{"id":60077409,"date":"2025-04-17T19:05:44","date_gmt":"2025-04-17T18:05:44","guid":{"rendered":"https:\/\/dialogue.earth\/?p=60077409"},"modified":"2025-04-25T11:38:16","modified_gmt":"2025-04-25T10:38:16","slug":"indias-forests-are-disappearing-but-not-on-paper","status":"publish","type":"post","link":"https:\/\/dialogue.earth\/en\/forests\/indias-forests-are-disappearing-but-not-on-paper\/","title":{"rendered":"India\u2019s forests are disappearing, but not on paper"},"content":{"rendered":"\n<p>On the afternoon of March 30, bulldozers rolled into Kancha Gachibowli, a lush, 400-acre tract of forested land in Hyderabad, a city in India\u2019s southern Telangana state. Trees were felled throughout the night. <a href=\"https:\/\/www.instagram.com\/p\/DH2QsxMz7Ai\/\">Videos<\/a> taken at the site showed the razing taking place, with sounds of distressed animals echoing in the background.<\/p>\n\n\n\n<p>The land was set to be auctioned off by the Telangana government to make way for an IT park. The urban forest, <a href=\"https:\/\/www.outlooktraveller.com\/whats-new\/kancha-gachibowli-forest-issue-and-telangana-deforestation\">home<\/a> to over 730 species of plants, 220 species of birds, and several mammals and reptiles, is also close to the campus of the University of Hyderabad, whose students have been at the <a href=\"https:\/\/www.thehindu.com\/news\/cities\/Hyderabad\/hyderabad-university-protest-20-students-injured-as-police-resort-to-lathi-charge\/article69403189.ece\">forefront<\/a> of resistance since the felling began. On April 3, the Supreme Court <a href=\"https:\/\/indianexpress.com\/article\/india\/kancha-gachibowli-protests-sc-telangana-government-dialogue-hyderabad-university-students-9923890\/\">ordered<\/a> a halt to the \u201calarming deforestation\u201d.<\/p>\n\n\n\n<p>Like many dense and biodiversity-rich natural forests in India, Kancha Gachibowli does not enjoy legal protection. This is because it is not legally classified as a forest, meaning it does not show up in government records.<\/p>\n\n\n\n<p>This reflects a worrying trend. Across India, forest land is quietly disappearing, often without official acknowledgement of the fact. All this is happening whilst India\u2019s official forest survey, the annual India State of Forests Report (ISFR), claims the country\u2019s forest and tree cover has been increasing.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-how-are-forests-defined-in-india\">How are forests defined in India?<\/h2>\n\n\n\n<p>In India, the administrative definition of forests differs from the ecological and social, notes Kanchi Kohli, an independent researcher on forest governance.<\/p>\n\n\n\n<p>The ISFR considers as \u201cforest cover\u201d all land over one hectare with a canopy density above 10%, regardless of legal status or ecological value. This means it counts plantations, orchards, bamboo, and palm as forests.<\/p>\n\n\n\n<p>In 2023, it <a href=\"https:\/\/fsi.nic.in\/uploads\/isfr2023\/isfr_book_eng-vol-1_2023.pdf\">reported<\/a> an increase of 1,446 sq km in total forest and tree cover that year compared to 2021. Figures from NGOs paint a different picture, however. According to data from <a href=\"https:\/\/www.globalforestwatch.org\/dashboards\/country\/IND\/?category=forest-change&amp;location=WyJjb3VudHJ5IiwiSU5EIl0%3D&amp;map=eyJjYW5Cb3VuZCI6dHJ1ZX0%3D\">Global Forest Watch<\/a>, from 2021 to 2023, India lost 4,380 sq km of total tree cover with canopy density above 10%, which includes forest. During this period, 94% of tree loss happened in natural forests.<\/p>\n\n\n\n<p>A similar discrepancy was seen for data from 2019-2021, where the ISFR claimed a 2,261 sq km rise in combined <a href=\"https:\/\/pib.gov.in\/PressReleaseIframePage.aspx?PRID=1914422\">forest<\/a> and <a href=\"https:\/\/pib.gov.in\/PressReleasePage.aspx?PRID=2035037\">tree<\/a> cover. Meanwhile, Global Forest Watch recorded a 4,270 sq km loss in total tree cover canopy density above 10% for the same period. A Ministry of Environment, Forest and Climate Change <a href=\"https:\/\/pib.gov.in\/PressReleasePage.aspx?PRID=2035037#:~:text=The%20tree%20cover%20increased%20by,tree%20cover%20does%20not%20arise.