rendered":"<p>An unprecedented recent decision could be a milestone in Ecuador\u2019s history. Last month, the national government announced a <a href=\"https:\/\/amazonwatch.org\/news\/2022\/0913-ecuador-declares-temporary-moratorium-on-new-oil-and-mining-concessions\">one-year moratorium<\/a> on new mining and oil projects, with the registers for new concessions, environmental permits and tenders for oil blocks to remain closed.<\/p>\n<p>On 9 September, President Guillermo Lasso\u2019s government and indigenous organisations <a href=\"https:\/\/www.reuters.com\/world\/americas\/ecuador-inks-temporary-oil-moratorium-deal-with-indigenous-groups-2022-09-09\/\">signed<\/a> an act to formalise the measure, which will remain in force until the drafting of a law on prior consultation with communities located in proximity to proposed projects.<\/p>\n<p>This agreement came as a result of talks held after weeks of often-violent <a href=\"https:\/\/www.theguardian.com\/world\/2022\/jul\/01\/ecuador-deal-reached-to-end-weeks-of-deadly-protests-and-strikes\">protests<\/a> in June, which, among other concerns, focused on indigenous peoples\u2019 dissatisfaction with the government\u2019s economic and extractive policies. At least five people died during the demonstrations, more than 500 were reported injured and economic losses were <a href=\"https:\/\/www.france24.com\/en\/live-news\/20220704-indigenous-protests-cost-ecuador-1-bn-central-bank-says\">estimated<\/a> at US$1 billion.<\/p>\n<p>With the signing of the moratorium, activities at some 15 oil blocks will be frozen pending new regulation, according to the Ministry of Energy and Mines, as well as some 200 mining projects that cannot operate due to the lack of permits, which will depend on a future law, according to estimates by the indigenous movement.<\/p>\n<blockquote><p>This agreement gives the Ecuadorian state the opportunity to settle a debt it has owed indigenous peoples for decades<\/p><\/blockquote>\n<p>\u201cThe moratorium should be maintained until a law is issued that regulates, in accordance with international and national human rights standards, prior consultation for the implementation of any project that could affect indigenous territories,\u201d said Cristina Melo, legal adviser to the Fundaci\u00f3n Pachamama. Her organisation has represented the Confederation of Indigenous Nationalities of Ecuador (CONAIE) that has led the protests and called for non-violent action.<\/p>\n<p>This agreement, she added, \u201cgives the Ecuadorian state the opportunity to settle a debt it has owed the indigenous peoples for decades.\u201d<\/p>\n<p>It comes 10 years after the <a href=\"https:\/\/www.amnesty.org\/en\/latest\/press-release\/2012\/07\/ecuador-inter-american-court-ruling-marks-key-victory-indigenous-peoples-20\/\">Sarayaku vs Ecuador<\/a> case, a landmark ruling which upheld indigenous right to free, prior and informed consent, after an oil company had encroached on ancestral lands. \u201cThe Inter-American Court of Human Rights (IACHR) had already established the obligation of the Ecuadorian state to legislate appropriately on this right,\u201d Melo points out.<\/p>\n<h2>Demands and decrees<\/h2>\n<p>During negotiations over the moratorium, CONAIE asked the government to halt the expansion of the mining and oil frontier, for an audit of the concessions granted, and for socio-environmental reparations, among other demands. As part of these actions, they also demanded the repeal of two recently issued government decrees.<\/p>\n<p>Decree 95, which came into force on 7 July 2021, was <a href=\"https:\/\/www.fielweb.com\/App_Themes\/InformacionInteres\/Decreto_Ejecutivo_No._95_20210607132917_20210607132920.pdf\">launched<\/a> by President Lasso in an attempt to double oil production, which in the second quarter of that year stood at almost 500,000 barrels of crude per day. It opened up changes in public policies to improve technical and operating conditions for investors and adjustments in contract models, among other measures. It was repealed on 29 June, one day before the end of the demonstrations.<\/p>\n<p>Decree 151, meanwhile, was not repealed. This order came into force on 5 August last year, and contained an action plan for the mining sector that streamlined concession procedures. Instead of its repeal, the government issued Decree 468, which orders that no new mining permits be approved in indigenous territories and protected areas \u2013 something that is already enshrined in the country\u2019s constitution. It does, however, exempt projects that already had a prior agreement.