{"id":60015973,"date":"2024-04-30T13:34:24","date_gmt":"2024-04-30T12:34:24","guid":{"rendered":"https:\/\/dialogue.earth\/?p=60015973"},"modified":"2024-05-03T14:57:45","modified_gmt":"2024-05-03T13:57:45","slug":"as-elections-near-whats-next-for-panamas-closed-copper-mine","status":"publish","type":"post","link":"https:\/\/dialogue.earth\/en\/business\/as-elections-near-whats-next-for-panamas-closed-copper-mine\/","title":{"rendered":"As elections near, what\u2019s next for Panama\u2019s closed copper mine?"},"content":{"rendered":"\n<p class=\"has-drop-cap\">Panama will hold its presidential elections on 5 May, months after huge protests saw thousands descend on the country\u2019s streets and ultimately help to force the <a href=\"https:\/\/www.reuters.com\/markets\/commodities\/top-panama-court-rules-first-quantum-mining-contract-unconstitutional-2023-11-28\/\">closure<\/a> of Central America\u2019s largest copper mine.<\/p>\n\n\n\n<p>The issue has featured in debates among the leading candidates: centre-right frontrunner and former minister Jos\u00e9 Ra\u00fal Mulino; former president Mart\u00edn Torrijos (2004-2009); former foreign secretary R\u00f3mulo Roux; and lawyer and independent Ricardo Lombana. Some commentators have <a href=\"https:\/\/youtu.be\/kD-9ye_6EwQ?t=3242\">dubbed<\/a> the Cobre Panam\u00e1 mine as \u201canother candidate\u201d in the elections, such is its economic and political importance for the country.<\/p>\n\n\n\n<p>Since the government\u2019s historic ruling in November to shutter the mine, it has been estimated that closure could take more than nine years and cost approximately <a href=\"https:\/\/www.reuters.com\/markets\/commodities\/closure-first-quantums-panama-mine-seen-around-800-mln-minister-says-2024-03-06\/\">USD 800 million<\/a>. Questions have been raised over the impact the decision will have for Panama\u2019s economy, having turned its back on an activity that represented 3% of its GDP, Panamanian economist Felipe Argote told Dialogue Earth. Estimates from <a href=\"https:\/\/www.first-quantum.com\/English\/announcements\/announcements-details\/2023\/First-Quantum-Provides-Update-on-Cobre-Panama-Operations\/default.aspx\">First Quantum<\/a>, the Canadian company that has owned the mine since 2013, put this figure as high as 5%.<\/p>\n\n\n\n<p>Others warn about the actions that must be taken to prevent further environmental damage after the closure, given previous experiences at the country\u2019s Remance, Santa Rosa and Molej\u00f3n gold mines. Most have pledged to respect the <a href=\"https:\/\/www.reuters.com\/markets\/commodities\/panama-congress-bans-new-mining-concessions-amid-protests-2023-11-03\/\">ban on new mining concessions<\/a> that was enacted in November in response to the wave of protests, which broke out after the government had initially approved a new contract with First Quantum. Only two candidates \u2013 current vice-president Jos\u00e9 Gabriel Carrizo, of the ruling Democratic Revolutionary Party, and the independent candidate Melit\u00f3n Arrocha \u2013 left the door open for a potential popular vote to decide whether the ban on mining should be upheld.<\/p>\n\n\n\n<p>As polling day nears, Dialogue Earth takes a closer look at the background of the Cobre Panam\u00e1 mine, the possible consequences of its closure and the road ahead.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-what-happened-to-the-mine-the-environmental-context\">What happened to the mine? The environmental context<\/h2>\n\n\n\n<p>The Cobre Panam\u00e1 mine is located in the central province of Col\u00f3n, 120 km west of Panama City, and at the heart of the Mesoamerican Biological Corridor, a migratory bridge for hundreds of species that stretches from Colombia to Mexico. In 2023, 330,863 tonnes of copper were extracted at the mine, <a href=\"https:\/\/www.first-quantum.com\/Spanish\/nuestras-operaciones\/proyectos-activos\/cobre-panama\/estadisticas-de-produccion\/default.aspx\">First Quantum<\/a> reports.