{"id":60041376,"date":"2024-07-11T13:48:41","date_gmt":"2024-07-11T12:48:41","guid":{"rendered":"https:\/\/dialogue.earth\/?p=60041376"},"modified":"2024-07-15T22:46:27","modified_gmt":"2024-07-15T21:46:27","slug":"in-peru-locals-harbour-doubts-over-a-new-port","status":"publish","type":"post","link":"https:\/\/dialogue.earth\/en\/business\/in-peru-locals-harbour-doubts-over-a-new-port\/","title":{"rendered":"In Peru, locals harbour doubts over a new port"},"content":{"rendered":"\n<p>\u201cWhen there is wind, everything goes black,\u201d says Washington Espinoza, an artisanal fisher from San Juan de Marcona in southern Peru, the coastal town that is the country\u2019s leading iron producer. \u201cWhen there is wind, all the metal goes into the sea, and it is affecting marine life.\u201d<\/p>\n\n\n\n<p>Espinoza is describing the impacts of mining activity currently underway in the area. But he also expresses concern about new plans that may further threaten its already fragile ecosystem.<\/p>\n\n\n\n<p>Earlier this year, it was announced that the southern Peruvian district of Marcona, of which Espinoza\u2019s town is the capital, is set to become a new hub for mining activity in Peru, driven by the construction of what will be the country\u2019s third largest port, behind the central hub of Callao and the soon-to-open <a href=\"https:\/\/dialogue.earth\/en\/business\/382806-perus-megaport-reshapes-pacific-trade-and-the-town-next-door\/\">Chancay<\/a>. The San Juan de Marcona Port Terminal will be run by a subsidiary of the Chinese company Jinzhao Mining and could potentially unlock mining investments of more than <a href=\"https:\/\/www.gob.pe\/institucion\/proinversion\/noticias\/921786-nuevo-puerto-de-marcona-impulsaria-inversiones-por-mas-de-us-15-mil-millones-en-el-sur-del-pais\">USD 15 billion<\/a>.<\/p>\n\n\n\n<p>However, in a region where distrust of mining projects is common and Chinese investors have <a href=\"https:\/\/www.business-humanrights.org\/es\/%C3%BAltimas-noticias\/per%C3%BA-ong-denuncian-presuntas-violaciones-de-derechos-humanos-por-shougang-group-zijin-y-otras-empresas-chinas\/\">struggled<\/a> to win local support, the project has been met with scepticism among many residents and NGOs, with some raising concerns over its potential impacts on local environments and people.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-a-new-mega-port\">A new mega-port<\/h2>\n\n\n\n<p>Marcona is a fishing village some 530 kilometres south of Peru\u2019s capital, Lima. Alongside its iron ore reserves, it is home to two protected natural areas: the San Fernando and Punta San Juan national reserves. Both offer refuge to the world\u2019s largest colony of the threatened Humboldt penguin, and other species such as sea lions, anchovies, crabs and the endangered blue whale.<\/p>\n\n\n\n<p>The proposal for a port terminal in this locality is not new. In 2005, the Peruvian state <a href=\"https:\/\/cdn.www.gob.pe\/uploads\/document\/file\/5165567\/Exposici%C3%B3n%20de%20Motivos%20del%20Decreto%20Supremo%20N%C2%B0%20019-2009-MTC.pdf?v=1695307674#:~:text=Mediante%20Ley%20No.,San%20Nicol%C3%A1s%20y%20San%20Juan.\">declared<\/a> it a project of \u201cpublic necessity and utility\u201d, given the \u201cimportant commercial activities\u201d in the area. By 2018, two Chinese companies \u2013 Shougang Hierro Peru, a subsidiary of the state-owned Shougang Group, and Jinzhao Mining Peru, a subsidiary of a Chinese construction firm \u2013 had formally expressed their interest in building it, according to Peru\u2019s <a href=\"https:\/\/www.minem.gob.pe\/minem\/archivos\/file\/Mineria\/PUBLICACIONES\/ANUARIOS\/2017\/ANUARIO%20MINERO%202017(1).pdf\">Ministry of Energy and Mines<\/a>.<\/p>\n\n\n\n<p>It was not until March this year that Jinzhao <a href=\"https:\/\/www.reuters.com\/world\/peru-awards-chinas-jinzhao-405-million-port-construction-contract-2024-03-22\/\">won<\/a> the tender for the design, financing, construction, operation and maintenance of the port for 30 years, with investments of USD 405 million expected. The company will also operate Pampa de Pongo, an iron mine under development some 40 kilometres east of Marcona that is home to some of the largest iron ore deposits in Latin America, from which it plans to export more than <a href=\"https:\/\/cdn.www.gob.pe\/uploads\/document\/file\/5141495\/PLAN%20MAESTRO%20TERMINAL%20PORTUARIO%20SAN%20JUAN%20DE%20MARCONA.pdf?v=1694847247\">20 million tonnes of iron per year<\/a>.