<\/p>\n<h2>Indigenous scepticism in Ecuador<\/h2>\n<p>On 24 August, amid the negotiations, indigenous leaders demanded progress. On that day, Gilberto Talahua of the Bolivar Indigenous Movement <a href=\"https:\/\/www.youtube.com\/watch?v=7uk_pVjxNoU\">said<\/a> that he hoped that a moratorium \u201con all extractive activities\u201d would be reached.<\/p>\n<p>At the same meeting, environment minister Gustavo Manrique agreed with the leaders, but also said that \u201cminerals have a role in the planet\u201d, and that this meant analysing different options.<\/p>\n<figure id=\"attachment_28051\" aria-describedby=\"caption-attachment-28051\" style=\"width: 350px\" class=\"wp-caption alignright\"><a href=\"https:\/\/dialogue.earth\/en\/extractive-industries\/28022-ecuador-mining-conflict-evolves-into-a-battle-for-indigenous-identity\/\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-28051\" src=\"https:\/\/dialogue.earth\/content\/uploads\/2019\/06\/IMG_2894.jpg\" alt=\"woman points to Junefield's mine Ecuagoldmining\" width=\"350\" height=\"233\" \/><\/a><figcaption id=\"caption-attachment-28051\" class=\"wp-caption-text\"><strong>Read more: <a href=\"https:\/\/dialogue.earth\/en\/extractive-industries\/28022-ecuador-mining-conflict-evolves-into-a-battle-for-indigenous-identity\/\">Ecuador mining conflict evolves into a battle for indigenous identity<\/a><\/strong><\/figcaption><\/figure>\n<p>On 5 September, another roundtable was reinstated to hear counter proposals. Luis Mullo, president of the National Confederation of Indigenous and Black Peasant Organisations (FENOCIN), expressed his dissatisfaction with the government\u2019s responses: \u201cOn the part of civil society, we are complying with peace, but [their response] worries us.\u201d Nevertheless, the parties reached several agreements, chief among them the moratorium.<\/p>\n<p>Jos\u00e9 Cueva, an agronomist and expert in mining and environmental issues who has advised the indigenous movement, told Di\u00e1logo Chino that the dissatisfaction among part of the leadership is generated by the contradictory discourse of the government.<\/p>\n<p>\u201cThe government has never accepted that the moratorium should include all projects, including those that currently have permits or concessions granted,\u201d Cueva said. \u201cThe government says that only new projects or applications are included in the moratorium.\u201d<\/p>\n<p>True to this, in <a href=\"https:\/\/www.youtube.com\/watch?v=-qF5Qki9PLY\">statements<\/a> to the media, the Minister of Energy and Mines, Xavier Vera, indicated that all projects that are underway will continue, and that several mining projects will be able to obtain an environmental license without the requirement of prior consultation. The six projects \u2013 Curipamba, La Plata, Loma Larga, Cascabel, Warintza and Mirador Norte \u2013 are mostly focused on gold, copper and silver extraction, and represent investments of more than US$10 billion.<\/p>\n<p>Di\u00e1logo Chino made several approaches to the ministry for comment and further information on these projects, but at the time of press, no response had been received.<\/p>\n<h2>Mining presence, projects on hold<\/h2>\n<p>In 2018, when more than 4,200 sources of <a href=\"http:\/\/pras.ambiente.gob.ec\/documents\/2132788\/7427703\/14.+BASE+FINAL+GADs+v2.1.pdf\/5657ccba-b143-4890-b45b-ef7384a2e856\">mining contamination<\/a> were detected nationwide, the energy ministry launched a \u201cpurification\u201d project to verify the situation and consolidate information on the country\u2019s mining sector.<\/p>\n<div class='block--pullout-stat block--pullout-stat--float cd-shortcode--factbox'>\n                <p class='block--pullout-stat__title'>4,237<\/p>\n                <div class='block--pullout-stat__content'>\n                    <br \/>\nThe number of sources of mining contamination in Ecuador recorded by a 2018 investigation by the Ministry of Environment and Water<br \/>\n\n                <\/div>\n            <\/div>\n<p>By September 2019, it had validated <a href=\"https:\/\/www.recursosyenergia.gob.ec\/el-catastro-minero-esta-depurado-en-un-75\/\">more than 4,000 cases<\/a>, which were matched with operations in the national registry of legal mining concessions. Some 75% of these legal concessions figured in these cases.<\/p>\n<p>While artisanal and illegal mining is of concern to activists, given its indiscriminate use of mercury, there is a greater focus on open-pit mining, which has a more significant impact on the environment and the social dynamics of surrounding communities. As of last July, large-scale mining occupied an area of <a href=\"https:\/\/contenido.bce.fin.ec\/documentos\/Estadisticas\/Hidrocarburos\/ReporteMinero072021.pdf\">104,000 hectares<\/a> in Ecuador \u2013 three times the area of the capital Quito \u2013 spread over seven provinces.