<\/p>\n\n\n\n<p>Concerns over the environmental impacts of the mine, which had been in operation since 2019, were one of the key issues that led to last year\u2019s protests.<\/p>\n\n\n\n<p>In 2021, local newspaper La Prensa <a href=\"https:\/\/www.prensa.com\/impresa\/panorama\/mina-de-cobre-causo-209-danos-ambientales\/\">published<\/a> an investigation in which it alleged 209 breaches of the obligations established in the mine\u2019s environmental impact study by First Quantum\u2019s local subsidiary, Minera Panam\u00e1. The company reportedly neglected mitigation measures, affecting water sources in an area crossed by several rivers. In at least two of them, the Caimito and Botija rivers, authorities <a href=\"https:\/\/www.prensa-latina.cu\/2024\/01\/09\/denuncian-delitos-ambientales-de-minera-panama-sin-esclarecer\/\">recorded<\/a> impacts on aquatic life.<\/p>\n\n\n\n<div class=\"wp-block-cd-article-image aligncenter block--article-image block--article-image--article\" itemscope itemtype=\"http:\/\/schema.org\/ImageObject\"><div class=\"block--article-image__column\"><div class=\"hide-expand block--article-image__image\"><img class=\"lazy\" data-src=\"https:\/\/dialogue.earth\/content\/uploads\/2024\/04\/20240429_copper-mine-Panama_map_EN.jpg\" data-srcset=\"https:\/\/dialogue.earth\/content\/uploads\/2024\/04\/20240429_copper-mine-Panama_map_EN-768x819.jpg 768w, https:\/\/dialogue.earth\/content\/uploads\/2024\/04\/20240429_copper-mine-Panama_map_EN-960x1024.jpg 1024w, https:\/\/dialogue.earth\/content\/uploads\/2024\/04\/20240429_copper-mine-Panama_map_EN.jpg 2400w\" data-sizes=\"(max-width: 600px) 768px, (max-width: 1024px) 1024px, 2400px\" alt=\"\"\/><\/div><div class=\"block--article-image__content\"><div itemprop=\"caption\" class=\"block--article-image__caption\">(Data source: <a href=\"https:\/\/docplayer.es\/19566545-Estudio-de-impacto-ambiental-y-social-proyecto-mina-de-cobre-panama-setiembre-2010.html\">Minera Panam\u00e1<\/a>, Map: Dialogue Earth)<\/div><\/div><\/div><meta itemprop=\"contentUrl\" content=\"https:\/\/dialogue.earth\/content\/uploads\/2024\/04\/20240429_copper-mine-Panama_map_EN.jpg\"\/><meta itemprop=\"contentSize\" content=\"2 MB\"\/><meta itemprop=\"height\" content=\"2560\"\/><meta itemprop=\"width\" content=\"2400\"\/><meta itemprop=\"author\"\/><meta itemprop=\"representativeOfPage\" content=\"true\"\/><\/div>\n\n\n\n<p>The company itself acknowledged impacts on over 3,000 hectares in the area due to \u201cmining activities\u201d, although it <a href=\"https:\/\/www.first-quantum.com\/English\/announcements\/announcements-details\/2023\/First-Quantum-Provides-Update-on-Cobre-Panama-Operations\/default.aspx\">claims<\/a> to have reforested 4,200 hectares as part of its mitigation plans. But Joana \u00c1brego, legal manager of the Environmental Advocacy Centre Panama (CIAM), a local NGO, told Dialogue Earth that the project\u2019s footprint could be as large as 20,000 hectares, if facilities that service the mine such as the Punta Rinc\u00f3n port, among others, are included in its area of influence.<\/p>\n\n\n\n<p>On 20 October 2023, despite public discontent over the environmental impact of the mine and following weeks of political debates, President Laurentino Cortizo signed into law the contract that would have permitted the mining company to exploit the copper for a further 20 years. This proved to be the trigger for widespread protests, during which many of the country\u2019s major roads and ports such as Punta Rinc\u00f3n were <a href=\"https:\/\/www.reuters.com\/markets\/commodities\/panama-port-blockade-keeps-supplies-first-quantum-mine-company-says-2023-11-17\/\">blockaded<\/a>.