\">press release<\/a> attributed these \u201ccontradictions\u201d to differing definitions of forest and tree cover between the reports.<\/p>\n\n\n\n<p>As of March 2024, over <a href=\"https:\/\/www.thehindu.com\/sci-tech\/energy-and-environment\/forest-areas-encroached-in-25-states-union-territories-mp-assam-worst-affected-government-report\/article69399037.ece\">13,000 sq km<\/a> of land is under encroachment in the country, according to data from the Union Environment Ministry.<\/p>\n\n\n\n<p>\u201cAny land with tree cover on it is considered forest [by the ISFR] to show there is an optimum state of forest in the country, which responds to both national policies and international negotiations,\u201d says Kohli. Since 1952, India has had a <a href=\"https:\/\/ifs.nic.in\/Dynamic\/book\/page3.pdf\">policy<\/a> of maintaining 33% of its geographical area as forest cover.<\/p>\n\n\n\n<a class=\"wp-block-cd-related-news alignright block--related-news loading\" data-post-id=\"20108035\"><div class=\"block--related-news__image\"><\/div><div class=\"block--related-news__content\"><span class=\"block--related-news__heading\">Recommended<\/span><span class=\"block--related-news__title\"><\/span><\/div><\/a>\n\n\n\n<p>Such surveys fail to address the quality of the forest or take into account the social and cultural practices around it, Kohli notes, such as the importance of the forests to the way of life of the <a href=\"https:\/\/dialogue.earth\/en\/justice\/van-gujjars-help-conserve-forests-but-are-deprived-of-rights\/\">Van Gujjars<\/a>, a pastoralist community. Their traditional practices, such as lopping \u2013 or pruning of trees for agricultural and conservation purposes \u2013 play a crucial role in forest regeneration. But the Van Gujjars\u2019 contributions and practices are not recognised under the law, nor in official forest surveys.<\/p>\n\n\n\n<p>Although deforestation is acknowledged in the surveys, \u201cit\u2019s often balanced [out] by ambiguous inclusions like trees [planted] outside forest areas, or plantations, and land diverted for other uses legally remains forests\u201d, she says.<\/p>\n\n\n\n<p>\u201cThere is no hiding that deforestation is taking place, and some of it is legally admissible,\u201d Kohli adds. \u201cThe question [is,] what are you including as forest in lieu of that? It\u2019s land-for-land compensation.\u201d<\/p>\n\n\n\n<p>Deforestation is not the only reason India\u2019s forests are disappearing. The challenge also lies in whether the forests exist on paper. And while monoculture plantations and degraded lands are often recorded as forest gain, dense forests like Kancha Gachibowli are absent from government records. The Supreme Court raised this issue in a hearing in March, <a href=\"https:\/\/www.tribuneindia.com\/news\/comment\/scs-forest-conservation-order-exposes-years-of-official-neglect\/\">noting<\/a> that many forests have been left out of official records and <a href=\"https:\/\/api.sci.gov.in\/supremecourt\/2023\/40155\/40155_2023_2_6_59890_Order_04-Mar-2025.pdf\">instructing<\/a> states to set up expert committees to identify \u201cforest-like areas\u201d, unclassified forest lands or community forest lands within six months.<\/p>\n\n\n\n<div class=\"wp-block-cd-pull-quote block--pull-quote\"><div class=\"block--pull-quote__wrapper\"><blockquote class=\"block--pull-quote__quote\">The Forest Conservation Act 1980 was one of the few tools communities had to regulate how forested land is used<\/blockquote><cite class=\"block--pull-quote__cite\">Kanchi Kohli, independent researcher on forest governance<\/cite><\/div><\/div>\n\n\n\n<p>Kohli says India\u2019s forested land is not classified as such largely because of political interests or differences in how states record land.