{"id":60088818,"date":"2025-07-07T19:57:47","date_gmt":"2025-07-07T18:57:47","guid":{"rendered":"https:\/\/dialogue.earth\/?p=60088818"},"modified":"2025-07-07T20:01:57","modified_gmt":"2025-07-07T19:01:57","slug":"el-salvadors-environmentalists-lament-reversal-on-mining-ban-as-companies-circle","status":"publish","type":"post","link":"https:\/\/dialogue.earth\/en\/justice\/el-salvadors-environmentalists-lament-reversal-on-mining-ban-as-companies-circle\/","title":{"rendered":"El Salvador\u2019s environmentalists lament reversal on mining ban, as companies circle"},"content":{"rendered":"\n<p>In December 2024, El Salvador\u2019s congress reversed an historic ruling on metal mining to <a href=\"https:\/\/www.asamblea.gob.sv\/node\/13444\">reauthorise<\/a> the activity in the country, seven years after it <a href=\"https:\/\/es.mongabay.com\/2017\/04\/salvador-se-convierte-primer-pais-prohibir-la-mineria-metales\/\">became<\/a> the first nation in the world to explicitly ban it.<\/p>\n\n\n\n<p>Gold mining has a particularly long and troubled history in the Central American country, dating back to the colonial era, and has had profound environmental consequences, such as <a href=\"https:\/\/unes.org.sv\/2025\/03\/26\/cicatrices-de-la-mineria-en-el-rio-san-sebastian\/\">river pollution<\/a> caused by acid drainage from mines.<\/p>\n\n\n\n<p>The new law <a href=\"https:\/\/www.elsalvador.com\/noticias\/nacional\/gobierno-crearia-empresas-para-la-explotacion-minera-con-nueva-ley\/1189423\/2024\/\">states<\/a> that only President Nayib Bukele\u2019s government can authorise or carry out the mining, though it can do so through \u201cinstitutions specifically created or designed for this activity, or through companies in which it has shareholdings\u201d.<\/p>\n\n\n\n<p>Since the law was approved, Vidalina Morales says she has experienced hellish nights. She tells how, after dark, strange vehicles have been driving around her community of Santa Marta, located in El Salvador\u2019s inland department of Caba\u00f1as, an area that has been at the centre of mining conflicts. The endless barking of dogs, stirred by outsiders entering this rural area, has pierced the nighttime silence. Morales is one of the women activists who have been <a href=\"https:\/\/dialogue.earth\/en\/climate\/el-salvadors-environmentalists-see-a-darker-future\/\">speaking out against mining in El Salvador<\/a> for many years. She doesn\u2019t know for sure who is in those vehicles, but her neighbours warn her to \u201cbe careful\u201d.<\/p>\n\n\n\n<p>Morales is president of the Economic and Social Development Association (Ades), an activist organisation through which she and her colleagues have been resisting a range of threats in Santa Marta for over 20 years. She suspects the police may be among those trying to intimidate her by driving through her community at night; Ades has been reporting police harassment in the community for months, something she says has intensified after the reauthorisation of mining.<\/p>\n\n\n\n<a class=\"wp-block-cd-related-news alignright block--related-news loading\" data-post-id=\"60038452\"><div class=\"block--related-news__image\"><\/div><div class=\"block--related-news__content\"><span class=\"block--related-news__heading\">Recommended<\/span><span class=\"block--related-news__title\"><\/span><\/div><\/a>\n\n\n\n<p>The activist says that Ades never stopped its resistance, even after the entry of the mining ban in 2017. In 2023, five Ades members <a href=\"https:\/\/cispes.org\/article\/imprisoned-santa-marta-environmentalists-transferred-house-arrest\">were arrested<\/a> and charged with a crime that allegedly occurred during the Salvadoran Civil War (1980-1992). Ades is convinced this is a reprisal for their anti-mining struggle. The activists have chosen <a href=\"https:\/\/www.laprensagrafica.com\/elsalvador\/Afirman-que-suspension-de-juicio-contra-lideres-ambientalistas-de-Santa-Marta-es-una-estrategia-dilatoria-20250409-0049.html\">not to attend<\/a> recent hearings because they believe there are no guarantees of a fair trial.