Instead, many countries have joined forces to sanction vessels engaging in illegal, unreported and unregulated fishing where they land their catch: at the world\u2019s ports.<\/p>\n\n\n\n<p>The more nations that block such fishing vessels from their ports, the higher their operating costs become, as they are forced to motor to less-scrutinised docks to land fish. &nbsp;<\/p>\n\n\n\n<p>Last month, China confirmed its <a href=\"https:\/\/dialogue.earth\/en\/digest\/china-joins-major-treaty-to-curb-illegal-fishing\/\">commitment<\/a> to such efforts when it became a member of the legally binding UN Agreement on Port State Measures (<a href=\"https:\/\/www.fao.org\/port-state-measures\/en\/\">PSMA<\/a>). This treaty requires signatories to inspect foreign fishing vessels, verify registrations and deny entry to those suspected of illegal activity.<\/p>\n\n\n\n<div class=\"wp-block-cd-accordion block--accordion\"><span class=\"block--accordion__title\">The Port State Measures process<\/span><div class=\"block--accordion__content\"><div class=\"block--accordion__content__inner\">\n<p>The PSMA is the first legally binding international agreement to tackle&nbsp;<a href=\"https:\/\/dialogue.earth\/en\/conservation\/11813-explainer-illegal-unreported-and-unregulated-fishing\/\">illegal, unreported and unregulated<\/a>&nbsp;(IUU) fishing.<\/p>\n\n\n\n<p>For one year following its negotiation in 2009, the agreement was open for countries to sign up to. These signatory countries had then to ratify the treaty, by sending a formal document to the UN Food and Agriculture Organization (FAO), and becoming an official party to the treaty. Countries that did not sign up to the PSMA during the one-year period can still become a party to it, but this process is termed \u201cacceding\u201d rather than ratifying. The obligations for both groups are identical.<\/p>\n\n\n\n<p>In June 2016, enough countries&nbsp;had become official parties for the&nbsp;PSMA to come into force.<\/p>\n<\/div><\/div><\/div>\n\n\n\n<p>A UK-led study of 2017 data <a href=\"https:\/\/cbe.miis.edu\/cgi\/viewcontent.cgi?article=1097&amp;context=joce\">found<\/a> 14 of the world\u2019s 15 busiest ports to be in China, based on total number of vessel visits. The country also has one of the world\u2019s <a href=\"https:\/\/openknowledge.fao.org\/server\/api\/core\/bitstreams\/9df19f53-b931-4d04-acd3-58a71c6b1a5b\/content\/sofia\/2022\/fishing-fleet.html#:~:text=At%20an%20estimated%20564%20000,China%20and%20the%20European%20Union.\">largest<\/a> fishing fleets, according to research published by the UN in 2022. But by acceding to the PSMA, China has committed to strengthening ports and improving oversight of its fishing vessels.<\/p>\n\n\n\n<p>The significance of this cannot be overstated, especially given the vast size of China\u2019s domestic fleet. More than 99% of visits to Chinese ports are from Chinese vessels. China\u2019s accession has significantly expanded the coverage of the agreement and improved the effectiveness of combating global IUU activities, by preventing illicit catches from landing and circulating through ports.<\/p>\n\n\n\n<p>As a member of the PSMA, China should also cooperate with other member states to ensure that Chinese fishing vessels abide by a port state\u2019s regulatory measures while using foreign ports. We expect China\u2019s move will encourage more non-member states to follow in its footsteps.<\/p>\n\n\n\n<p>While preparing to join the agreement, China has not only gradually strengthened its regulatory capabilities for its ports used by foreign fishing vessels, but also raised the management standards for its domestic fishing ports. That means following the approach of \u201cmanaging vessels at ports\u201d, by implementing systems requiring vessels <a href=\"https:\/\/www.gov.cn\/gongbao\/content\/2019\/content_5397750.htm\">entering and exiting<\/a> ports to declare their catch, gear, etc.; and making them land their catch at <a href=\"https:\/\/dialogue.earth\/en\/ocean\/16063-designated-ports-pave-way-for-sustainable-fishing-chinese-waters\/\">designated ports<\/a> with more enforcement capacity.