<\/p>\n\n\n\n<p>The Telangana government, which was granted full ownership of Kancha Gachibowli by the Supreme Court in 2024, said the forest had never been <a href=\"https:\/\/www.thehindu.com\/news\/cities\/Hyderabad\/400-acre-kancha-gachibowli-land-was-not-shown-as-forest-in-revenue-or-forest-records\/article69403327.ece\">classified<\/a> as such in its records. A 1996 Supreme Court ruling, known as the Godavarman judgment, <a href=\"https:\/\/indiankanoon.org\/doc\/298957\/\">defined<\/a> forested land by its characteristics rather than its official designation. Under this ruling, Kancha Gachibowli is considered a \u201cdeemed forest\u201d \u2013 a tract of land with ecological characteristics of a forest that is not officially classified as such by the government. But the Forest Conservation (Amendment) Act of 2023 removed protections for deemed forests, instead restricting conservation to \u201clegally notified forests\u201d. This has left them vulnerable to clearance.<\/p>\n\n\n\n<p>Kohli acknowledges that there are communities that stand to benefit from this amendment. This includes those that have been disincentivised to plant trees or engage in agroforestry because of the prior permissions required for legally notified forests. However, broadly, \u201cwhat this amendment has ended up doing is trying to unlock those lands which can be put to [use for] other purposes\u201d, she says. \u201cPeople are concerned because the Forest Conservation Act 1980 [the original law] was one of the few tools communities had to regulate how forested land is used.\u201d The amendment is currently being <a href=\"https:\/\/www.scobserver.in\/wp-content\/uploads\/2023\/12\/1-FCA-Writ-Petition-court-version-1-1-1-191-1.pdf\">challenged<\/a> in the Supreme Court by a group of petitioners that includes several former senior officers from the Indian Forest Service.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-a-nationwide-pattern-of-diminishing-forests\">A nationwide pattern of diminishing forests<\/h2>\n\n\n\n<p>Similar situations have unfolded elsewhere in India. In September 2024,&nbsp;the Supreme Court <a href=\"https:\/\/www.hindustantimes.com\/cities\/delhi-news\/schalts-tree-felling-for-rly-facility-at-dwarka-101726625536043.html\">halted<\/a> the felling of nearly 25,000 trees in the Shahabad Mohammadpur deemed forest in Delhi\u2019s Dwarka neighbourhood for the expansion of a railway facility. Prior to the ruling, the construction activity had sparked <a href=\"https:\/\/www.landconflictwatch.org\/conflicts\/dwarka-residents-protest-rail-terminal-on-forest-land-demand-protected-status\">protests<\/a> and <a href=\"https:\/\/www.downtoearth.org.in\/forests\/delhis-dwarka-rail-terminal-petition-shows-that-citizen-activism-is-vital-to-protect-loosely-defined-deemed-forests\">legal appeals<\/a>.<\/p>\n\n\n\n<div class=\"wp-block-cd-article-image aligncenter block--article-image block--article-image--article\" itemscope itemtype=\"http:\/\/schema.org\/ImageObject\"><div class=\"block--article-image__column\"><div class=\"hide-expand block--article-image__image\"><img class=\"lazy\" data-src=\"https:\/\/dialogue.earth\/content\/uploads\/2025\/04\/Activists-protest-against-coal-giant-Adani-and-the-destruction-of-the-Hasdeo-Forest-in-India_Vuk-Valcic_Alamy_2J7XC0D.jpg\" data-srcset=\"https:\/\/dialogue.earth\/content\/uploads\/2025\/04\/Activists-protest-against-coal-giant-Adani-and-the-destruction-of-the-Hasdeo-Forest-in-India_Vuk-Valcic_Alamy_2J7XC0D-768x534.jpg 768w, https:\/\/dialogue.earth\/content\/uploads\/2025\/04\/Activists-protest-against-coal-giant-Adani-and-the-destruction-of-the-Hasdeo-Forest-in-India_Vuk-Valcic_Alamy_2J7XC0D-1024x712.jpg 