<\/p>\n\n\n\n<p>Other organisations have also expressed opposition to the new law reauthorising mining. In March, the Catholic Church submitted a petition with around <a href=\"https:\/\/www.laprensagrafica.com\/elsalvador\/Organizaciones-interpondran-demanda-de-inconstitucionalidad-contra-la-mineria-junto-a-57000-firmas-20250324-0011.html\">150,000<\/a> signatures to El Salvador\u2019s legislative assembly calling for the law to be repealed. Social organisations submitted another 59,000 signatures and a constitutional complaint to the country\u2019s supreme court.<\/p>\n\n\n\n<p>All these activities, however, have failed to change the government\u2019s decision or deter the mining industry. Meanwhile, companies have been discreetly registering themselves in the country, with the aim of exploiting minerals in the country \u2013 some even before the approval of the new law.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-veteran-miners-shows-interest\">Veteran miners shows interest<\/h2>\n\n\n\n<p>The new metal mining law has attracted well-known figures into the sector, although no specific projects have yet been announced. Since December, at least three companies related to the metals trade have been registered in the Salvadoran <a href=\"https:\/\/www.cnr.gob.sv\/servicios\/registro-de-comercio\/\">Commercial Registry<\/a>.<\/p>\n\n\n\n<p>Among those is a company formed by two mining veterans with a controversial track record in Central America. Cital\u00e1 Resources, which officially registered as a mining company on 27 February 2025, was founded by two lawyers from a firm specialising in foreign investment, but its board of directors reveals a more robust mining profile: Canadian Simon Ridgway serves as president and Venezuelan Pedro Rafael Garc\u00eda Varela as vice president. Both are <a href=\"https:\/\/radiusgold.com\/corporate\/management\/\">linked<\/a> to the Canadian company <a href=\"https:\/\/radiusgold.com\/corporate\/about-us\/\">Radius Gold<\/a>, with nearly 30 years of experience in gold mining in Peru, Mexico, Guatemala and Honduras.<\/p>\n\n\n\n<p>Ridgway and Garc\u00eda Varela also founded Entre Mares de Guatemala, a company that participated in the country\u2019s Cerro Blanco gold mine, and a subsidiary of Canada-based Bluestone Resources, and formerly of the now-defunct Canadian mining giant Goldcorp.<\/p>\n\n\n\n<p>The Cerro Blanco project has been <a href=\"https:\/\/horacero.org\/corrupcion-amenazas-a-la-vida-y-resistencia-de-las-comunidades-la-historia-de-la-mina-cerro-blanco\/\">criticised<\/a> for alleged mismanagement and risking the contamination of Lake G\u00fcija, which is shared with El Salvador and connected to the Lempa River, El Salvador\u2019s main water source. Although the project\u2019s mining permit was <a href=\"https:\/\/www.newswire.ca\/news-releases\/bluestone-receives-notice-from-the-guatemalan-ministry-of-environment-and-natural-resources-837264551.html\">suspended<\/a> in June 2024, the mine was later sold to fellow Canadian firm <a href=\"https:\/\/revistalabrujula.com\/2024\/12\/19\/aura-minerals-nuevo-propietario-de-mina-cerro-blanco-es-una-amenaza-a-las-comunidades-senalan-organizaciones\/\">Aura Minerals<\/a> as part of its acquisition of Bluestone. The new owner has since <a href=\"https:\/\/www.business-humanrights.org\/en\/latest-news\/response-by-aura-minerals-about-cerro-blanco-mining-project\/\">responded<\/a> to accusations that it poses environmental threats, stating a \u201ccommitment to responsible and sustainable mining\u201d.