<\/p>\n\n\n\n<a class=\"wp-block-cd-related-news alignright block--related-news loading\" data-post-id=\"40090180\"><div class=\"block--related-news__image\"><\/div><div class=\"block--related-news__content\"><span class=\"block--related-news__heading\">Recommended<\/span><span class=\"block--related-news__title\"><\/span><\/div><\/a>\n\n\n\n<p>Joining the PSMA is crucial for China\u2019s sustainable fisheries transformation. Its thriving industrial fishing sector has been taken over by foreign-owned or foreign-controlled vessels.<\/p>\n\n\n\n<p>Locally flagged, Chinese vessels are often also registered and licensed in China to benefit from government subsidies. At best, Chinese fleets in other jurisdictions will now be motivated by best practices, although the responsibility of upholding the PSMA is primarily borne by port states [signed up to the agreement].<\/p>\n\n\n\n<a class=\"wp-block-cd-related-news alignright block--related-news loading\" data-post-id=\"60079629\"><div class=\"block--related-news__image\"><\/div><div class=\"block--related-news__content\"><span class=\"block--related-news__heading\">Recommended<\/span><span class=\"block--related-news__title\"><\/span><\/div><\/a>\n\n\n\n<p>All six countries of the Fisheries Committee for the West Central Gulf of Guinea (<a href=\"https:\/\/fcwc-fish.org\/\">FCWC<\/a>) \u2013 Benin, Cote d\u2019Ivoire, Ghana, Liberia, Nigeria and Togo <strong>\u2013<\/strong> have joined the PSMA. These countries share fisheries resources, and by sticking together, they seal gaps in the fight against IUU fishing.<\/p>\n\n\n\n<p>I expect China will step up to join in the PSMA efforts to clamp down on IUU fishing. This agreement is one more piece in a series of measures needed to combat IUU fishing. The success of this agreement also depends on new members joining.<\/p>\n\n\n\n<p>The Chinese fishing fleet in Latin America comprises over 700 vessels. Many of them frequent the ports of Montevideo in Uruguay, and several others in Peru, according to data available on <a href=\"https:\/\/www.skylight.global\/\">Skylight<\/a> and <a href=\"https:\/\/globalfishingwatch.org\/\">Global Fishing Watch<\/a>. Although these two countries are members to the PSMA, the fleet is thought to choose these ports because of the absence of controls, and low costs. Likewise,&nbsp;<a href=\"https:\/\/pescare.com.ar\/confirman-desde-la-empresa-fuzhou-hongdong-la-firma-de-un-acuerdo-trascendental-con-la-provincia-argentina-de-santa-cruz\/#:~:text=Actividad-,Confirman%20desde%20la%20empresa%20Fuzhou%20Hongdong%20la%20firma%20de%20un,provincia%20argentina%20de%20Santa%20Cruz&amp;text=En%20un%20paso%20clave%20para,altos%20representantes%20de%20la%20compa%C3%B1%C3%ADa.\" target=\"_blank\" rel=\"noreferrer noopener\">reports<\/a>&nbsp;show that the Chinese fleets are now actively looking for new ports in South America that are close to their fishing grounds.<\/p>\n\n\n\n<p>Therefore, the countries in the region that have not yet joined the PSMA, notably Argentina, must do so soon. This will allow them to request information and actions to prevent IUU fishing from the other PSMA members.<\/p>\n\n\n\n<p>We have to wait to see whether China actually complies with this agreement and if this delivers measurable results in the water. Campaigners have questioned the nation\u2019s fulfilment of previous fishing pledges in Latin America, including the effectiveness of its self-imposed squid fishing <a href=\"https:\/\/www.theguardian.com\/environment\/2023\/aug\/10\/china-moratoriums-on-fishing-do-nothing-to-protect-squid\">moratorium<\/a>.