<\/p>\n\n\n\n<p>After weeks of demonstrations, in November Panama\u2019s Supreme Court <a href=\"https:\/\/www.theguardian.com\/world\/2023\/nov\/28\/panama-supreme-court-canadian-copper-mine-unconstitutional\">ruled<\/a> that the contract award had violated the country\u2019s constitution, including articles regulating the procedure for approving public contracts. In addition, excessive benefits were said to have been granted to the contractor and were contrary to environmental legislation \u2013 in other words, that the interests of the state had been subordinated to those of the mining company. Soon after, First Quantum <a href=\"https:\/\/www.first-quantum.com\/English\/announcements\/announcements-details\/2023\/First-Quantum-Comments-on-Developments-in-Panama\/default.aspx\">announced<\/a> its intention to dispute the decision in international courts.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-a-complicated-exit\">A complicated exit<\/h2>\n\n\n\n<p>Both First Quantum and the authorities have said the closure of the mine will present numerous challenges. A <a href=\"https:\/\/pdf.ac\/3uv3M1\">report<\/a> published by the company in February noted that Panama would be \u201cthe first country in the world to implement a sudden closure of a mine of this magnitude\u201d, and that the process could take over a decade. The company reports that maintenance of the shuttered mine is currently costing it between USD 15 million and USD 20 million each month, and that some 1,400 workers are involved in activities to stabilise the site.<\/p>\n\n\n\n<p>Looking forward, \u00c1brego is concerned over the risks posed by the pit where mining has taken place, and that as long as it remains open and exposed to the elements, it is in an \u201cecologically sensitive area\u201d, with rivers and groundwater sources that could be affected. Another danger she highlights is possible seepage of material from the mine\u2019s tailings ponds, similar to cases reported following the closure of the Santa Rosa and <a href=\"https:\/\/www.laestrella.com.pa\/panama\/nacional\/aguas-tinas-vierte-relave-petaquilla-HPLE51687\">Molej\u00f3n<\/a> gold mines.<\/p>\n\n\n\n<a class=\"wp-block-cd-related-news alignright block--related-news loading\" data-post-id=\"50053970\"><div class=\"block--related-news__image\"><\/div><div class=\"block--related-news__content\"><span class=\"block--related-news__heading\">Recommended<\/span><span class=\"block--related-news__title\"><\/span><\/div><\/a>\n\n\n\n<p>One of First Quantum\u2019s proposals to finance the safeguarding plan is to <a href=\"https:\/\/www.reuters.com\/markets\/commodities\/first-quantum-says-probability-taking-out-copper-panama-mine-only-after-election-2024-04-24\/\">sell 121,000 tonnes of copper concentrate<\/a> that is currently in storage in the country. This is material that has already been extracted and whose prolonged storage on site has been highlighted as a risk to the environment due to <a href=\"https:\/\/www.prensa.com\/economia\/minera-panama-alerta-de-gases-peligrosos-en-el-concentrado-de-cobre-almacenado\/\">contamination<\/a> by \u201cdangerous gases\u201d. Executives from the company have reportedly <a href=\"https:\/\/www.reuters.com\/markets\/commodities\/first-quantum-execs-discuss-investment-disputed-copper-with-chinese-officials-2024-03-27\/\">discussed<\/a> the sale of the copper to Chinese company Jiangxi Copper, which owns an 18% stake in the Canadian firm.<\/p>\n\n\n\n<p>First Quantum\u2019s report warned that an extended shutdown would put its ability to meet its \u201cfinancial covenants\u201d in jeopardy. The situation is complicated further by the international arbitrations <a href=\"https:\/\/www.reuters.com\/markets\/commodities\/first-quantum-starts-international-arbitration-cobre-panama-mine-2023-12-01\/\">launched<\/a> by the transnational firm and its partners against Panama.