{"id":60043614,"date":"2024-07-24T11:03:11","date_gmt":"2024-07-24T10:03:11","guid":{"rendered":"https:\/\/dialogue.earth\/?p=60043614"},"modified":"2024-07-29T20:05:17","modified_gmt":"2024-07-29T19:05:17","slug":"no-respite-from-heat-for-workers-in-india","status":"publish","type":"post","link":"https:\/\/dialogue.earth\/en\/climate\/no-respite-from-heat-for-workers-in-india\/","title":{"rendered":"No respite from heat for workers in India"},"content":{"rendered":"\n<p>In June, as the India Meteorological Department (IMD) warned of \u2018<a href=\"https:\/\/internal.imd.gov.in\/press_release\/20240615_pr_3052.pdf\">severe heatwave conditions<\/a>\u2019 sixty-year-old Mohd Zaffer fed fuel to the fire. Zaffer, a master craftsman with three decades of experience making perfumes, was heating large metal pots called <em>deghs,<\/em> used in the production of <em>Shamama Attar<\/em>, a rare, traditional scent made in the city of Kannauj, the<a href=\"https:\/\/onlineupsida.com\/pp-kannauj.aspx#:~:text=The%20essence%20flavour%20and%20fragrance,body%20jells%2C%20ayurvedic%20medicines%20etc.\"> perfume capital of India.<\/a> Despite temperatures reaching 45\u02daC outside, a sweat-drenched Zaffer maintained his focus.<\/p>\n\n\n\n<p>The scent-making process involves a simple distillation method. Ingredients are added to a metal pot to simmer on a small furnace, from which steam travels through a wooden pipe to another pot or receiver, which is kept in water to condense the steam. Artisans must simultaneously control the heat and adjust the hot receiver, working perilously close to the furnace and exposing themselves to dangerous levels of heat.<\/p>\n\n\n\n<div class=\"wp-block-cd-pull-quote block--pull-quote\"><div class=\"block--pull-quote__wrapper\"><blockquote class=\"block--pull-quote__quote\">Summers are especially difficult to work here. The entire area is filled with smoke and black soot.<\/blockquote><cite class=\"block--pull-quote__cite\">Mohd Zaffer, master craftsman<\/cite><\/div><\/div>\n\n\n\n<p>\u201cOur job requires us to keep an eye on these<em> deghs<\/em> to keep the heat in control. If it needs more heat, we add wood to the furnace. Once the steam is collected in the receiver pot or <em>bhapka<\/em>, the water around it gets extremely hot. And that\u2019s the time we have to adjust it (receiver) with our bare hands,\u201d explains Zaffer, detailing the traditional <em>degh-bhapka<\/em> method<em>.<\/em><\/p>\n\n\n\n<p>Zaffer works dangerously close to the furnace for over 10 hours without any protective gear, wearing only loose shorts and a vest to let the sweat dry quickly. Even when changing the hot receiver, his only protection is a damp cotton cloth. The heat from the furnace is not the only danger. Zaffer works in a closed estate with a large tin-covered compound in the middle housing 20 such <em>deghs<\/em> and furnaces.<\/p>\n\n\n\n<p>\u201cSummers are especially difficult to work here. The entire area is filled with smoke and black soot. Others can\u2019t even stand here for even 10 minutes,\u201d he says. \u201cWe have gotten used to this heat and smoke now. But yes, winters are more bearable here.\u201d<\/p>\n\n\n\n<p>According to the latest <a href=\"https:\/\/www.ilo.org\/publications\/ensuring-safety-and-health-work-changing-climate#:~:text=This%20report%20presents%20critical%20evidence,Ultraviolet%20(UV)%20radiation\">global report<\/a> on health and safety in a changing climate by the International Labour Organisation (ILO), \u201cWorkers across different sectors are exposed to these hazards but some workers, such as agricultural workers and other outdoor workers carrying out heavy labour in hot climates, may be particularly at risk.