1024w, https:\/\/dialogue.earth\/content\/uploads\/2025\/04\/Activists-protest-against-coal-giant-Adani-and-the-destruction-of-the-Hasdeo-Forest-in-India_Vuk-Valcic_Alamy_2J7XC0D.jpg 2560w\" data-sizes=\"(max-width: 600px) 768px, (max-width: 1024px) 1024px, 2560px\" alt=\"A group of people holding signs protesting outside the court\"\/><\/div><div class=\"block--article-image__content\"><div itemprop=\"caption\" class=\"block--article-image__caption\">Activists gather outside the Indian High Commission in London to protest conglomerate Adani Group\u2019s coal mining activities in Hasdeo Arand, central India\u2019s largest unfragmented forest (Image: Vuk Valcic \/ Alamy)<\/div><\/div><\/div><meta itemprop=\"contentUrl\" content=\"https:\/\/dialogue.earth\/content\/uploads\/2025\/04\/Activists-protest-against-coal-giant-Adani-and-the-destruction-of-the-Hasdeo-Forest-in-India_Vuk-Valcic_Alamy_2J7XC0D.jpg\"\/><meta itemprop=\"contentSize\" content=\"2 MB\"\/><meta itemprop=\"height\" content=\"1779\"\/><meta itemprop=\"width\" content=\"2560\"\/><meta itemprop=\"author\"\/><meta itemprop=\"representativeOfPage\" content=\"true\"\/><\/div>\n\n\n\n<p>In Haryana state\u2019s Mangar Bani, a known biodiversity hotspot, only 1,132 of its 4,262 acres are <a href=\"https:\/\/www.hindustantimes.com\/india-news\/central-act-amendment-to-benefit-firms-owning-deemed-forest-land-in-aravallis-101696269138769.html\">officially protected<\/a> under the Punjab Land Preservation Act of 1900. Despite past Supreme Court rulings in 2002 and 2004 <a href=\"https:\/\/sanctuarynaturefoundation.org\/public\/article\/mangar-bani-and-other-forests\">affirming<\/a> its forest status, much of the land remains unprotected in official records. Environmental activists allege that the region also faced <a href=\"https:\/\/www.hindustantimes.com\/cities\/gurugram-news\/gurugram-green-activists-allege-trees-felled-illegally-at-mangar-bani-101652726618069.html\">illegal tree felling<\/a> in 2022. In December 2023, the Supreme Court <a href=\"https:\/\/www.hindustantimes.com\/cities\/delhi-news\/sc-tells-haryana-to-ensure-no-damage-at-mangar-bani-area-101700072996834.html\">directed<\/a> the Haryana government to prevent any further damage to the area, the region\u2019s sole primary forest.<\/p>\n\n\n\n<p>It was one of many rulings by the Supreme Court in recent years regarding conservation. In 2024, it <a href=\"https:\/\/www.thehindu.com\/news\/national\/go-back-to-dictionary-meaning-of-forest-supreme-court\/article67864608.ece\">directed<\/a> the government to comply with the \u201cdictionary\u201d definition of forests as upheld in the&nbsp;judgment. In February 2025, while hearing petitions challenging amendments to the Forest Conservation Act, it <a href=\"https:\/\/www.downtoearth.org.in\/forests\/sc-orders-centre-states-to-refrain-from-steps-that-lead-to-reduction-of-forests#:~:text=The%20Supreme%20Court%20while%20hearing,Union%20of%20India%20for%20the\">ordered<\/a> the central and state governments to avoid any actions that would lead to the \u201creduction\u201d of forest land.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-even-notified-forests-are-not-guaranteed-protection\">Even notified forests are not guaranteed protection<\/h2>\n\n\n\n<p>But forests being officially classified as such does not in itself guarantee their safety. Kohli says that even classified forests can still be acquired or diverted for non-forest use. Under <a href=\"https:\/\/prsindia.org\/files\/bills_acts\/bills_parliament\/2005\/bill53_2007010153_Handbook_of_Forest_Conservation_Act_1980_and_Forest_Conservation_Rules_2003.pdf\">Section 2<\/a> the Forest Conservation Act, forest land can be used for other purposes, such as infrastructure projects or mining, if prior approval is secured from central government.