The incident would have gone unnoticed had it not been for what happened to the animal\u2019s body.<\/p>\n\n\n\n<p>After being alerted to the incident by locals and rangers, agents from the Forestry and Environmental Preservation Police (Pofoma) <a href=\"https:\/\/www.la-razon.com\/ciudades\/2024\/05\/11\/en-la-mira-al-menos-tres-trabajadores-de-sinohydro-por-descuartizar-a-un-jaguar\/\">discovered<\/a> its dismembered head and three of its limbs, half-buried, along with its full hide spread on a board, in a camp belonging to the Chinese company Sinohydro, which was in charge of the works.<\/p>\n\n\n\n<p>Government officials told media that they suspected the parts were dismembered with the intention of being sold. The parts were <a href=\"https:\/\/www.laregion.bo\/caso-jaguar-descuartizado-denuncian-por-biocidio-y-trafico-de-vida-silvestre-a-trabajadores-de-empresa-china-sinohydro\/\">recovered<\/a> by authorities, and three Sinohydro employees \u2013 two Bolivian and one Pakistani \u2013 were linked to the incident, though no arrests were initially reported, nor had the driver who struck the jaguar been identified. The Pakistani worker is said to have voluntarily handed over the jaguar head and four of its teeth, according to a police report seen by Dialogue Earth.<\/p>\n\n\n\n<p>At least five national laws in the country protect animals and punish biocide and wildlife trafficking with up to eight years in prison. The jaguar, classified as \u201cnear threatened\u201d <a href=\"https:\/\/www.iucn.org\/es\/news\/south-america\/202205\/bolivia-despliega-esfuerzos-conjuntos-para-salvar-el-jaguar#:~:text=Actualmente%20el%20jaguar%20est%C3%A1%20en,impulsa%20grandes%20obras%20viales%2C%20la\">according<\/a> to the International Union for Conservation of Nature, is being conserved in Bolivia under a <a href=\"https:\/\/wwflac.awsassets.panda.org\/downloads\/plan_de_accion_para_la_conservacion_del_jaguar_2020_2025.pdf\">national plan<\/a>. The Public Prosecutor\u2019s Office therefore opened an investigation to determine who was responsible. Sandra Monta\u00f1o, legal advisor to the Cochabamba Departmental Secretariat for the Rights of Mother Earth, a state environmental body, said that the Cochabamba government has joined the legal process.<\/p>\n\n\n\n<p>The incident gained national prominence due to gory photographs of the animal carcass circulating on social media.<\/p>\n\n\n\n<p>Three other Sinohydro employees, from its legal, human resources and environmental departments, were <a href=\"https:\/\/www.laregion.bo\/caso-jaguar-descuartizado-denuncian-por-biocidio-y-trafico-de-vida-silvestre-a-trabajadores-de-empresa-china-sinohydro\/\">reported<\/a> by local media to have assisted police authorities in the recovery of the animal parts, while the two Bolivian workers allegedly involved in the incident were reported to have left the company camp soon after. But the incident has been another potentially damaging episode for Sinohydro in Bolivia, where it has faced challenges since it arrived in the country in 2013.<\/p>\n\n\n\n<p>The Chinese constructor \u2013 a subsidiary of state-owned PowerChina \u2013 is involved in six road infrastructure and energy projects in Bolivia, but has been the subject of complaints from environmental organisations and government officials, related to is record on deforestation around project sites, labour disputes, and the quality of the works it has delivered.<\/p>\n\n\n\n<div class=\"wp-block-cd-article-image aligncenter block--article-image block--article-image--article\" itemscope itemtype=\"http:\/\/schema.org\/ImageObject\"><div class=\"block--article-image__column\"><div class=\"hide-expand block--article-image__image\"><img class=\"lazy\" data-src=\"https:\/\/dialogue.earth\/content\/uploads\/2024\/09\/20240927_Bolivia-Sinohydro-projects_map_EN.jpg\" data-srcset=\"https:\/\/dialogue.earth\/content\/uploads\/2024\/09\/20240927_Bolivia-Sinohydro-projects_map_EN-768x768.jpg 768w, https:\/\/dialogue.earth\/content\/uploads\/2024\/09\/20240927_Bolivia-Sinohydro-projects_map_EN-1024x1024.jpg 1024w, https:\/\/dialogue.earth\/content\/uploads\/2024\/09\/20240927_Bolivia-Sinohydro-projects_map_EN.jpg 