<\/p>\n\n\n\n<p>One possible way out, according to Argote, could be for the state to acquire control of shares in the mine in exchange for desisting from any legal action. The creation of a \u201cmixed company\u201d had already been contemplated in a 1967 cabinet decree, which established a \u201cspecial regime\u201d for the area occupied by the current concession. It is an option that could put an end to questions about possible infringements of Panama\u2019s sovereignty in relation to the mine, a concern raised by protesters and the supreme court\u2019s ruling.<\/p>\n\n\n\n<p>However, Harley Mitchell Moran, a Panamanian lawyer who has worked on cases against companies for environmental breaches, said that reaching an agreement would only be possible \u201cas long as it is lawful, public and considers the national interests at stake, such as a healthy environment.\u201d<\/p>\n\n\n\n<p>Dialogue Earth requested an interview with a representative of Minera Panam\u00e1, but no response was received. The Ministry of Commerce and Industry, one of the entities in charge of overseeing the Cobre Panam\u00e1 mine\u2019s management, was also approached for comment, but at the time of press no response had been received.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-economy-faces-mining-hangover\">Economy faces mining hangover<\/h2>\n\n\n\n<p>With investments of USD 10 billion made over a decade, 7,000 employees currently suspended, and the mine\u2019s output accounting for over 75% of Panama\u2019s exports, the numbers around Cobre Panam\u00e1 and its closure are presenting serious headaches for decision-makers and business figures.<\/p>\n\n\n\n<p>However, since the <a href=\"https:\/\/www.presidencia.gob.pa\/Noticias\/Presidente-Cortizo-Cohen-sanciona-Ley-de-Moratoria-de-mineria-en-el-pais-#:~:text=407%2520de%25203%2520de%2520noviembre,nacional%25E2%2580%259D%2520%25E2%2580%2593%2520Ley%2520de%2520Moratoria.\">banning<\/a> of mining concessions in November, both environmentalists and economists have pointed towards the potential for alternative, non-extractive industries, which they say can create deeper roots in the country.<\/p>\n\n\n\n<div class=\"wp-block-cd-article-image aligncenter block--article-image block--article-image--article\" itemscope itemtype=\"http:\/\/schema.org\/ImageObject\"><div class=\"block--article-image__column\"><div class=\"hide-expand block--article-image__image\"><img class=\"lazy\" data-src=\"https:\/\/dialogue.earth\/content\/uploads\/2024\/04\/Dolphin-Bay-on-Isla-San-Cristobal_Alamy_2WPF9MW-2.jpg\" data-srcset=\"https:\/\/dialogue.earth\/content\/uploads\/2024\/04\/Dolphin-Bay-on-Isla-San-Cristobal_Alamy_2WPF9MW-2-768x512.jpg 768w, https:\/\/dialogue.earth\/content\/uploads\/2024\/04\/Dolphin-Bay-on-Isla-San-Cristobal_Alamy_2WPF9MW-2-1024x682.jpg 1024w, https:\/\/dialogue.earth\/content\/uploads\/2024\/04\/Dolphin-Bay-on-Isla-San-Cristobal_Alamy_2WPF9MW-2.jpg 2560w\" data-sizes=\"(max-width: 600px) 768px, (max-width: 1024px) 1024px, 2560px\" alt=\"wooden cabins on stilts in dark water\"\/><\/div><div class=\"block--article-image__content\"><div itemprop=\"caption\" class=\"block--article-image__caption\">Wooden chalets at San Cristobal island, Panama. Low-impact eco-tourism could present another option: last year alone, the tourism industry reportedly <a href=\"https:\/\/www.laestrella.com.pa\/economia\/promtur-panama-reporta-impacto-economico-AELE497373\">generated<\/a> more than USD 900 million in revenue for the country.<\/p>\n\n\n\n<p>Despite the hit to the Panamanian economy from the mine\u2019s closure, the country\u2019s GDP is still <a href=\"https:\/\/www.swissinfo.ch\/spa\/el-pib-de-panam%25C3%25A1-crecer%25C3%25A1-2,5-%2525-en-2024-afectado-por-fuerte-desaceleraci%25C3%25B3n,-seg%25C3%25BAn-moody's\/74290876#:~:text=SWI%2520swissinfo.ch-,El%2520PIB%2520de%2520Panam%25C3%25A1%2520crecer%25C3%25A1%25202%252C5%2520%2525%2520en%25202024%2520afectado,por%2520fuerte%2520desaceleraci%25C3%25B3n%252C%2520seg%25C3%25BAn%2520Moody's\">expected<\/a> to grow by more than 2% this year, which would make it one of the <a href=\"https:\/\/www.bloomberglinea.com\/2024\/04\/04\/el-ruido-politico-de-latam-no-incidiria-tanto-en-el-mercado-es-lo-que-preve-citigroup-para-la-region\/?source=piano-newsletter-la&amp;pnespid=uKE_DXoZJK9Bg_be_zvkC5KGpkmwRsp1NOW.2bJ1qRlmtK9TB87bI52.SZQrAccjy6l4uQzPcA\">strongest markets<\/a> in the region.