{"id":60069658,"date":"2025-02-04T18:25:53","date_gmt":"2025-02-04T18:25:53","guid":{"rendered":"https:\/\/dialogue.earth\/?p=60069658"},"modified":"2025-02-13T14:44:40","modified_gmt":"2025-02-13T14:44:40","slug":"citizens-and-state-at-odds-over-chiles-rucalhue-dam","status":"publish","type":"post","link":"https:\/\/dialogue.earth\/en\/justice\/citizens-and-state-at-odds-over-chiles-rucalhue-dam\/","title":{"rendered":"Citizens and state at odds over Chile\u2019s Rucalhue dam"},"content":{"rendered":"\n<p>Fernanda Purr\u00e1n was raised alongside the Biob\u00edo River in central Chile. She says the river was \u201cpart of our family\u201d, but the arrival of hydropower in the region in the 1990s destroyed that relationship. She says that subsequently, the levels of the waters they swam in would rise at any moment, with no warning as to when a dam\u2019s floodgates would open. \u201cThere have been years of uncertainty and a lot of pain, a lot of anguish.\u201d<\/p>\n\n\n\n<p>Now, another hydropower plant is on the horizon in Biob\u00edo. The Rucalhue <a href=\"https:\/\/seia.sea.gob.cl\/expediente\/ficha\/fichaPrincipal.php?modo=normal&amp;id_expediente=2128925735\">project<\/a> is located less than a kilometre from its namesake village, and 10 kilometres from the communes of Santa B\u00e1rbara and Quilaco. The project involves the construction of a power plant and a reservoir. The latter\u2019s volume will be more than 7 million cubic metres, created by flooding 139 hectares of land.<\/p>\n\n\n\n<p>The 90-megawatt (MW) project would become the fifth hydroelectric plant on the Biob\u00edo, one of Chile\u2019s main rivers, and joins the Ralco (689MW), Pangue (466MW), Angostura (323MW) and Palmucho (34MW) plants.<\/p>\n\n\n\n<div class=\"wp-block-cd-article-image aligncenter block--article-image block--article-image--article\" itemscope itemtype=\"http:\/\/schema.org\/ImageObject\"><div class=\"block--article-image__column\"><div class=\"hide-expand block--article-image__image\"><img class=\"lazy\" data-src=\"https:\/\/dialogue.earth\/content\/uploads\/2025\/02\/Pangue-dam_Biobio-river_Chile_google-earth_airbus-Maxar-Tech-CNES-edited.jpg\" data-srcset=\"https:\/\/dialogue.earth\/content\/uploads\/2025\/02\/Pangue-dam_Biobio-river_Chile_google-earth_airbus-Maxar-Tech-CNES-edited-768x512.jpg 768w, https:\/\/dialogue.earth\/content\/uploads\/2025\/02\/Pangue-dam_Biobio-river_Chile_google-earth_airbus-Maxar-Tech-CNES-edited-1024x682.jpg 1024w, https:\/\/dialogue.earth\/content\/uploads\/2025\/02\/Pangue-dam_Biobio-river_Chile_google-earth_airbus-Maxar-Tech-CNES-edited.jpg 2560w\" data-sizes=\"(max-width: 600px) 768px, (max-width: 1024px) 1024px, 2560px\" alt=\"Satellite image of river\"\/><\/div><div class=\"block--article-image__content\"><div itemprop=\"caption\" class=\"block--article-image__caption\">Satellite image of the Biob\u00edo River, showing the Pangue dam and reservoir in 2025 (Image: Airbus \/ Maxar Technologies \/ CNES via Google Earth)<\/div><\/div><\/div><meta itemprop=\"contentUrl\" content=\"https:\/\/dialogue.earth\/content\/uploads\/2025\/02\/Pangue-dam_Biobio-river_Chile_google-earth_airbus-Maxar-Tech-CNES-edited.jpg\"\/><meta itemprop=\"contentSize\" content=\"2 MB\"\/><meta itemprop=\"height\" content=\"1706\"\/><meta itemprop=\"width\" content=\"2560\"\/><meta itemprop=\"author\"\/><meta itemprop=\"representativeOfPage\" content=\"true\"\/><\/div>\n\n\n\n<p>Although an environmental resolution in 2016 granted the Rucalhue plant a <a href=\"https:\/\/iclac.cl\/publicaciones\/policy-brief\/central-hidroelectrica-rucalhue-region-del-biobio\/\">mostly favourable<\/a> qualification, the project had until recently failed to secure construction permission. This is because two protected species of plants, the guindo santo shrub (<em>Eucryphia glutinosa<\/em>) and the naranjillo tree (<em>Citronella mucronata<\/em>)<em>, <\/em>are found within the area of its potential footprint.