2560w\" data-sizes=\"(max-width: 600px) 768px, (max-width: 1024px) 1024px, 2560px\" alt=\"\"\/><\/div><div class=\"block--article-image__content\"><div itemprop=\"caption\" class=\"block--article-image__caption\">(Data sources: Bolivian Highway Administration, ENDE; Map: Dialogue Earth)<\/div><\/div><\/div><meta itemprop=\"contentUrl\" content=\"https:\/\/dialogue.earth\/content\/uploads\/2024\/09\/20240927_Bolivia-Sinohydro-projects_map_EN.jpg\"\/><meta itemprop=\"contentSize\" content=\"2 MB\"\/><meta itemprop=\"height\" content=\"2560\"\/><meta itemprop=\"width\" content=\"2560\"\/><meta itemprop=\"author\"\/><meta itemprop=\"representativeOfPage\" content=\"true\"\/><\/div>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-environmental-complaints\">Environmental complaints<\/h2>\n\n\n\n<p>The company\u2019s name first appeared in Bolivian media as the subject of environmental complaints in 2017. Tom\u00e1s Monasterio, then a congressman for the opposition Democratic Party, <a href=\"https:\/\/www.lostiempos.com\/actualidad\/economia\/20170110\/presentan-demanda-contra-sinohydro-abc-desmonte-arboles-rio-surutu\">filed a criminal complaint<\/a> against Sinohydro over the deforestation of 6.8 hectares of trees on the banks of the Surut\u00fa River in Santa Cruz department, which he said increased flood risk and put local communities in danger. Almost a month later, he <a href=\"https:\/\/www.noticiasfides.com\/nacional\/sociedad\/diputado-monasterio-presento-una-segunda-demanda-penal-contra-sinohydro-por-desmonte-ilegal\">filed a second lawsuit<\/a> against the company for deforestation of a further 1.8 hectares, this time on the banks of the Pira\u00ed River, which took place despite regulations prohibiting any logging within 100 metres of a river for environmental protection. Both instances took place as part of the construction of the Montero-Yapacan\u00ed dual carriageway in Santa Cruz.<\/p>\n\n\n\n<p>The former parliamentarian described these incidents to Dialogue Earth as \u201ca savage clearing\u201d. During an inspection in Surut\u00fa, he reported that personnel from the Forestry and Land Authority (ABT) also found \u201cburied toxic waste\u201d.<\/p>\n\n\n\n<p>The ABT <a href=\"https:\/\/www.lostiempos.com\/actualidad\/economia\/20170127\/denuncian-sinohydro-otra-tala-ilegal?page=1\">announced<\/a> the issuing of a fine of <a href=\"https:\/\/www.cadecocruz.org.bo\/index.php?op=200&amp;gr=1&amp;nw=1397\">around BOB 14,000<\/a> (USD 2,018) for the first case, along with an order to reforest the entire area, and a doubling of the fine for the second. In both cases, the ABT confirmed that there was no authorisation to clear the land. But Humberto Nazra, the Bolivian Highway Administration\u2019s (ABC) works prosecutor, told <a href=\"https:\/\/eju.tv\/2017\/01\/la-investigacion-de-tala-apunta-a-china-sinohydro-y-a-estatal-abc\/\">media<\/a> that he did not believe Sinohydro acted in bad faith, and said the company had acknowledged its mistakes and was complying with orders issued to it by authorities.<\/p>\n\n\n\n<p>Monasterio then filed a third criminal complaint. He said that as he was undertaking an inspection of the deforested Surut\u00fa site, a group of local community members \u2013 which he claimed consisted of Sinohydro employees and people supportive of the company and politicians who approved the projects \u2013 \u201cheld me back and threatened to lynch me, and I had to flee from Surut\u00fa\u201d.<\/p>\n\n\n\n<p>The former deputy says he was surprised to be informed, when his legislative term ended in 2021, that his three complaints were all rejected due to allegedly insufficient evidence, despite the environmental crimes committed being demonstrated and already subject to fines.