{"id":50059663,"date":"2022-10-19T19:18:26","date_gmt":"2022-10-19T18:18:26","guid":{"rendered":"https:\/\/stage.dialogochino.net\/?p=59663"},"modified":"2023-08-25T20:40:25","modified_gmt":"2023-08-25T19:40:25","slug":"59663-panama-china-fta-plays-us-talks","status":"publish","type":"post","link":"https:\/\/dialogue.earth\/en\/business\/59663-panama-china-fta-plays-us-talks\/","title":{"rendered":"Panama plays US off against China in FTA talks, but has limited hand"},"content":{"rendered":"<p>In April 2019, Panamanian trade representatives met their Chinese counterparts in Beijing for what was billed as the fifth and final round of negotiations towards a free trade agreement (FTA) between the two countries. Following a whirlwind diplomatic romance \u2013 which began when former president Juan Carlos Varela cut ties with Taipei in favour of Beijing in 2017, and culminated in Xi Jinping\u2019s visit to Panama a year later \u2013 the trade deal was seen as an important milestone for Panama\u2019s shifting economic and foreign policy.<\/p>\n<figure id=\"attachment_34485\" aria-describedby=\"caption-attachment-34485\" style=\"width: 350px\" class=\"wp-caption alignright\"><a href=\"https:\/\/dialogue.earth\/en\/trade-investment\/34472-has-chinas-winning-streak-in-panama-ended\/\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-34485\" src=\"https:\/\/dialogue.earth\/content\/uploads\/2020\/03\/R6334T.jpg\" alt=\"Juan Carlos Varela and Xi Jinping greeting each other, with Panamanian and Chinese flags on either side.\" width=\"350\" height=\"233\" \/><\/a><figcaption id=\"caption-attachment-34485\" class=\"wp-caption-text\"><strong>Read more: <a href=\"https:\/\/dialogue.earth\/en\/trade-investment\/34472-has-chinas-winning-streak-in-panama-ended\/\">Has China\u2019s winning streak in Panama ended?<\/a><\/strong><\/figcaption><\/figure>\n<p>Three months later, the deal <a href=\"https:\/\/dialogue.earth\/en\/trade-investment\/34472-has-chinas-winning-streak-in-panama-ended\/\">appeared to be dead<\/a>. A new president, Laurentino \u201cNito\u201d Cortizo, paused talks and said that his government would revise the content of the negotiations, \u201cin detail and with caution\u201d. However, while in Los Angeles for this year\u2019s <a href=\"https:\/\/dialogue.earth\/en\/climate-energy\/54589-summit-of-the-americas-climate-agenda-tensions-dominate\/\">Summit of the Americas<\/a>, Cortizo told media that FTA talks with China were set to resume.<\/p>\n<p>\u201cWe are going to restart this negotiation with China,\u201d he told <a href=\"https:\/\/www.youtube.com\/watch?v=aJAlrtxYvaU\">France 24<\/a>. \u201cThis process has to realign more towards the agricultural sector from Panama\u2019s point of view\u2026 Even though we\u2019re a small country we have been able to negotiate [one-on-one] with major powers like the United States, and we\u2019ll do the same with China.\u201d<\/p>\n<p>What provoked Cortizo\u2019s sudden change of heart? Local experts and analysts believe the decision was motivated by frustration at the US\u2019 own inflexible trade policy. After winning presidential elections in July 2019, Cortizo aligned his foreign policy back towards the US, a traditional ally. Chinese investment plans, including a US$4 billion high-speed railway, were <a href=\"https:\/\/dialogue.earth\/en\/trade-investment\/34472-has-chinas-winning-streak-in-panama-ended\/\">put on ice<\/a> and Chinese companies lost out on key infrastructure tenders. Meanwhile, in November 2021, the Panama Canal Authority <a href=\"https:\/\/www.seatrade-maritime.com\/ports-logistics\/panama-canal-contracts-us-army-corps-water-projects-programme\">signed a contract<\/a> with the US Army Corps of Engineers for consulting and advisory services on a future $2 billion infrastructure project to ensure adequate water supply to the canal.