<\/p>\n\n\n\n<p>An example of this is the mining currently taking place in central India\u2019s largest unfragmented forest, the Hasdeo Arand. In 2009, the environment ministry categorised Hasdeo Arand as a \u201cno-go zone\u201d for mining because of its rich forest cover. But just two years later, the Parsa East and Kanta Basan (PEKB) coal mine <a href=\"https:\/\/www.landconflictwatch.org\/conflicts\/government-approves-coal-mining-in-biodiversity-rich-hasdeo-arand-forest-in-chhattisgarh?\">received initial forest clearance<\/a> permission, and in March 2012, it was granted <a href=\"https:\/\/forestsclearance.nic.in\/writereaddata\/AdditionalInformation\/AddInfoSought\/0_0_111111250121818362018FC.pdf\">stage two clearance<\/a> permission, allowing the use of <a href=\"https:\/\/greentribunal.gov.in\/sites\/default\/files\/news_updates\/REPORT%20BY%20STATE%20OF%20CHHATTISGARH%20IN%20OA%20NO.%2059%20of%202024%20NEWS%20ITEM%20TITLED%20DEFORESTATION%20FOR%20MINING%20RESUMES%20IN%20HASDEO%20LOCALS%20ACTIVISTS%20ALLEGE%20DETENTION%20APPEARING%20IN%20THE%20HINDU%20DATED%2022.12.2023.pdf\">1,898 hectares<\/a> of forest land for the mine. So far, <a href=\"https:\/\/thewire.in\/environment\/94460-trees-felled-in-chhattisgarhs-hasdeo-forest-273757-more-to-go-government-tells-parliament\">94,460 trees have been felled<\/a>, Bhupender Yadav, minister of environment, forest and climate change, told Parliament in December.<\/p>\n\n\n\n<p>A 2021 Indian Council of Forestry Research and Education (ICFRE) report, cited in an <a href=\"https:\/\/greentribunal.gov.in\/sites\/default\/files\/news_updates\/AFFIDAVIT BY R-4 RRVUNL IN IA NO. 137 of 2024 IN OA NO. 59 of 2024 NEWS ITEM TITLED DEFORESTATION FOR MINING RESUMES IN HASDEO LOCALS ACTIVISTS ALLEGE DETENTION.pdf\">affidavit<\/a> submitted in response to concerns raised by a member of the Nature Conservation Society, identified a number of rare, endangered and threatened species of flora and fauna whose habitat was in the PEKB coal mine. The Wildlife Institute of India, which was consulted by the ICFRE for its report, recommended that no mining be permitted in the region, except in the part of the PEKB mine in Hasdeo Arand where it is already ongoing, due to the area\u2019s \u201cirreplaceable, rich biodiversity and socio-cultural values\u201d. But in March 2022, the Chhattisgarh state government <a href=\"https:\/\/www.hindustantimes.com\/india-news\/250k-trees-to-be-cut-in-hasdeo-forest-as-second-phase-of-mining-commences-101725082866615.html\">approved<\/a> the second phase of mining for the PEKB coal mine, granting final forest clearance despite <a href=\"https:\/\/www.bbc.com\/news\/world-asia-india-64949877\">resistance<\/a> from the region\u2019s Indigenous communities.<\/p>\n\n\n\n<div class=\"wp-block-cd-pull-quote block--pull-quote\"><div class=\"block--pull-quote__wrapper\"><blockquote class=\"block--pull-quote__quote\">It\u2019s not just the law on paper, but the rationality and process, and whether these laws stay true to their original intent, that really matters<\/blockquote><cite class=\"block--pull-quote__cite\">Kanchi Kohli<\/cite><\/div><\/div>\n\n\n\n<p>On April 16, the Supreme Court <a href=\"https:\/\/indianexpress.com\/article\/india\/sc-telangana-hyderabad-university-kancha-gachibowli-trees-9947091\/\">asked<\/a> the Telangana government to come up with a plan to restore the 100 acres of trees in Kancha Gachibowli that had been felled, and take immediate steps to protect the affected wildlife.&nbsp;On May 15, the Supreme Court will hear what is being done to protect the animals that lost their habitat following the tree felling.<\/p>\n\n\n\n<p>From Hasdeo Arand to Dwarka and Mangar Bani, each ecologically rich region faces a different challenge: absence of classification, diversion for development despite legal protection and ignorance towards community voices. This reveals a disconnect between the ecological and social value of the forested land and legal recognition.<\/p>\n\n\n\n<p>\u201cIt\u2019s not just the law on paper, but the rationality and process,
