{"id":60055177,"date":"2024-10-15T17:35:46","date_gmt":"2024-10-15T16:35:46","guid":{"rendered":"https:\/\/dialogue.earth\/?p=60055177"},"modified":"2024-10-18T18:10:40","modified_gmt":"2024-10-18T17:10:40","slug":"environmental-laws-given-pass-in-kashmirs-tourism-drive","status":"publish","type":"post","link":"https:\/\/dialogue.earth\/en\/nature\/environmental-laws-given-pass-in-kashmirs-tourism-drive\/","title":{"rendered":"Environmental laws \u2018given pass\u2019 in Kashmir\u2019s tourism drive"},"content":{"rendered":"\n<p>The Gurez Valley lies on the Indian side of the&nbsp;<a href=\"http:\/\/news.bbc.co.uk\/2\/shared\/spl\/hi\/south_asia\/03\/kashmir_future\/html\/default.stm\">Line of Control<\/a>, which separates the two parts of the former princely state of Jammu &amp; Kashmir between Indian and Pakistani administration.<\/p>\n\n\n\n<p>Its location \u2013 in a militarised zone between two nuclear-armed adversaries \u2013 might be one of the reasons why this area has seen limited infrastructural development. But in the years since Covid-19 emerged, a drive to increase tourism is compromising what is an important ecosystem.<\/p>\n\n\n\n<p>\u201cUncontrolled concrete construction [is] happening in Gurez,\u201d says local resident Muzammil Khan. He recalls when there was just one wooden, six-room guest house in Dawar village. In the last three to four years, \u201cmore than 20 guest houses, 10 multistorey hotels and numerous homestays\u201d have sprung up in the small valley. Khan, 29, presides over the Youth Association of Gurez, an <a href=\"https:\/\/www.facebook.com\/YouthAssociationGurez\/\">NGO<\/a> working to preserve the area\u2019s environment and culture.<\/p>\n\n\n\n<div class=\"wp-block-cd-article-image aligncenter block--article-image block--article-image--article\" itemscope itemtype=\"http:\/\/schema.org\/ImageObject\"><div class=\"block--article-image__column\"><div class=\"hide-expand block--article-image__image\"><img class=\"lazy\" data-src=\"https:\/\/dialogue.earth\/content\/uploads\/2024\/10\/20241014_Tourism-development-in-Kashmir-Gurez-Valley_MuzammilKhan.jpg\" data-srcset=\"https:\/\/dialogue.earth\/content\/uploads\/2024\/10\/20241014_Tourism-development-in-Kashmir-Gurez-Valley_MuzammilKhan-768x576.jpg 768w, https:\/\/dialogue.earth\/content\/uploads\/2024\/10\/20241014_Tourism-development-in-Kashmir-Gurez-Valley_MuzammilKhan-1024x768.jpg 1024w, https:\/\/dialogue.earth\/content\/uploads\/2024\/10\/20241014_Tourism-development-in-Kashmir-Gurez-Valley_MuzammilKhan.jpg 2560w\" data-sizes=\"(max-width: 600px) 768px, (max-width: 1024px) 1024px, 2560px\" alt=\"narrow road with mountain in background\"\/><\/div><div class=\"block--article-image__content\"><div itemprop=\"caption\" class=\"block--article-image__caption\">Environmentalists allege that construction in the Gurez Valley in response to tourism is turning it into a concrete jungle (Image: Muzammil Khan)<\/div><\/div><\/div><meta itemprop=\"contentUrl\" content=\"https:\/\/dialogue.earth\/content\/uploads\/2024\/10\/20241014_Tourism-development-in-Kashmir-Gurez-Valley_MuzammilKhan.jpg\"\/><meta itemprop=\"contentSize\" content=\"1 MB\"\/><meta itemprop=\"height\" content=\"1920\"\/><meta itemprop=\"width\" content=\"2560\"\/><meta itemprop=\"author\"\/><meta itemprop=\"representativeOfPage\" content=\"true\"\/><\/div>\n\n\n\n<p>Khan\u2019s association has no problem with development in the area, only the way it is being done. Arsalam Aslam, another member of the association, tells Dialogue Earth the \u201ccore and immediate demand of our association is that our area should be developed strictly in light of environmental laws\u201d.<\/p>\n\n\n\n<p>Gurez is home to a rich array of flora and fauna, including musk deer, and the endemic fish species that populate the area\u2019s Kishanganga River. Khan says increased tourism and its associated infrastructure will put pressure on these habitats and the river\u2019s water quality, \u201cespecially in the absence of a sewage treatment facility\u201d.