&nbsp;<\/p>\n\n\n\n<div class=\"wp-block-cd-article-image aligncenter block--article-image block--article-image--article\" itemscope itemtype=\"http:\/\/schema.org\/ImageObject\"><div class=\"block--article-image__column\"><div class=\"hide-expand block--article-image__image\"><img class=\"lazy\" data-src=\"https:\/\/dialogue.earth\/content\/uploads\/2024\/07\/20240618_Callao-port_Flickr_53804463056_1a33006500_k.jpg\" data-srcset=\"https:\/\/dialogue.earth\/content\/uploads\/2024\/07\/20240618_Callao-port_Flickr_53804463056_1a33006500_k-768x512.jpg 768w, https:\/\/dialogue.earth\/content\/uploads\/2024\/07\/20240618_Callao-port_Flickr_53804463056_1a33006500_k-1024x683.jpg 1024w, https:\/\/dialogue.earth\/content\/uploads\/2024\/07\/20240618_Callao-port_Flickr_53804463056_1a33006500_k.jpg 2048w\" data-sizes=\"(max-width: 600px) 768px, (max-width: 1024px) 1024px, 2048px\" alt=\"large containers unloaded onto busy port\"\/><\/div><div class=\"block--article-image__content\"><div itemprop=\"caption\" class=\"block--article-image__caption\">Callao, Peru\u2019s largest port, handles more than 35 million tonnes of cargo each year. The proposed new port could handle 19 million tonnes, according to a government agency (Image: <a href=\"https:\/\/www.flickr.com\/photos\/presidenciaperu\/53804463056\/in\/album-72177720318104844\/\">Presidencia Per\u00fa<\/a> \/ <a href=\"https:\/\/www.flickr.com\/people\/presidenciaperu\/\">Flickr<\/a>, <a href=\"https:\/\/creativecommons.org\/licenses\/by-nc-sa\/2.0\/\">CC BY-NC-SA<\/a>)<\/div><\/div><\/div><meta itemprop=\"contentUrl\" content=\"https:\/\/dialogue.earth\/content\/uploads\/2024\/07\/20240618_Callao-port_Flickr_53804463056_1a33006500_k.jpg\"\/><meta itemprop=\"contentSize\" content=\"2 MB\"\/><meta itemprop=\"height\" content=\"1365\"\/><meta itemprop=\"width\" content=\"2048\"\/><meta itemprop=\"author\"\/><meta itemprop=\"representativeOfPage\" content=\"true\"\/><\/div>\n\n\n\n<p>The new terminal will reportedly be a multi-purpose port, featuring a dedicated dock for the handling of minerals, according to the <a href=\"https:\/\/www.gob.pe\/institucion\/proinversion\/noticias\/921786-nuevo-puerto-de-marcona-impulsaria-inversiones-por-mas-de-us-15-mil-millones-en-el-sur-del-pais\">ProInversi\u00f3n<\/a>, a government agency that seeks to attract foreign private investment in Peru. It is said that this will enable the activation of at least nine iron, copper, zinc and molybdenum mining projects in the country\u2019s south.<\/p>\n\n\n\n<p>The government has said the port will begin operations in 2028, and could handle some 19 million tonnes of cargo each year. Over 35 million tonnes passes annually through Callao, the country\u2019s largest port, while Chancay foresees the handling of some 34 million tonnes. Authorities claim Marcona could eventually have the capacity to handle 40 million tonnes each year.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-fears-over-mining-expansion\">Fears over mining expansion<\/h2>\n\n\n\n<p>Despite the touted benefits of the new port and the mining projects it could enable, previous experiences with mining companies and their track record in the region have aroused scrutiny and scepticism among some observers.<\/p>\n\n\n\n<p>Currently, <a href=\"https:\/\/cooperaccion.org.pe\/el-puerto-de-marcona\/\">72%<\/a> of Marcona district is reportedly occupied by such concessions, mostly held by Peruvian company Marcobre and Shougang Hierro Peru.