\u201d There is no consolidated data on heat deaths due to labour conditions in India, even if newspapers <a href=\"https:\/\/indianexpress.com\/article\/cities\/delhi\/delhi-heat-claims-first-victim-40-year-old-factory-worker-from-darbhanga-9360274\/\">sometimes report them<\/a>.<\/p>\n\n\n\n<div class=\"wp-block-cd-article-image aligncenter block--article-image block--article-image--article\" itemscope itemtype=\"http:\/\/schema.org\/ImageObject\"><div class=\"block--article-image__column\"><div class=\"hide-expand block--article-image__image\"><img class=\"lazy\" data-src=\"https:\/\/dialogue.earth\/content\/uploads\/2024\/07\/20240722_Mohd-Zaffer-pouring-water-to-control-the-furnace-fire_TejprakashBhardwaj-scaled.jpg\" data-srcset=\"https:\/\/dialogue.earth\/content\/uploads\/2024\/07\/20240722_Mohd-Zaffer-pouring-water-to-control-the-furnace-fire_TejprakashBhardwaj-768x576.jpg 768w, https:\/\/dialogue.earth\/content\/uploads\/2024\/07\/20240722_Mohd-Zaffer-pouring-water-to-control-the-furnace-fire_TejprakashBhardwaj-1024x768.jpg 1024w, https:\/\/dialogue.earth\/content\/uploads\/2024\/07\/20240722_Mohd-Zaffer-pouring-water-to-control-the-furnace-fire_TejprakashBhardwaj-scaled.jpg 2560w\" data-sizes=\"(max-width: 600px) 768px, (max-width: 1024px) 1024px, 2560px\" alt=\"man pouring water over furnace fire\"\/><\/div><div class=\"block--article-image__content\"><div itemprop=\"caption\" class=\"block--article-image__caption\">Sixty-year-old craftsman Mohd Zaffer pouring water to control the furnace fire inside the perfumery (Image: Tej Prakash Bhardwaj)<\/div><\/div><\/div><meta itemprop=\"contentUrl\" content=\"https:\/\/dialogue.earth\/content\/uploads\/2024\/07\/20240722_Mohd-Zaffer-pouring-water-to-control-the-furnace-fire_TejprakashBhardwaj-scaled.jpg\"\/><meta itemprop=\"contentSize\" content=\"656 KB\"\/><meta itemprop=\"height\" content=\"1920\"\/><meta itemprop=\"width\" content=\"2560\"\/><meta itemprop=\"author\"\/><meta itemprop=\"representativeOfPage\" content=\"true\"\/><\/div>\n\n\n\n<p>The perfumery where Zaffer works employs about 15 workers. Their work exposes them to various hazards, like high ambient temperatures and radiant heat from furnaces. These workers operate in poorly ventilated home-based industries and small factories, classified under the micro, small and medium enterprises (MSME) category.<\/p>\n\n\n\n<p>In the state of Uttar Pradesh, where Kannauj is located, the MSME sector <a href=\"https:\/\/pib.gov.in\/PressReleaseIframePage.aspx?PRID=1946375\">employs<\/a> about 11 million workers, while across India, the sector employs over 123 million people, accounting for 20% of the entire workforce. While not all MSMEs engage in extreme heat-related activities, most MSME employees are exposed to heat hazards due to the informal nature of their work.<\/p>\n\n\n\n<p>Avikal Somvanshi, head of the Urban Lab programme at the Centre for Science and Environment (CSE), says: \u201cAnyone working in medium and small-scale industries, factories, which are not insulated, or do not have any kind of air conditioning or even fans to cool people down are highly vulnerable to heat.\u201d He notes that these buildings are cramped withoutventilation, with tin roofs that fail to block out the heat, especially during extreme temperatures such as those experienced in May and June.