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-underused-laws\">Underused laws<\/h2>\n\n\n\n<p>The weak implementation of environmental laws is a significant problem in the Kashmir Valley, according to environmental experts. Faiz Bakhshi, a noted environmentalist, says \u201cthere is nothing wrong\u201d with the Jammu &amp; Kashmir Forest (Conservation) <a href=\"https:\/\/jkforest.gov.in\/assets\/pdf\/act\/J_K_Forest_Conservation_Act.pdf\">Act<\/a> and the Environment (Protection) <a href=\"https:\/\/cpcb.nic.in\/displaypdf.php?id=aG9tZS9lcGEvZXByb3RlY3RfYWN0XzE5ODYucGRm\">Act<\/a>, but \u201cthey are not being implemented strictly.\u201d This, says Bakhshi, \u201cresults in serious environmental damage as it is now being witnessed in <a href=\"https:\/\/kupwara.nic.in\/tourist-place\/tourist-places-bungusvalley\/\">Bungus<\/a> Valley and Gurez\u201d.<\/p>\n\n\n\n<div class=\"wp-block-cd-pull-quote block--pull-quote\"><div class=\"block--pull-quote__wrapper\"><blockquote class=\"block--pull-quote__quote\">What I have observed is that environmental laws are given a pass during tourism infrastructure creation and tourism promotion<\/blockquote><cite class=\"block--pull-quote__cite\">Saleem Beg, conservationist and former director general for tourism in Jammu &amp; Kashmir<\/cite><\/div><\/div>\n\n\n\n<p>Like Gurez, the Bungus Valley is environmentally significant. \u201cThe Bungus Valley is unique in offering the peculiar attributes of a grassland ecosystem typically characterised by short grasses, and habitat to a rich biodiversity of flora and fauna, including musk deer, pheasants and monal,\u201d says Sami Ullah Bhat, an environmental expert and professor at Kashmir University\u2019s environmental science department. He expects improved access and subsequently higher visitor numbers to increase solid waste pollution.&nbsp;<\/p>\n\n\n\n<p>Dialogue Earth also spoke to Saleem Beg, a prominent conservationist and former director general for tourism in Jammu &amp; Kashmir. But today, Bungus is facing a threat like Sonamarg and Doodhpathri [developed tourist destinations].\u201d<\/p>\n\n\n\n<p>Environmental protections are accommodated in the government of Jammu &amp; Kashmir\u2019s tourism <a href=\"https:\/\/jandktourism.jk.gov.in\/pdfs\/TOURISM_POLICY.pdf\">policy<\/a>, established in 2020. It says the tourism department \u201cwill ensure development of sustainable and eco-friendly tourism by considering social and environmental aspects\u201d, and \u201chigh standards of sanitation and hygiene will be maintained in all tourist destinations.\u201d It also says \u201cnew structures and expansions\u201d in \u201cecologically sensitive zones\u201d must be undertaken in accordance with the Forest Conservation Act, the Environment Protection Act, and any other pertinent acts or rules.<\/p>\n\n\n\n<p>In practice, these guidelines are often not followed. That is according to Rasikh Rasool, a local environmental activist who <a href=\"https:\/\/greentribunal.gov.in\/sites\/default\/files\/news_updates\/OBJECTIONS%20BY%20APPICANT%20TO%20REPORT%20OF%20R-3%20IN%20OA%20NO.%20163%20of%202024%20RASIKH%20RASOOL%20BHAT%20VS%20GOVERNMENT%20OF%20UT%20OF%20JAMMU%20AND%20KASHMIR%20THROUGH%20CHIEF%20SECRETARY.pdf\">filed<\/a> a public interest litigation case with India\u2019s National Green Tribunal in May. He seeks its <a href=\"https:\/\/greentribunal.gov.in\/sites\/default\/files\/news_updates\/REPLY%20BY%20DISTRICT%20MINERAL%20OFFICER,%20GEOLOGY%20AND%20MINING%20DEPTT,%20KUPWARA%20IN%20OA%20NO.%20163%20of%202024%20RASIKH%20RASOOL%20BHAT%20VS%20GOVERNMENT%20OF%20UT%20OF%20JAMMU%20AND%20KASHMIR%20THROUGH%20CHIEF%20SECRETARY%20n.pdf\">intervention<\/a> over haphazard construction in and around the Bungus Valley. \u201cThere are clear guidelines in the Forest Conservation Act that a road should be only constructed through a forest if there is no alternative,\u201d explains Rasool. \u201cBut the concerned department of the government chose to construct a road through an unlocked, thick forest, despite two other roads leading to Bungus Valley.\u201d<\/p>\n\n\n\n<p>Rasool alleges the road project included felling at least 25,000 forest trees. However, in its June 2024 <a href=\"https:\/\/www.greentribunal.gov.in\/sites\/default\/files\/news_updates\/REPORT%20BY%20J%20&amp;%20K%20PCC%20IN%20OA%20NO.