<\/p>\n\n\n\n<p>In October 2023, Chile\u2019s National Forestry Corporation (Conaf) <a href=\"https:\/\/conaf-dev.lazos.cl\/centro-documental\/resolucion-982-2023\/\">classified<\/a> the new hydropower plant as being of \u201cnational interest\u201d. A year later, Conaf <a href=\"https:\/\/www.terram.cl\/central-rucalhue-conaf-da-luz-verde-a-faenas-de-cuestionado-proyecto-hidroelectrico-en-el-rio-biobio\/\">approved<\/a> the project\u2019s management plans, which was the final hurdle. Construction works \u2013 which include the felling of guindo santo shrubs and naranjillo trees, as well as disrupting the associated ecosystems \u2013 can now begin.<\/p>\n\n\n\n<p>The USD 240 million project is being overseen by Rucalhue Energ\u00eda, a Chilean company owned by the China International Water and Electric Corporation (CWE). A subsidiary of the China Three Gorges Corporation, this is CWE\u2019s <a href=\"https:\/\/english.cwe.cn\/gsyw\/ywly\/dl\/mz\/202409\/t20240923_267152.html\">first<\/a> project in Chile.<\/p>\n\n\n\n<p>The plant is part of the government\u2019s <a href=\"https:\/\/www.economia.gob.cl\/wp-content\/uploads\/2024\/09\/plan-de-fortalecimiento-industrial-del-biobio.pdf\">Biob\u00edo Industrial Strengthening Plan<\/a>, which was launched in response to the September 2024 <a href=\"https:\/\/www.swissinfo.ch\/spa\/sider%C3%BArgica-chilena-huachipato-inicia-el-cierre-definitivo-con-el-apagado-de-su-alto-horno\/87559240\">closure<\/a> of Huachipato. Once Chile\u2019s biggest steel plant, Huachipato turned the coastal city of Talcahuano into one of the Biob\u00edo region\u2019s main industrial centres.<\/p>\n\n\n\n<p>Currently, <a href=\"https:\/\/zenodo.org\/records\/10462516\">13<\/a> hydropower plants operate in the Biob\u00edo Basin, mostly built in the 1990s. The basin extends for about <a href=\"https:\/\/laderasur.com\/articulo\/rio-biobio-una-historia-de-degradacion-y-sacrificio\/?srsltid=AfmBOooZ6Zf3d_XA8aqTT19xk5W8LGmdSKYCbYz6VajKeUxmJk5mK_sP\">380 kilometres<\/a> and the area generates about 38% of Chile\u2019s hydropower.<\/p>\n\n\n\n<a class=\"wp-block-cd-related-news alignright block--related-news loading\" data-post-id=\"60014869\"><div class=\"block--related-news__image\"><\/div><div class=\"block--related-news__content\"><span class=\"block--related-news__heading\">Recommended<\/span><span class=\"block--related-news__title\"><\/span><\/div><\/a>\n\n\n\n<p>These power plants have long faced resistance from communities living in the area, including Indigenous peoples, who claim they have destroyed both local ecosystems and the area\u2019s social fabric. Residents of the Alto Biob\u00edo commune were displaced by the nearby Ralco dam in the early 2000s. \u201cThe people who were relocated from Ralco, and moved further downstream, no longer have communication with the people who live in Alto Biob\u00edo,\u201d claims Purr\u00e1n. \u201cThey kind of formed their own communities \u2013 they live in their own spaces, and act individually and silently.\u201d<\/p>\n\n\n\n<p>According to Juan Pablo Boisier, a researcher at the University of Chile\u2019s Center for Climate and Resilience Research (<a href=\"https:\/\/www.cr2.cl\/eng\/\">CR2<\/a>), these hydropower plants are not just important for renewable electricity generation, but also for water supply. He acknowledges, however, the environmental and social impacts associated with the necessary landscape modifications.