<\/p>\n<blockquote><p>Even though we\u2019re a small country we have been able to negotiate with major powers like the US, and we\u2019ll do the same with China<\/p><\/blockquote>\n<p>But the limits of Washington\u2019s goodwill became clear in March this year, when the US embassy\u2019s charg\u00e9 d&#8217;affaires in Panama (the ambassador\u2019s post has been vacant since 2018) said it would not meet the nation\u2019s demands to revise its FTA with the US.<\/p>\n<p>The Panama\u2013United States Trade Promotion Agreement, an FTA which entered into force in 2012, allowed the Central American country to maintain import tariffs on a number of agricultural products, including rice, dairy, chicken and beef, in order to protect local producers from cheaper American imports. As per the original deal, those tariffs are to be gradually phased out, starting this year, but local producers have not managed to improve their competitiveness. Panamanian officials have therefore made <a href=\"https:\/\/www.plenglish.com\/news\/2022\/09\/17\/panama-accelerates-steps-to-review-trade-agreement-with-the-u-s\/\">repeated calls<\/a> over the last year to review the terms of the agreement.<\/p>\n<p>In the same interview with France 24, Cortizo said the FTA was \u201cextremely favourable\u201d to the US. The timing of the announcement of the resumption of talks with China is likely to be a measure to pressure the US into compromise over the tariffs, according to Euclides Tapia, professor of international relations at the University of Panama.<\/p>\n<p>\u201cWhile the Panamanian government is making an absurd demand of the US, in parallel they announce, as a form of pressure, the reactivation of commercial negotiations with China,\u201d he said. \u201cI don\u2019t think it\u2019s a coincidence.\u201d<\/p>\n<h2>Panama &#8211; China FTA: limits to negotiation tactic<\/h2>\n<p>Cortizo\u2019s gambit is unlikely to succeed. Given the US\u2019 formidable farming export industry and the vulnerability of Latin American smallholder farmers, agricultural tariffs have been the most politically sensitive issue in the US\u2019 trade deals in the region and beyond. A renegotiation of terms would set a precedent and likely lead to similar requests from the US\u2019 19 other free trade partners.<\/p>\n<figure id=\"attachment_55733\" aria-describedby=\"caption-attachment-55733\" style=\"width: 350px\" class=\"wp-caption alignright\"><a href=\"https:\/\/dialogue.earth\/en\/uncategorised\/55672-peru-china-trade-ambassador-fta-becoming-obsolete\/\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-55733\" src=\"https:\/\/dialogue.earth\/content\/uploads\/2022\/06\/Embajador_Luis_Quesada-1-1440x720-1.jpg\" alt=\"luis quesada, Peru's ambassador to China, speaking in front of a microphone.\" width=\"350\" height=\"175\" \/><\/a><figcaption id=\"caption-attachment-55733\" class=\"wp-caption-text\"><strong>Read more: <a href=\"https:\/\/dialogue.earth\/en\/uncategorised\/55672-peru-china-trade-ambassador-fta-becoming-obsolete\/\">Peru\u2019s ambassador to China: \u201cThe FTA with China is becoming obsolete\u201d<\/a><\/strong><\/figcaption><\/figure>\n<p>\u201cI don\u2019t think the Cortizo government is reading the tea leaves effectively,\u201d says Eric Farnsworth, vice president of the Council of the Americas, a US-based think tank. \u201cI don\u2019t think anyone in Washington has any interest in reopening the Panama FTA. To do so would mean Peru and Colombia lining up for the same, then Morocco and Jordan.\u201d<\/p>\n<p>The recently elected left-wing president of Colombia, <a href=\"https:\/\/dialogue.earth\/en\/climate-energy\/57077-petro-colombia-president-environmental-ambitions\/\">Gustavo Petro<\/a>, has frequently stated he would look to review the country\u2019s existing trade deal with the US. Between its signature in 2012 and 2019, the value of US poultry exports to Colombia increased from $27 million to nearly $102 million, while corn exports increased from around $86 million to $685 million, according to <a href=\"https:\/\/www.ers.usda.gov\/webdocs\/outlooks\/102838\/aes-118-01.pdf?v=4145.8\">US