%20163%20of%202024%20RASIKH%20RASOOL%20BHAT%20VS%20GOVERNMENT%20OF%20UT%20OF%20JAMMU%20AND%20KASHMIR%20THROUGH%20CHIEF%20SECRETARY.pdf\">report<\/a> to the National Green Tribunal, the government acknowledged the removal of \u201c1,023 deodar, kail and fir trees\u201d only.<\/p>\n\n\n\n<p>Furthermore, Rasool says over half a million tourists have visited Bungus in the past two years, without any arrangements in place for treating the resulting solid and liquid waste.<\/p>\n\n\n\n<p>In recent weeks, both the <a href=\"https:\/\/www.greaterkashmir.com\/kashmir\/visitors-leave-behind-trail-of-garbage-in-gurez-valley\/\">local<\/a> and <a href=\"https:\/\/www.livemint.com\/mint-lounge\/ideas\/gurez-tourism-impact-environment-culture-11725020587361.html\">national<\/a> press have highlighted how the Gurez and Bungus regions are suffering from pollution and mismanagement.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-the-impact-of-mass-tourism\">The impact of mass tourism<\/h2>\n\n\n\n<p>At the end of August, India\u2019s tourism minister <a href=\"https:\/\/economictimes.indiatimes.com\/industry\/services\/travel\/tourisms-contribution-to-economy-will-exceed-global-average-in-next-5-years-gajendra-singh-shekhawat-at-et-wlf\/articleshow\/112948989.cms\">proclaimed<\/a> that the sector\u2019s contribution to the national economy would rise from 7.9% to 10% before the end of the decade. Ten days later, Jammu &amp; Kashmir\u2019s commissioner secretary of tourism, Yasha Mudgal, <a href=\"https:\/\/www.greaterkashmir.com\/business\/cs-dulloo-pitches-for-promotion-of-off-beat-tourist-destinations-with-world-bank\/#google_vignette\">pushed<\/a> this agenda at a World Bank gathering, saying: \u201cThe need for development of additional tourist spots [is] to relieve pressure on the traditional ones, which are being explored beyond their carrying capacity.\u201d<\/p>\n\n\n\n<p>Citing Bungus and Gurez, Beg says the government\u2019s promotion of <a href=\"https:\/\/www.greaterkashmir.com\/business\/cs-dulloo-pitches-for-promotion-of-off-beat-tourist-destinations-with-world-bank\/\">lesser-known<\/a> tourist destinations means \u201cecologically sensitive areas are being heavily intervened [in].\u201d<\/p>\n\n\n\n<div class=\"wp-block-cd-article-image aligncenter block--article-image block--article-image--article\" itemscope itemtype=\"http:\/\/schema.org\/ImageObject\"><div class=\"block--article-image__column\"><div class=\"hide-expand block--article-image__image\"><img class=\"lazy\" data-src=\"https:\/\/dialogue.earth\/content\/uploads\/2024\/10\/20240915_Tourism-development-in-Kashmir-Sonamarg_AtharParvaiz.jpg\" data-srcset=\"https:\/\/dialogue.earth\/content\/uploads\/2024\/10\/20240915_Tourism-development-in-Kashmir-Sonamarg_AtharParvaiz-768x576.jpg 768w, https:\/\/dialogue.earth\/content\/uploads\/2024\/10\/20240915_Tourism-development-in-Kashmir-Sonamarg_AtharParvaiz-1024x768.jpg 1024w, https:\/\/dialogue.earth\/content\/uploads\/2024\/10\/20240915_Tourism-development-in-Kashmir-Sonamarg_AtharParvaiz.jpg 2560w\" data-sizes=\"(max-width: 600px) 768px, (max-width: 1024px) 1024px, 2560px\" alt=\"buildings beneath forested hill\"\/><\/div><div class=\"block--article-image__content\"><div itemprop=\"caption\" class=\"block--article-image__caption\">The infrastructural sprawl in Sonamarg has devalued its health resort credentials, according to local environmentalists (Image: Athar Parvaiz)<\/div><\/div><\/div><meta itemprop=\"contentUrl\" content=\"https:\/\/dialogue.earth\/content\/uploads\/2024\/10\/20240915_Tourism-development-in-Kashmir-Sonamarg_AtharParvaiz.jpg\"\/><meta itemprop=\"contentSize\" content=\"2 MB\"\/><meta itemprop=\"height\" content=\"1920\"\/><meta itemprop=\"width\" content=\"2560\"\/><meta itemprop=\"author\"\/><meta itemprop=\"representativeOfPage\" content=\"true\"\/><\/div>\n\n\n\n<div class=\"wp-block-cd-did-you-know alignleft block--did-you-know\"><p class=\"block--did-you-know__title\"><\/p><div class=\"block--did-you-know__content\"><p>Common for Indian cities, Master