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-citizen-participation-and-prior-consultation\">Citizen participation and prior consultation<\/h2>\n\n\n\n<p>The local community\u2019s main criticisms of the Rucalhue project have been the lack of civic participation and the failure to carry out a comprehensive consultation with Indigenous people. According to Javier Arroyo, a lawyer and member of the Latin American Observatory of Environmental Conflicts (<a href=\"https:\/\/olca.cl\/oca\/index.php\">Olca<\/a>), this constitutes a breach of international commitments signed by Chile, including <a href=\"https:\/\/www.ilo.org\/es\/media\/443541\/download\">Convention 169<\/a> of the International Labour Organization \u2013 or the Declaration on the Rights of Indigenous Peoples \u2013 as well as the Escaz\u00fa Agreement, the Latin American environmental treaty <a href=\"https:\/\/dialogue.earth\/en\/justice\/environmental-litigation-in-latam-and-caribbean-bolstered-by-escazu-treaty\/\">enshrining rights to environmental information and justice<\/a>.<\/p>\n\n\n\n<a class=\"wp-block-cd-related-news alignright block--related-news loading\" data-post-id=\"60045385\"><div class=\"block--related-news__image\"><\/div><div class=\"block--related-news__content\"><span class=\"block--related-news__heading\">Recommended<\/span><span class=\"block--related-news__title\"><\/span><\/div><\/a>\n\n\n\n<p>An Indigenous consultation for the project did take place, <a href=\"https:\/\/www.sea.gob.cl\/noticias\/sea-region-del-biobio-finalizo-proceso-de-consulta-indigena\">concluding<\/a> in 2016, but the process was <a href=\"https:\/\/agendapropia.co\/articles\/la-defensa-del-ro-bo-bo-historias-de-memoria-y-resistencia-de-los-mapuche-pewenche\">accused<\/a> of being flawed and manipulated to favour the project, with social and environmental organisations calling for a fresh consultation. In the time since, the guindo santo and naranjillo, both classified as \u201cvulnerable\u201d, were granted protections under a <a href=\"https:\/\/www.bcn.cl\/leychile\/navegar?idNorma=274894&amp;idVersion=2023-09-06&amp;idParte=8676418\">2023 law<\/a> meaning special authorisation was required for their felling.<\/p>\n\n\n\n<p>The Ministry of Social Development was <a href=\"https:\/\/resumen.cl\/articulos\/fuera-de-todo-plazo-ministerio-de-desarrollo-social-respaldo-interes-nacional-de-proyecto-central-rucalhue\">asked<\/a> by Conaf to advise on the need for a new consultation, but for reasons unknown, this did not happen. Conaf ultimately decided to authorise the project in any case.<\/p>\n\n\n\n<p>\u201cIn this process, two negligences occurred,\u201d claims Arroyo. \u201cThe first is that Conaf issued the declaration of national interest, without even having [received] a report from the Ministry of Social Development on whether it was necessary to carry out the Indigenous consultation. And the second is the profound delay on the part of the Ministry of Social Development in pronouncing\u2026 on the possible Indigenous consultation, and also its lack of consideration [of the consultation] to date.\u201d<\/p>\n\n\n\n<p>Dialogue Earth spoke to Bernardo Reyes, president of the NGO Forest Ethics Foundation (FEB), about these alleged oversights. \u201cThe lack of transparency and citizen participation in the decision-making on the project is unacceptable,\u201d says the activist.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-the-management-plan\">The management plan<\/h2>\n\n\n\n<p>Conaf spokespersons told Dialogue Earth that the management plan approved for the dam \u201ccomplied with all the technical and legal requirements [necessary] to be processed\u201d. They point to its compensatory measures, such as the rehabilitation of grasslands with native species (including the naranjillo and guindo santo flora) and the restoration of degraded ecosystems.