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-the-ivirizu-case\">The Ivirizu case<\/h2>\n\n\n\n<p>Sinohydro has faced further criticism on its environmental performance in Bolivia, being <a href=\"https:\/\/dialogue.earth\/en\/business\/364274-latin-american-ngo-concerns-chinese-investments-un\/\">mentioned<\/a> before the United Nations Committee on Economic, Social and Cultural Rights (CESCR) in 2023. The case of the Ivirizu hydroelectric plant, under construction in Cochabamba, was highlighted by Franco Albarrac\u00edn, a researcher at the environmental civil society organisation Cedib, who presented a <a href=\"https:\/\/alianzaddhh.org\/china-derechos-humanos-y-actividades-empresariales-en-america-latina\/\">report<\/a> to the committee evaluating China\u2019s business activities in Latin America and their compliance with international obligations and human rights laws. <\/p>\n\n\n\n<p>He <a href=\"https:\/\/www.brujuladigital.net\/economia\/denuncian-en-ginebra-a-la-china-sinohydro-por-violacion-de-ddhh-laborales-e-impactos-ambientales\">highlighted<\/a> to the committee the company\u2019s hydroelectric power plant, which he claimed as having \u201calready affected 280 hectares of forest within the protected area [of the Carrasco National Park, within which the plant is located], which clearly has a negative and probably irreversible impact on flora and fauna\u201d. One researcher claims that works have already affected 280 hectares of forest within the protected area of the Carrasco National Park, where the project is located (Image: Ministry of Hydrocarbons and Energy of Bolivia)<\/div><\/div><\/div><meta itemprop=\"contentUrl\" content=\"https:\/\/dialogue.earth\/content\/uploads\/2024\/09\/Ivirizu-hidroelectric-plant_Synohydro_Bolivia_Ministerio-de-Hidrocarburos-y-energias-2.jpg\"\/><meta itemprop=\"contentSize\" content=\"3 MB\"\/><meta itemprop=\"height\" content=\"1707\"\/><meta itemprop=\"width\" content=\"2560\"\/><meta itemprop=\"author\"\/><meta itemprop=\"representativeOfPage\" content=\"true\"\/><\/div>\n\n\n\n<p>Marco Gandarillas, head of monitoring Chinese investments at Ecuador-based NGO Latinoam\u00e9rica Sustentable, highlighted the \u201ccomplicated\u201d nature of the Ivirizu project, \u201cfrom deforestation and the treatment of deforestation waste, to the [power plant] itself\u201d. Additionally, he claimed that there have been reports of incursions into the protected area by \u201ccolonisers\u201d (a term often used in Bolivia to refer to people from the Andean region who seek land in the tropical zone), which he said has been made possible by the project\u2019s creation of roads and paths for the movement of workers and materials.<\/p>\n\n\n\n<p>In order to carry out this project \u2013 which Bolivian public utilities company Ende <a href=\"https:\/\/www.ende.bo\/noticia\/noticia\/51\">stated<\/a> in 2016 would be used to generate surplus electricity for export \u2013 a Cedib dossier <a href=\"https:\/\/cedib.org\/wp-content\/uploads\/2021\/03\/Dossier-AreasProtegidas-ULTIMO.pdf\">notes<\/a> that the zoning of the protected area was modified for the development of the project, which was declared <a href=\"https:\/\/www.lexivox.org\/norms\/BO-L-N819.html#:~:text=19%20DE%20JULIO%20DE%202016.,para%20su%20ejecuci%C3%B3n%20e%20implementaci%C3%B3n.\">\u201cof national interest and priority<\/a>\u201d by the government only a month before the modification. In May 2023, the Ministry of Hydrocarbons and Energy <a href=\"https:\/\/www.mhe.gob.bo\/2024\/05\/21\/proyecto-hidroelectrico-ivirizu-tiene-un-avance-del-86-y-generara-mas-de-290-megavatios-de-energia\/\">announced<\/a> the project was \u201cmore than 86%\u201d complete.<\/p>\n\n\n\n<p>Additionally, when more than 50 Bolivian environmental organisations sent a letter in 2020 to Sinohydro, one of the requests made was that they make public the environmental studies, in which they stated that the intervention of the power plant in the park \u201cwill have irreversible impacts\u201d, reports Gandarillas. \u201cBut both the company and the Bolivian authorities refused,\u201d he adds.<\/p>\n\n\n\n<p>Sinohydro has not responded directly to these issues, and did not respond to Dialogue Earth\u2019s approaches for comment. In a <a href=\"http:\/\/www.powerchina.cn\/art\/2023\/1\/21\/art_7460_1595082.html\">2023 article<\/a> published on the website of parent company PowerChina, it referred to the obtaining of environmental impact assessment and tree felling permits in 2018, and emphasised the project\u2019s attempts to adhere to Bolivian environmental law, claiming that it had \u201cstrictly followed\u201d environment protection measures and \u201censured that local ecology is not damaged\u201d.