Department of Agriculture<\/a> figures. Colombian <em>campesinos<\/em>, however, feel similarly unable to compete, with the FTA a point of contention and target of multiple protests in the past decade, including in <a href=\"https:\/\/peoplesdispatch.org\/2021\/05\/14\/colombians-continue-to-resist-as-national-strike-completes-15-days\/\">2021<\/a>, in <a href=\"https:\/\/justiceforcolombia.org\/news\/cut-colombia-7-reasons-to-explain-the-national-strike-in-colombia\/\">2019<\/a>, and a nationwide agrarian strike in <a href=\"https:\/\/www.bilaterals.org\/?colombia-nationwide-strike-against\">August 2013<\/a>.<\/p>\n<p>Panama experienced <a href=\"https:\/\/www.ft.com\/content\/951be09d-5a22-4de7-8c44-8fe11deb5cd6\">similar protests<\/a> in July 2022, this time motivated by rising living costs and widespread corruption. With an approval rating hovering around <a href=\"https:\/\/www.bloomberglinea.com\/2022\/07\/26\/giammattei-y-cortizo-mas-impopulares-que-maduro-en-encuesta-cid-gallup\/\">21%<\/a>, Cortizo, who hails from a cattle-ranching background, can ill afford to lose the support of farmers. But the apparently misguided use of trade policy to gain concessions shows the limits to which smaller Latin American nations can play the US and China against each other.<\/p>\n<p>Varela\u2019s courtship of China created significant diplomatic blowback. \u201cFrom a US perspective, Varela went too far, too fast,\u201d said Farnsworth. \u201cHe got a lot of negative attention, a lot of pushback in Washington.\u201d<\/p>\n<p>In 2018, during the Varela administration, it was reported that former US diplomats had admitted <a href=\"https:\/\/www.theguardian.com\/world\/2018\/nov\/28\/panama-china-us-latin-america-canal\">pressuring<\/a> the Panamanian government not to permit the construction of a Chinese embassy at the entrance of the Panama Canal. But it is unclear what further incentives or pressures the US government brought to bear on Cortizo to convince him to cool the relationship with China.<\/p>\n<blockquote><p>I don\u2019t think anyone in Washington has any interest in reopening the Panama FTA. To do so would mean Peru and Colombia lining up for the same<\/p><\/blockquote>\n<p>The US has sought to push back against Chinese investment and involvement elsewhere in the region. In Chile, for example, it emerged that US diplomats had <a href=\"https:\/\/www.bloomberg.com\/opinion\/articles\/2022-08-30\/must-the-us-kiss-latin-america-goodbye?utm_source=substack&amp;utm_medium=email#xj4y7vzkg\">threatened<\/a> to remove the country\u2019s US visa waiver program should they allow Chinese telecom firm Huawei to construct a proposed trans-Pacific cable project.<\/p>\n<p>It remains to be seen for how much longer such pressure will be enough from a US perspective. In recent years, China has become the largest trading partner of Brazil, Chile, Peru and Uruguay, and the latter recently ignored the protests of its Mercosur partners to <a href=\"https:\/\/dialogue.earth\/en\/uncategorised\/56817-uruguay-china-fta-negotiations-tensions-over-mercosur-future\/\">initiate FTA talks with China<\/a>. A Chinese trade agreement in Panama, one of the US\u2019 most staunch allies in the region and a geopolitically strategic node as a result of its Canal, would be a symbolic milestone.<\/p>\n<p>It would also highlight the lack of a clear US trade agenda in the hemisphere, according to Farnsworth. He believes Panama should instead look to incorporate itself into the United States-Mexico-Canada Agreement (USMCA).<\/p>\n<p>\u201cPanama would be a terrific partner, and its services-based economy could really benefit,\u201d he said. \u201cI think they\u2019re shooting the wrong target. You know, instead of looking at the past, let\u2019s look in the future. Let\u2019s figure out a way to link Panama more meaningfully into the North American economy.\u201d<\/p>\n<p>Panama\u2019s Ministry of Trade and the US Embassy in Panama did not respond to requests