<\/p>\n\n\n\n<div class=\"wp-block-cd-article-image aligncenter block--article-image block--article-image--article\" itemscope itemtype=\"http:\/\/schema.org\/ImageObject\"><div class=\"block--article-image__column\"><div class=\"hide-expand block--article-image__image\"><img class=\"lazy\" data-src=\"https:\/\/dialogue.earth\/content\/uploads\/2024\/07\/20240708_Marcona-district-mining-concessions_Peru_map_EN.jpg\" data-srcset=\"https:\/\/dialogue.earth\/content\/uploads\/2024\/07\/20240708_Marcona-district-mining-concessions_Peru_map_EN-768x600.jpg 768w, https:\/\/dialogue.earth\/content\/uploads\/2024\/07\/20240708_Marcona-district-mining-concessions_Peru_map_EN-1024x800.jpg 1024w, https:\/\/dialogue.earth\/content\/uploads\/2024\/07\/20240708_Marcona-district-mining-concessions_Peru_map_EN.jpg 2560w\" data-sizes=\"(max-width: 600px) 768px, (max-width: 1024px) 1024px, 2560px\" alt=\"\"\/><\/div><div class=\"block--article-image__content\"><div itemprop=\"caption\" class=\"block--article-image__caption\">(Data source: CooperAcci\u00f3n \/ Map: Dialogue Earth)<\/div><\/div><\/div><meta itemprop=\"contentUrl\" content=\"https:\/\/dialogue.earth\/content\/uploads\/2024\/07\/20240708_Marcona-district-mining-concessions_Peru_map_EN.jpg\"\/><meta itemprop=\"contentSize\" content=\"2 MB\"\/><meta itemprop=\"height\" content=\"2000\"\/><meta itemprop=\"width\" content=\"2560\"\/><meta itemprop=\"author\"\/><meta itemprop=\"representativeOfPage\" content=\"true\"\/><\/div>\n\n\n\n<p>The latter was founded in 1992, when nationalised mine Hierro Peru (Iron Peru) was bought by the Chinese company following its opening to privatisation by then-president Alberto Fujimori. Shougang has since faced penalties for a series of <a href=\"https:\/\/www.gob.pe\/institucion\/oefa\/noticias\/24583-oefa-ordeno-a-shougang-paralizacion-inmediata-del-transporte-y-almacenamiento-de-minerales-y-concentrados-para-evitar-afectacion-de-la-bahia-san-nicolas-en-ica\">labour<\/a> and <a href=\"https:\/\/publico.oefa.gob.pe\/administrados-sancionados\/#\/\">environmental<\/a> infractions, receiving 98 sanctions for the latter, according to the environment ministry\u2019s <a href=\"https:\/\/www.gob.pe\/institucion\/oefa\/informes-publicaciones\/4510769-resolucion-n-343-2023-oefa-tfa-se\">Agency for Environmental Assessment and Enforcement (OEFA)<\/a>.<\/p>\n\n\n\n<p>These have included the leakage of particulate matter from crude oil and iron concentrate stores, and an <a href=\"https:\/\/www.oefa.gob.pe\/oefa-supervisa-emergencia-ambiental-en-minera-shougang-hierro-peru-s-a-a-en-ica\/\">environmental emergency<\/a> that was declared due to a broken pipe with highly toxic mine tailings.<\/p>\n\n\n\n<p>Shougang \u201chas distinguished itself as one of the main violators of human rights in the country,\u201d claims Julia Cuadros, a researcher on Chinese investment in Peru and Latin America for the NGO CooperAcci\u00f3n. She suggests that \u201cit is natural to fear a repetition of the same thing.\u201d<\/p>\n\n\n\n<p>In the OEFA database of sanctions, Shougang is the mining company with the 17th highest number of infractions in Peru; a 2017 Boston University <a href=\"https:\/\/www.bu.edu\/gdp-cn\/files\/2017\/09\/Peru.pdf\">study<\/a> highlighted that Chinese companies have received comparatively fewer environmental sanctions than other firms. However, it is in labour relations that Shougang has faced its strongest challenges, encountering <a href=\"https:\/\/dialogue.earth\/en\/business\/595-hierro-peru-china-s-footprint-in-the-andes\/\">repeated strikes<\/a> and <a href=\"https:\/\/dialogue.earth\/en\/business\/2558-violent-protests-underline-challenges-for-china-peru-mining-cooperation\/\">violent protests<\/a> in its three decades in Marcona, amid worker discontent.<\/p>\n\n\n\n<p>The Boston University report points to difficult relations between the company and the Marcona community. \u201cObjectively, Shougang has not performed significantly worse in terms of labour standards or environmental impact than its Peruvian or international counterparts,\u201d it states, but highlights how it \u201chas not won over the hearts and minds of their neighbours\u201d.<\/p>\n\n\n\n<p>For the fishers, the impact of pollution by mining companies has been felt, for example, through the <a href=\"https:\/\/www.facebook.com\/permalink.php?story_fbid=pfbid02uiNXPuwojaskvdC1SuXEEYCxXaUbLtHJawYwJucXCUNRaRoMkPJHzJ8LZtmnhgJ3l&amp;id=61554213556863\">scarcity of red sea urchins<\/a> locally, which had in recent years become an increasingly <a href=\"https:\/\/boletines.exportemos.pe\/recursos\/boletin\/infografia-erizo-de-mar-en-la-region-de-asia-pacifico-inteligencia-comercial-exportemos.pdf.pdf\">popular export<\/a>. Their number is said to have fallen as a result of overpopulation of an invasive type of algae. \u201cThe strong wind from Marcona makes the iron fall into the sea and it is a mineral that causes these invasive algae to reproduce aggressively,\u201d says Juan Carlos Saavedra, a member of a Marcona artisanal fisher community who has been diving and fishing for 18 years. \u201cWe just want to avoid the same thing happening with the new projects.