<\/p>\n\n\n\n<p>On <a href=\"https:\/\/www.ende.bo\/noticia\/noticia\/679\">its official website<\/a>, Ende states that Ivirizu is a \u201csustainable solution\u201d to Bolivia\u2019s energy challenges. It also claims that environmental impact studies were carried out, and \u201cprevention and mitigation measures were implemented to protect biodiversity and local ecosystems\u201d. Additionally, the website states that Ivirizu is \u201cthe first project in Bolivia\u201d to implement rescue plans for flora and fauna such as amphibians and reptiles as a mitigation measure as part of its environmental licence.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-labour-and-quality-claims\">Labour and quality claims<\/h2>\n\n\n\n<p>In 2021, Sinohydro was also linked to alleged <a href=\"https:\/\/erbol.com.bo\/gente\/defensor%C3%ADa-identifica-vulneraciones-laborales-en-proyecto-cargo-de-empresa-china\">labour violations<\/a> in Ivirizu, revealed by the Ombudsman\u2019s Office, whose <a href=\"https:\/\/www.defensoria.gob.bo\/uploads\/files\/informe-defensorial-resultados-de-la-verificacion-defensorial-a-la-empresa-sinohydro-corporation-limited-sucursal-bolivia.pdf\">report<\/a> also pointed to a lack of action taken by the Ministry of Labour. These related to subcontracting and outsourcing, as well as poor conditions in workers\u2019 lodgings.<\/p>\n\n\n\n<p>Disputes were also reported in the construction of the Padilla-El Salto highway in Chuquisaca department in 2018, where a Chinese Sinohydro employee was arrested after allegedly <a href=\"https:\/\/correodelsur.com\/local\/20180201_sinohydro-en-la-mira-por-golpes-a-mujer-en-padilla.html\">attacking<\/a> a woman working for one of its subcontractors, who was protesting about its failure to pay her wages. The incident sparked wider hostilities, with workers from the subcontracted company and other local organisations <a href=\"https:\/\/eju.tv\/2018\/01\/en-padilla-declaran-paro-en-contra-de-abusos-de-la-empresa-china-sinohydro\/\">blockading<\/a> Sinohydro\u2019s camps. The company initially denied the accusations, saying that payment was the responsibility of its subcontractor, and claimed on the contrary that its workers were the victims of the incident, having been forcibly prevented from entering its camp. However, it was later <a href=\"https:\/\/www.la-razon.com\/economia\/2018\/02\/02\/sinohydro-asume-pago-de-salarios-adeudados-por-tnt-y-se-levantan-las-protestas-en-padilla\/\">reported<\/a> to have paid the missed wages and agreed to remove the employee involved in the alleged assault from the project.<\/p>\n\n\n\n<div class=\"wp-block-cd-article-image aligncenter block--article-image block--article-image--article\" itemscope itemtype=\"http:\/\/schema.org\/ImageObject\"><div class=\"block--article-image__column\"><div class=\"hide-expand block--article-image__image\"><img class=\"lazy\" data-src=\"https:\/\/dialogue.earth\/content\/uploads\/2024\/09\/tunnel_El-Sillar_doble-via_Bolivia_Agencia-Boliviana-de-Informacion.jpg\" data-srcset=\"https:\/\/dialogue.earth\/content\/uploads\/2024\/09\/tunnel_El-Sillar_doble-via_Bolivia_Agencia-Boliviana-de-Informacion-768x576.jpg 768w, https:\/\/dialogue.earth\/content\/uploads\/2024\/09\/tunnel_El-Sillar_doble-via_Bolivia_Agencia-Boliviana-de-Informacion-1024x769.jpg 1024w, https:\/\/dialogue.earth\/content\/uploads\/2024\/09\/tunnel_El-Sillar_doble-via_Bolivia_Agencia-Boliviana-de-Informacion.jpg 1600w\" data-sizes=\"(max-width: 600px) 768px, (max-width: 1024px) 1024px, 1600px\" alt=\"well lit concrete tunnel\"\/><\/div><div class=\"block--article-image__content\"><div itemprop=\"caption\" class=\"block--article-image__caption\">A tunnel under construction in Cochabamba, part of the El Sillar dual carriageway project. A company subcontracted by Sinohydro for this project was sued for failing to comply with