<\/p>\n\n\n\n<p>In 2024, India <a href=\"https:\/\/www.hindustantimes.com\/india-news\/india-experiencing-one-of-its-longest-and-deadliest-summers-shows-imd-data-101718282125109.html\">experienced <\/a>one of its longest-ever heatwaves. Uttar Pradesh <a href=\"https:\/\/indianexpress.com\/article\/india\/this-summer-most-number-of-heatwave-days-and-still-counting-9391450\/\">saw <\/a>20 heatwave days between March 1 to June 9. <a href=\"https:\/\/apnews.com\/article\/india-heatwave-deaths-heat-stroke-climate-change-880f26e3b8eeb066d2db2308502783d2\">Media reports<\/a> indicate that between March 1 and June 18, approximately 110 people died from heat stroke, with over 40,000 suspected cases reported. Although data related to work-related illness or deaths due to heat is unavailable, reports suggest fatalities in North Indian states like <a href=\"https:\/\/indianexpress.com\/article\/cities\/delhi\/delhi-heat-claims-first-victim-40-year-old-factory-worker-from-darbhanga-9360274\/\">Delhi <\/a>and <a href=\"https:\/\/www.thehindu.com\/news\/national\/poll-staff-among-heat-related-deaths-in-india\/article68237124.ece\">Uttar Pradesh<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-indian-labour-laws-on-heat-exposure-in-the-workplace\">Indian labour laws on heat exposure in the workplace<\/h2>\n\n\n\n<p>Occupational safety and health used to fall under the <a href=\"https:\/\/labour.gov.in\/sites\/default\/files\/factories_act_1948.pdf\">Factories Act, 1948<\/a>, which required factories to ensure \u201cadequate ventilation by the circulation of fresh air\u201d and maintain \u201csuch a temperature as will secure to workers therein reasonable conditions of comfort and prevent injury to health\u201d. In 2020, India consolidated 13 central laws on workers\u2019 safety into the <a href=\"https:\/\/prsindia.org\/files\/bills_acts\/bills_parliament\/2020\/Occupational%20Safety,%20Health%20And%20Working%20Conditions%20Code,%202020_1.pdf\">Occupational Safety, Health and Working Conditions Code, 2020<\/a>.&nbsp;<\/p>\n\n\n\n<div class=\"wp-block-cd-article-image aligncenter block--article-image block--article-image--article\" itemscope itemtype=\"http:\/\/schema.org\/ImageObject\"><div class=\"block--article-image__column\"><div class=\"hide-expand block--article-image__image\"><img class=\"lazy\" data-src=\"https:\/\/dialogue.earth\/content\/uploads\/2024\/07\/20240722_Worker-sweating-while-working-in-humid-heat-of-early-July-New-Delhi.-_TejprakashBhardwaj-scaled.jpg\" data-srcset=\"https:\/\/dialogue.earth\/content\/uploads\/2024\/07\/20240722_Worker-sweating-while-working-in-humid-heat-of-early-July-New-Delhi.-_TejprakashBhardwaj-768x432.jpg 768w, https:\/\/dialogue.earth\/content\/uploads\/2024\/07\/20240722_Worker-sweating-while-working-in-humid-heat-of-early-July-New-Delhi.-_TejprakashBhardwaj-1024x576.jpg 1024w, https:\/\/dialogue.earth\/content\/uploads\/2024\/07\/20240722_Worker-sweating-while-working-in-humid-heat-of-early-July-New-Delhi.-_TejprakashBhardwaj-scaled.jpg 2560w\" data-sizes=\"(max-width: 600px) 768px, (max-width: 1024px) 1024px, 2560px\" alt=\"sweaty man facing wall\"\/><\/div><div class=\"block--article-image__content\"><div itemprop=\"caption\" class=\"block--article-image__caption\">A worker sweating while working in the humid heat of early July in Okhla, New Delhi. Moreover, as noted by the think tank <a href=\"https:\/\/prsindia.org\/billtrack\/the-occupational-safety-health-and-working-conditions-code-2020\">PRS Legislative Research<\/a>, \u201cThe 2020 bill empowers the state government to exempt any new factory from the provisions of the Code in order to create more economic activity and employment.\u201d This exemption has been retained in the act.<em><\/em><\/p>\n\n\n\n<p>Other government institutions, such as the National Disaster Management Authority (NDMA), also ignore the impact of rising heat on industry, focussing only on individuals, with only advisory <a href=\"https:\/\/ndma.gov.in\/Natural-Hazards\/Heat-Wave\">guidelines for heatwaves<\/a>. The Ministry of Labour and Employment, responsible for overseeing worker safety, is restricted in its actions.