\u201d<\/p>\n\n\n\n<a class=\"wp-block-cd-related-news alignright block--related-news loading\" data-post-id=\"50382806\"><div class=\"block--related-news__image\"><\/div><div class=\"block--related-news__content\"><span class=\"block--related-news__heading\">Recommended<\/span><span class=\"block--related-news__title\"><\/span><\/div><\/a>\n\n\n\n<p>Some locals and NGOs fear similar challenges at the Marcona port as have been seen during the construction of the upcoming mega-port of Chancay, 80 kilometres from Lima. According to the <a href=\"https:\/\/spda.org.pe\/?wpfb_dl=4822\">Peruvian Society of Environmental Law<\/a> (SPDA), the environmental impact study for Chancay, an investment by Chinese company Cosco International, has not sufficiently considered all the adverse impacts, including its measures to protect adjacent wetlands.<\/p>\n\n\n\n<p>In a 2021 <a href=\"https:\/\/dialogue.earth\/en\/uncategorized\/43228-perus-chancay-mega-port-shakes-village-to-core\/\">report<\/a>, Dialogue Earth highlighted the damage to nearby houses that had occurred during blasting linked to the port\u2019s construction, as well as the concerns among local residents about the possible effects on the nearby Santa Rosa wetland. During a <a href=\"https:\/\/dialogue.earth\/en\/business\/382806-perus-megaport-reshapes-pacific-trade-and-the-town-next-door\/\">later report<\/a> from the town in 2023, observers told how the company had launched legal proceedings against inhabitants who had opposed the project.<\/p>\n\n\n\n<p>Cosco told Dialogue Earth that they only sought to prosecute those who had \u201cattacked the company\u2019s image\u201d, and highlighted compensation schemes they have offered to residents.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-new-project-new-doubts\">New project, new doubts<\/h2>\n\n\n\n<p>The awarding of the new Marcona terminal to Jinzhao has also taken place amidst an <a href=\"https:\/\/epicentro.tv\/villanueva-revela-un-nombre-mas-en-la-trama-de-avila-con-una-minera-china\/\">alleged case of corruption<\/a>, said to involve the general manager of its Peruvian business, as well as senior government figures and state officials, and the exchange of political favours. Jos\u00e9 \u00c1vila Herrera, a former member of the National Board of Justice, allegedly negotiated with former justice minister Felix Chero to secure favours, including to supposedly aid Jinzhao in gaining control of land to build the Marcona port.<\/p>\n\n\n\n<p>The head of the Jinzhao port project, Edison Poma, distanced the company from the allegations, <a href=\"https:\/\/www.facebook.com\/terminalportuariojinzhao\/videos\/1070987700838926?locale=es_LA\">claiming<\/a> in an interview that this was instead a case of confusion \u201cdue to a lack of communication between state entities\u201d.<\/p>\n\n\n\n<p>Researcher Cuadros suggests concerns about the involvement of Chinese companies in corruption cases. \u201cSuch lobbying would be something very obscure and, although companies of other nationalities also do it, the problem is that when it is an investment as large as this one, the impact is also large.\u201d<\/p>\n\n\n\n<p>Several Chinese companies have faced investigation in corruption cases in Latin America, including in <a href=\"https:\/\/www.bnamericas.com\/en\/news\/bolivias-roads-agency-raided-following-bribe-allegation\">Bolivia<\/a> and <a href=\"https:\/\/fundacionandresbello.org\/en\/news\/ecuador-%F0%9F%87%AA%F0%9F%87%A8-news\/ecuadors-public-prosecutors-office-to-file-bribery-charges-in-sinohydro-case-after-four-year-investigation\/\">Ecuador<\/a>, which have contributed to calls for the country\u2019s government to help ensure accountability for companies operating overseas \u2013 efforts that are reportedly beginning <a href=\"https:\/\/thediplomat.com\/2024\/02\/a-new-era-for-chinas-overseas-anti-corruption-campaign\/\">to progress<\/a> within China.