<\/p>\n\n\n\n<p>On the export side, following the halt in shipments from the Punta Rinc\u00f3n port last November, bananas replaced copper as Panama\u2019s main export, according to <a href=\"https:\/\/intelcom.gob.pa\/informe\/resumen-estadistico-del-desempeno-de-las-exportaciones-de-bienes-de-panama-en-febrero-2024\">data<\/a> for the first two months of the year from the Ministry of Commerce and Industry. China, which was the main destination for copper, <a href=\"https:\/\/intelcom.gob.pa\/informe\/resumen-estadistico-del-desempeno-de-las-exportaciones-de-bienes-de-panama-en-febrero-2024\">moved<\/a> from first to ninth place among the top export partners.<\/p>\n\n\n\n<div class=\"wp-block-cd-pull-quote block--pull-quote\"><div class=\"block--pull-quote__wrapper\"><blockquote class=\"block--pull-quote__quote\">There can be no \u2018clean\u2019 energy with materials that affect species and human life<\/blockquote><cite class=\"block--pull-quote__cite\">Joana \u00c1brego, legal manager of the Environmental Advocacy Centre Panama<\/cite><\/div><\/div>\n\n\n\n<p>Copper supplies a global market in transition to green energy, a growing <a href=\"https:\/\/globalamericans.org\/explaining-and-predicting-how-the-u-s-could-help-bolster-chiles-role-in-the-critical-mineral-supply-chain\/\">business<\/a> in the region. In the global supply chain of the strategic minerals needed to decarbonise economies, Panama is currently something of a missing link. But, \u00c1brego warns: \u201cThere can be no \u2018clean\u2019 energy with materials that affect species and human life.\u201d<\/p>\n\n\n\n<p>The closure of the mine, as a result of protests in which young people took centre stage, represents an opportunity to restore the \u201cviolated legal order\u201d and to finally respect environmental norms, Mitchell Moran says.<\/p>\n\n\n\n<p>Should the next president-elect and government decide that the mining industry does have a future in Panama, they will not have it easy: it will no longer just be a matter of promoting, negotiating, and approving new contracts \u2013 they will first have to convince a new generation that their administration is environmentally conscious and concerned about respecting the rule of law.<\/p>\n\n\n\n<p>Panama\u2019s general election will be held this Sunday, 5 May, with <a href=\"https:\/\/www.as-coa.org\/articles\/poll-tracker-panamas-2024-presidential-election\">recent polls<\/a> putting Jos\u00e9 Ra\u00fal Mulino in the lead. However, several public figures are <a href=\"https:\/\/www.eldiario.es\/politica\/tension-panama-semanas-comicios-generales_1_11316954.html\">calling on<\/a> the country\u2019s supreme court to issue a ruling on his candidacy ahead of the vote. Mulino was a late replacement for former president Ricardo Martinelli (2009-2014) \u2013 disqualified from running in March due to a <a href=\"https:\/\/www.reuters.com\/world\/americas\/panama-court-finds-former-president-martinelli-guilty-money-laundering-2023-07-18\/\">conviction<\/a> in 2023 for money laundering \u2013 and some have suggested his promotion from vice-presidential to presidential candidate was unconstitutional.<\/p>\n\n\n\n<p>As for First Quantum, the company has <a href=\"https:\/\/www.reuters.com\/markets\/commodities\/first-quantum-says-probability-taking-out-copper-panama-mine-only-after-election-2024-04-24\/\">said<\/a> it will likely not be able to export its stored copper concentrate from the country until after the election is decided; its prospects of mining in the country again are seen as <a href=\"https:\/\/www.reuters.com\/markets\/commodities\/panama-election-unlikely-shift-outlook-first-quantums-copper-mine-2024-04-18\/\">unlikely<\/a>, whatever the