<\/p>\n<p>Minister Vera has said that the country will not be affected economically by the year-long moratorium on mining, much less its oil production on which a large part of the state budget depends. But Katherine Navia, an expert in macroeconomics and professor at the Argos Institute in Guayaquil, sees a bleak outlook during the temporary closure.<\/p>\n<p>\u201cThis brings with it losses in jobs, new technologies, knowledge, international trade openness, and all of this results in a decrease in income tax collection,\u201d Navia told Di\u00e1logo Chino, noting that since 2008, investors have turned to starting operations in Peru and Chile.<\/p>\n<blockquote><p>The moratorium brings with it losses in jobs, new technologies, knowledge, international trade openness, and a decrease in income tax collection<\/p><\/blockquote>\n<p>She hopes that the fine print of the agreement will be finalised, ideally before the end of the year, so that the country will have clear legislation on the extraction of natural resources to create a climate of confidence for foreign investors.<\/p>\n<p>The specialist did acknowledge the complexity of the debate, which is perhaps most profound in the oil sector, because it deals with an additional component to the expansion of the extractive frontier: the lives of uncontacted communities.<\/p>\n<p>Cristina Melo, the advisor to Fundaci\u00f3n Pachamama, hopes that with the agreement reached, the future of each of the installations that are in full operation in the Ecuadorian jungle will be re-evaluated, as communities are also feeling the impacts on local flora and fauna.<\/p>\n<figure id=\"attachment_52122\" aria-describedby=\"caption-attachment-52122\" style=\"width: 350px\" class=\"wp-caption alignright\"><a href=\"https:\/\/dialogue.earth\/en\/extractive-industries\/52121-ecuadors-yasuni-national-park-between-oil-exploitation-and-conservation\/\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-52122\" src=\"https:\/\/dialogue.earth\/content\/uploads\/2022\/03\/Yasuni\u0301-ITT-Ecuador-oil-scaled.jpg\" alt=\"truck carries oil across a bridge over a river\" width=\"350\" height=\"233\" \/><\/a><figcaption id=\"caption-attachment-52122\" class=\"wp-caption-text\"><strong>Read more: <a href=\"https:\/\/dialogue.earth\/en\/extractive-industries\/52121-ecuadors-yasuni-national-park-between-oil-exploitation-and-conservation\/\">Yasun\u00ed National Park: between oil exploitation and conservation<\/a><\/strong><\/figcaption><\/figure>\n<p>\u201cThere are no exact figures, but extractive activity has expanded in territories of the Tagaeri and Taromenane \u2018untouchable\u2019 zone [home to peoples in <a href=\"https:\/\/www.fundacionlabaka.org\/index.php\/proyectos\/pueblos\/53-pueblos-en-aislamiento-voluntario#:~:text=En%20la%20regi%C3%B3n%20amaz%C3%B3nica%20ecuatoriana,Tagaeri%2DTaromenane%20(ZITT).\">voluntary isolation<\/a>] and there are wells in Yasun\u00ed, one of the most biodiverse areas in the world. Exploitation has even begun in the Ishpingo Norte and Tambococha blocks, in the areas of these peoples and the environmental buffer zones of Yasun\u00ed,\u201d she said. \u201cThese are some of the projects that will have to be re-evaluated by the government.\u201d<\/p>\n<p>Oil activity involves the installation of camps, platforms and wells, as well as flares that may be lit around the clock, which all generate noise. And with the arrival of oil exploration and extraction, other problems can arise, such as deforestation, hunting of wild animals, social conflicts, and disease among uncontacted peoples, <a href=\"https:\/\/www.inredh.org\/archivos\/documentos_ambiental\/impactos_explotacion_petrolera_esp.pdf\">studies<\/a> have highlighted.<\/p>\n<p>Indigenous organisations hope that the prospective drafting of a law guaranteeing prior consultation with the communities will be the turning point they had hoped for. There is also hope that the state will make concerted efforts to change <a href=\"https:\/\/dialogue.earth\/en\/climate-energy\/54913-ecuadors-energy-investment-drive-targets-renewables-and-fossil-fuels\/\">the country\u2019s energy mix<\/a> and productive industries, with a greater emphasis on clean energy and sustainable projects in natural areas \u2013 and in a way that allows communities to maintain their way of life, their customs and their