<\/p>\n\n\n\n<div class=\"wp-block-cd-article-image aligncenter block--article-image block--article-image--article\" itemscope itemtype=\"http:\/\/schema.org\/ImageObject\"><div class=\"block--article-image__column\"><div class=\"hide-expand block--article-image__image\"><img class=\"lazy\" data-src=\"https:\/\/dialogue.earth\/content\/uploads\/2024\/07\/20240628_Dina-Boluarte-with-Xi-Jinping_Flickr_53820560227_2711acb2ca_k.jpg\" data-srcset=\"https:\/\/dialogue.earth\/content\/uploads\/2024\/07\/20240628_Dina-Boluarte-with-Xi-Jinping_Flickr_53820560227_2711acb2ca_k-768x512.jpg 768w, https:\/\/dialogue.earth\/content\/uploads\/2024\/07\/20240628_Dina-Boluarte-with-Xi-Jinping_Flickr_53820560227_2711acb2ca_k-1024x683.jpg 1024w, https:\/\/dialogue.earth\/content\/uploads\/2024\/07\/20240628_Dina-Boluarte-with-Xi-Jinping_Flickr_53820560227_2711acb2ca_k.jpg 2048w\" data-sizes=\"(max-width: 600px) 768px, (max-width: 1024px) 1024px, 2048px\" alt=\"Dina Boluarte with Xi Jinping\"\/><\/div><div class=\"block--article-image__content\"><div itemprop=\"caption\" class=\"block--article-image__caption\">Peruvian president Dina Boluarte with Chinese leader Xi Jinping during her official visit to Beijing in June 2024. In recent years, Jinzhao has carried out a detailed study, which <a href=\"https:\/\/www.gob.pe\/institucion\/senace\/normas-legales\/4391810-00107-2023-senace-pe-dein\">was approved<\/a> in 2023 by Senace, the national environmental certification body. But fishers say that this was not well received locally.<\/p>\n\n\n\n<p>\u201cWe are not against the investment,\u201d says Espinoza, who is president of the town\u2019s artisanal fishing community group, which brings together over 1,500 local fishers. He expresses reservations around the involvement of a Chinese business, claiming that \u201cthe issue is with the Chinese companies. If Jinzhao doesn\u2019t do this study properly, it will be the same [outcome] as with Shougang.\u201d<\/p>\n\n\n\n<p>According to a <a href=\"https:\/\/www.investinperu.pe\/es\/pi\/detalle-noticia\/comunicado-proinversion\">communiqu\u00e9<\/a> from ProInversi\u00f3n, this study was not part of the evaluation process for Jinzhao\u2019s bid, but will have to be presented by the company once the concession contract has been signed; no information is yet available on when this will take place. They will also have to provide an update to a final engineering study, within a maximum period of two years.<\/p>\n\n\n\n<div class=\"wp-block-cd-pull-quote block--pull-quote\"><div class=\"block--pull-quote__wrapper\"><blockquote class=\"block--pull-quote__quote\">Although it is an investment of Chinese capital, it is a public project and we are obliged to comply with all the laws of the Peruvian state<\/blockquote><cite class=\"block--pull-quote__cite\">Edison Poma, Jinzhao port project head<\/cite><\/div><\/div>\n\n\n\n<p>Poma, the Jinzhao port project head, said in his interview that the proposal put together for its bid also involved a third-party company hired by ProInversi\u00f3n to oversee and verify its technical and environmental compliance. \u201cAlthough it is an investment of Chinese capital, it is a public project and we are obliged to comply with all the laws of the Peruvian state,\u201d he added.<\/p>\n\n\n\n<p>Dialogue Earth sought interviews with ProInversi\u00f3n and Jinzhao about the issues raised in this article and sent queries directly to the companies by email. However, no response had been received by the time of publication.<\/p>\n\n\n\n<p>\u201cWhen the national government declares these investments to be of national interest, they are simply implemented [without public approval],\u201d claims Cuadros. \u201cAnd what usually happens is that the population goes from resistance, as in Chancay, to accepting that they are going to have to coexist with this work but without giving up their rights.\u201d<\/p>\n\n\n\n<p>The fishers of Marcona say they will continue to look to assert their rights to their environment and livelihoods. \u201cWe don\u2019t want all this natural wealth to be lost for future generations, because being fishermen is something that is practically in our blood,\u201d says