Plans are government documents designed to regulate land use within urban boundaries<\/p><\/div><\/div>\n\n\n\n<p>Evidence of tourism surges outpacing the government\u2019s efforts to regulate or plan can be seen in traditional sightseeing areas like Sonamarg. A 2020 scientific <a href=\"https:\/\/www.researchgate.net\/publication\/341419311_Use_of_High_Resolution_Remote_Sensing_for_Improving_Environmental_Friendly_Tourism_Master_Planning_in_the_Alpine_Himalaya_A_Case_Study_of_Sonamarg_Tourist_Resort_Kashmir\">study<\/a> used high-resolution satellite data to discover that, by 2015, Sonamarg had already \u201ccrossed the level of the projected developmental activities set out under the Master Plan for 2025\u201d. The plan proposes using approximately 60 hectares of land for infrastructure development through to 2025; the study identified approximately 58 hectares in Sonamarg that had already been used for this purpose by 2015.<\/p>\n\n\n\n<p>Several attempts by email, telephone and in person have been made to obtain comments from Mudgal, as well as from Kashmir\u2019s director of tourism, and its divisional commissioner. At the time of publication, Dialogue Earth had yet to receive a response.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-heeding-the-disasters-of-himachal-and-uttarakhand\">Heeding the disasters of Himachal and Uttarakhand<\/h2>\n\n\n\n<p>In Gurez, Muzammil Khan is concerned about the future. In response to an application for information, local government officials told him Gurez received 46,026 tourists in the 10 weeks between 1 May and early July. Khan estimates that, before 2019, tourist numbers for the whole year would remain in the thousands, and not reach the tens of thousands.<\/p>\n\n\n\n<p>According to <a href=\"https:\/\/dialogue.earth\/en\/author\/sumit-mahar\/\">Sumit Mahar<\/a>, similar tourism surges have \u201calready been disastrous\u201d for the Indian Himalayan state of Himachal Pradesh. Mahar represents the area\u2019s Himdhara Environment Research and Action Collective. He points to the opening of the Atal tunnel in 2020, which enabled annual visitor numbers to grow from 130,000 to 740,000 by <a href=\"https:\/\/www.hindustantimes.com\/cities\/chandigarh-news\/develop-tourism-plan-to-save-lahaul-101722880589940.html\">2022<\/a>. Mahar adds that <a href=\"https:\/\/www.newslaundry.com\/2023\/08\/14\/river-didnt-come-to-us-we-went-to-it-how-nhais-all-weather-highways-eroded-in-himachal\">alleged<\/a> substandard road construction also exacerbated the impacts of the state\u2019s 2023 floods.<\/p>\n\n\n\n<a class=\"wp-block-cd-related-news alignright block--related-news loading\" data-post-id=\"20127446\"><div class=\"block--related-news__image\"><\/div><div class=\"block--related-news__content\"><span class=\"block--related-news__heading\">Recommended<\/span><span class=\"block--related-news__title\"><\/span><\/div><\/a>\n\n\n\n<p>In Uttarakhand, another Himalayan state in India, Mahar claims \u201cmountains were cut indiscriminately\u201d for the Char Dham road project, \u201c<a href=\"https:\/\/www.downtoearth.org.in\/environment\/government-admits-to-have-bypassed-environment-impact-assessments-for-chardham-project-93268\">ignoring<\/a> environmental standards to bring more tourists\u201d. He says \u201cits consequences are witnessed in the form of landslides, cracks [in houses] in villages and the drying up of water sources.\u201d<\/p>\n\n\n\n<p>Mass tourism, observes Beg, \u201ccannot be stopped in a country like ours, where hoteliers, travel agents, the burgeoning middle class and \u2013 above all \u2013 the government is fuelling tourism promotion\u201d. He urges the government \u201cto not facilitate cheap accommodation\u201d as one way to stem the sprawl of low-quality development.<\/p>\n\n\n\n<p>Khan says these are warnings that Kashmir cannot afford to ignore. \u201cThere is an urgent need for controlling and regulating tourism in Gurez Valley. Who will come to see Gurez if this destruction continues?\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Secluded areas are being prepared for tourism growth despite environmental