labour and industrial safety regulations (Image: Agencia Boliviana de Informaci\u00f3n)<\/div><\/div><\/div><meta itemprop=\"contentUrl\" content=\"https:\/\/dialogue.earth\/content\/uploads\/2024\/09\/tunnel_El-Sillar_doble-via_Bolivia_Agencia-Boliviana-de-Informacion.jpg\"\/><meta itemprop=\"contentSize\" content=\"690 KB\"\/><meta itemprop=\"height\" content=\"1201\"\/><meta itemprop=\"width\" content=\"1600\"\/><meta itemprop=\"author\"\/><meta itemprop=\"representativeOfPage\" content=\"true\"\/><\/div>\n\n\n\n<p>In another project, the El Sillar dual carriageway \u2013 which links Santa Cruz with Cochabamba \u2013 Mikenny, a separate company subcontracted by Sinohydro, <a href=\"https:\/\/www.mintrabajo.gob.bo\/?p=7537\">was also sued<\/a> for \u201cnon-compliance with labour and industrial safety regulations\u201d in 2022. Between 2015 and 2019, the non-profit Centre for Labour and Agrarian Development Studies (Cedla) logged <a href=\"https:\/\/cedla.org\/publicaciones\/ieye\/cuaderno-de-coyuntura-25-empresas-chinas-en-bolivia-denuncias-sobre-derechos-de-los-trabajadores-y-situacion-ambiental-periodo-2015-2019\/\">153 complaints<\/a> against Sinohydro related to labour issues in Bolivia \u2013 the highest amongst 17 Chinese companies active in the country during the period \u2013 and six \u201cconflicting projects\u201d, or ones that have caused environmental and labour conflicts.<\/p>\n\n\n\n<p>The El Sillar project was delivered and opened in November 2023, but subsequently received complaints from the ABC after the press <a href=\"https:\/\/www.lostiempos.com\/actualidad\/pais\/20240512\/doble-sillar-tiene-deterioros-10-sectores-seis-meses-su-entrega\">recorded<\/a> sinkholes and collapses in at least ten sections of the road, leading the authority to demand guarantees from <a href=\"https:\/\/www.opinion.com.bo\/articulo\/cochabamba\/carretera-oriente-6-aspectos-derrumbe-tramo-sillar\/20231213000021930582.html\">Sinohydro<\/a> on repair work. This work is still ongoing, and is close to where the jaguar was struck.<\/p>\n\n\n\n<p>Dialogue Earth attempted to contact representatives of Sinohydro to discuss the issues raised in this article, but was unsuccessful. An exhaustive review of local media showed that the company issues press releases on social issues, but rarely gives interviews. In <a href=\"https:\/\/www.la-razon.com\/lr-article\/obras-del-tramo-de-ivirgarzama-a-ichilo-sufren-retraso-de-un-ano\/\">one of the few<\/a> available, given by a Bolivia branch manager in 2016, he sought to defend the company amidst delays in several of its projects. In December 2023, <a href=\"https:\/\/www.la-razon.com\/economia\/2023\/12\/13\/sinohydro-garantiza-solucion-a-problemas-en-el-sillar-y-sin-costo-para-el-estado\/\">another<\/a> was given by a branch manager stating the company\u2019s <a href=\"https:\/\/www.la-razon.com\/economia\/2023\/12\/13\/sinohydro-garantiza-solucion-a-problemas-en-el-sillar-y-sin-costo-para-el-estado\/\">commitment<\/a> to conducting repair works on the El Sillar project.<\/p>\n\n\n\n<div class=\"wp-block-cd-pull-quote block--pull-quote\"><div class=\"block--pull-quote__wrapper\"><blockquote class=\"block--pull-quote__quote\">Sinohydro has sustainable development policies, but they are little known outside China<\/blockquote><cite class=\"block--pull-quote__cite\">Marco Gandarillas, Latinoam\u00e9rica Sustentable<\/cite><\/div><\/div>\n\n\n\n<p>Both Cecilia Requena, a current senator from the opposition Civic Community party and a noted environmentalist, and the then-deputy Monasterio told Dialogue Earth that they had requested reports from various ministries in relation to the environmental complaints against the Chinese firm.<\/p>\n\n\n\n<p>In June, a month after the incident involving the dismembered jaguar was publicised, Requena sought more information from the Ministry of Government on the nature and progress of the police intervention in the case; from the Ministry of the Environment, to learn more about the environmental licences given to Sinohydro; and from the Ministry of Public Works, to understand the impact on wildlife, among others.