<\/p>\n\n\n\n<p>Dialogue Earth attempted to contact Rucalhue Energ\u00eda for comment but did not receive a response. On its website, the company says that it will \u201cintervene\u201d in the cases of 392 naranjillos and 139 guindos santos \u2013 that is, cut them down \u2013 but will also <a href=\"https:\/\/rucalhuenergia.cl\/sobre-el-proyecto\/\">plant<\/a> 1,334 and 545 of each species respectively. It also claims 43,268 \u201ccompanion species\u201d will be planted.<\/p>\n\n\n\n<div class=\"wp-block-cd-pull-quote block--pull-quote\"><div class=\"block--pull-quote__wrapper\"><blockquote class=\"block--pull-quote__quote\">The project lends itself to abuse; anything can be understood as being in the national interest. We don\u2019t have an energy-generation problem for them to declare this as such<\/blockquote><cite class=\"block--pull-quote__cite\">Pamela Poo, public policy director, Ecosur Foundation<\/cite><\/div><\/div>\n\n\n\n<p>The political scientist <a href=\"https:\/\/dialogue.earth\/en\/author\/pamelapoo\/\">Pamela Poo<\/a> has a gloomy view of these proposals. Poo, who directs public policy and advocacy for the sustainable development NGO Ecosur Foundation, criticises Conaf and claim it has a role in influencing the policies of Chile\u2019s president, Gabriel Boric: \u201cIt is a clear example of how the government is willing to sacrifice the environment for economic gain, without considering the long-term consequences for local communities and the wider ecosystem.\u201d<\/p>\n\n\n\n<p>Poo also criticises the \u201cnational interest\u201d framing of the project: \u201cIt lends itself to abuse; anything can be understood as being in the national interest. We don\u2019t have an energy-generation problem for them to declare this as such,\u201d she notes. \u201cWe are mortgaging the future of ecosystems and future generations.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-community-resilience\">Community resilience<\/h2>\n\n\n\n<p>Some locals have sought to stop the project, <a href=\"https:\/\/www.elmostrador.cl\/cultura\/2021\/07\/27\/desalojan-toma-contra-la-construccion-de-la-central-hidroelectrica-rucalhue-en-el-biobio\/\">obstructing<\/a> and even occupying associated riverbanks to prevent logging and the passage of heavy machinery. They allege violence and an absence of effort from the company to create spaces for dialogue.<\/p>\n\n\n\n<p>\u201cA group [of locals] spent five months on the site where the company is now working, preventing them from carrying out their first construction,\u201d says Purr\u00e1n. \u201cThe [police] response was to violently evict them&#8230; The same thing happened again later, with injured comrades.\u201d<\/p>\n\n\n\n<p>The actions of the company, says Reyes, are generating multiple impacts that go beyond the construction of the dam alone: \u201cWe are not only talking about economic or environmental impact. The multiple cultures of the area are also being affected. There is a profound conflict with the project, with a lack of transparency, logging of native species, lack of participation and fragmentation of communities.\u201d<\/p>\n\n\n\n<p>Construction of the Rucalhue hydroelectric project is underway and is expected to be <a href=\"https:\/\/sabes.cl\/2024\/08\/11\/reiniciaran-construccion-de-central-hidroelectrica-rucalhue-empresa-pagara-patentes-en-santa-barbara-y-quilaco\/\">completed<\/a> within three years. Meanwhile, the affected local communities, who describe having grown tired and less united, are once again having to live with a hydroelectric project on the Biob\u00edo River.<\/p>\n\n\n\n<p>Purr\u00e1n says many of the affected people no longer have the mental strength to act: \u201cThey say: \u2018do whatever you want, please leave me alone and do whatever you want and please don\u2019t bother us.\u2019 We have heard that response\u2026 there are also other people who have been opposing, but they are in the