<\/p>\n\n\n\n<p>Navneet Shrivastav, labour enforcement officer at the Kannauj labour department, says, \u201cThe district authority has released directions for putting work on hold during the day time. We are seeing a decline in working hours especially during peak heat time (12 PM-3 PM).\u201d He adds, \u201cWe cannot ask small factories to stop work or inspect the workplace directly without any complaint by workers to the commission.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-the-general-nature-of-heat-action-plans-and-advisories\">The \u2018general\u2019 nature of heat action plans and advisories<\/h2>\n\n\n\n<p>In 2019, the NDMA published its <a href=\"https:\/\/ndma.gov.in\/sites\/default\/files\/PDF\/Guidelines\/heatwaveguidelines.pdf\">national guidelines on heatwaves<\/a> to protect the public from extreme heat. These guidelines aim to help public officials develop their own heatwave action plans across India\u2019s cities and towns. During heatwaves, the labour department, state disaster management authorities (<a href=\"https:\/\/upsdma.up.nic.in\/heatwave.htm\">SDMAs<\/a>), the <a href=\"https:\/\/internal.imd.gov.in\/pages\/heatwave_mausam.php\">India Meteorological Department<\/a> and other <a href=\"https:\/\/upsdma.up.nic.in\/2024\/Heat_Wave_Action_Plan_2024.pdf\">state authorities<\/a> release advisories and Heat Action Plan (HAPs) for the general public and workers.<\/p>\n\n\n\n<p>Aravind Unni, a policy researcher on heat and informal workers with the Tata Institute of Social Sciences (TISS), highlights that these HAPs and advisories are \u201cgeneral\u201d in nature. \u201cOur HAPs and heat warnings never go into details of workers, population groups, or marginalised groups,\u201d he says.<\/p>\n\n\n\n<p>Unni suggests that district administration or municipal authorities could enhance HAPs by providing specific advisories for various demographics, such as perfume makers, brick kiln workers and textile workers, who experience heat in different workplace contexts. This tailored approach could improve the effectiveness of heat-related advisories.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-the-lethality-of-humid-heat\">The lethality of humid heat<\/h2>\n\n\n\n<p>Another missing element in the HAPs and guidelines is the consideration of humid heat. While humans <a href=\"https:\/\/www.lethalhumidity.org\/#about\">can tolerate<\/a> 54\u02daC of dry heat, studies <a href=\"https:\/\/www.nature.com\/articles\/d44151-024-00038-2\">show<\/a> that, in humid conditions, \u201c35\u00b0C marks the heat stress tolerance limit\u201d. Since MSMEs are poorly ventilated and often cramped, humidity becomes more difficult to tolerate for workers, especially during the monsoon season.<\/p>\n\n\n\n<p>In early July, Dialogue Earth visited a few small bakeries in Delhi. Mohd Rizwan, who works alongside a furnace fuelled by liquified petroleum gas used for baking bread, says, \u201cIt is very bad here during summers, especially when the monsoon arrives. One starts feeling very hot and dizzy during summer. The only fan that is present is a small table fan near the bhatti that blows hot air away.<\/p>\n\n\n\n<p>\u201cHeat indexes are not well-established in India,\u201d Dileep Mavalanka, a public health expert and former director of the Indian Institute of Public Health Gandhinagar, tells Dialogue Earth. \u201cOther countries [such as the US] have measures to combine temperature and humidity. India doesn&#8217;t have separate advisories for humid heat or wet-bulb temperature.\u201d<\/p>\n\n\n\n<p>\u201cEvery layer of marginality\u2026 brings a new problem,\u201d says Unni. Unless the details are dealt with, he says, the HAPs and heat-related advisories will change nothing for those most at risk of the rising heat in