<\/p>\n\n\n\n<p>Radius Gold also participated in the San Mart\u00edn mine in Honduras, operated through the now-defunct Glamis Gold and Entre Mares de Honduras, also subsidiaries of Goldcorp. Shared by El Salvador and Guatemala, the lake is connected to the Lempa River, which is El Salvador\u2019s main water source (Image: Camilo Freedman \/ dpa \/ Alamy)<\/div><\/div><\/div><meta itemprop=\"contentUrl\" content=\"https:\/\/dialogue.earth\/content\/uploads\/2025\/07\/Lake-Guija-protest_Alamy_2PP2NXK.jpg\"\/><meta itemprop=\"contentSize\" content=\"2 MB\"\/><meta itemprop=\"height\" content=\"1707\"\/><meta itemprop=\"width\" content=\"2560\"\/><meta itemprop=\"author\"\/><meta itemprop=\"representativeOfPage\" content=\"true\"\/><\/div>\n\n\n\n<p>According to Property and Land Registry documents seen by Dialogue Earth, as of the end of April 2025, Cital\u00e1 Resources had not registered any real estate in its name, but its articles of incorporation contemplate mergers and participation in \u201cmixed economy\u201d companies. This is relevant, given that El Salvador\u2019s new mining law establishes that only the state can engage in metal mining, but also allows for such public-private partnerships.<\/p>\n\n\n\n<p>The new <a href=\"https:\/\/investinelsalvador.gob.sv\/wp-content\/uploads\/2023\/11\/Incentivos-y-beneficios-fiscales-en-El-Salvador-V4-compress-1.pdf\">legislation<\/a> also offers tax benefits to foreign investors, including tax exemption periods of as much as 20 years.<\/p>\n\n\n\n<p>In addition to Cital\u00e1, two other companies were created on 17 December 2024, six days before the law\u2019s approval: Efat\u00e1 and Mega Obras y Servicios. Both are affiliated with foreign entities \u2013 from Colombia and Venezuela \u2013 and were officially registered in January and February 2025. Their founding documents list them as mining support companies.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-resisting-in-hostile-terrain\">Resisting in hostile terrain<\/h2>\n\n\n\n<p>Despite the reversal of the ban, and the circling interest of new companies, experts have called into question the feasibility of new projects.<\/p>\n\n\n\n<p>Andr\u00e9s McKinley, an <a href=\"https:\/\/mobile.libreriauca.com\/andres-mckinley--2\">academic<\/a> and researcher at the Jos\u00e9 Sime\u00f3n Ca\u00f1as Central American University (UCA) with decades of experience in metal mining and water resource management, believes that renewed mining projects in El Salvador are not viable.<\/p>\n\n\n\n<p>\u201cThere isn\u2019t enough water to meet people\u2019s demands [&#8230;.] water stress occurs when water availability reaches 1,700 cubic meters per person per year. And we\u2019ve been there for a few years now,\u201d says McKinley, <a href=\"https:\/\/pmc.ncbi.nlm.nih.gov\/articles\/PMC5547033\/\">referring<\/a> to the water stress indicator developed and implemented since the 1970s.<\/p>\n\n\n\n<p>That\u2019s not the only thing that makes it unviable. According to McKinley, the prospecting studies carried out around 20 years ago by the Pacific Rim mining company showed that density of gold deposits in El Salvador barely reached 5-9 grams per tonne of earth: less than what is needed to forge a single ring.<\/p>\n\n\n\n<p>In an <a href=\"https:\/\/x.com\/nayibbukele\/status\/1861882821561786578\">X post<\/a> in November announcing the law would be reversed, a month ahead of the final decision, Bukele claimed El Salvador possesses gold deposits with the \u201chighest density per square kilometre on the planet\u201d. This claim has been rejected by <a href=\"https:\/\/noticias.uca.edu.sv\/noticia\/oro-maldito\">academics<\/a> and other <a href=\"https:\/\/www.elsalvador.com\/noticias\/nacional\/luis-parada-es-mentira-que-el-salvador-tenga-altas-concentraciones-de-oro\/1193531\/2025\/\">experts<\/a>.<\/p>\n\n\n\n<div class=\"wp-block-cd-pull-quote block--pull-quote\"><div class=\"block--pull-quote__wrapper\"><blockquote class=\"block--pull-quote__quote\">We understand that we need minerals, we need metals. But that doesn\u2019t mean it should be done anywhere, under any circumstances<\/blockquote><cite class=\"block--pull-quote__cite\">Andr\u00e9s McKinley, Jos\u00e9 Sime\u00f3n Ca\u00f1as Central American University (UCA) researcher<\/cite><\/div><\/div>\n\n\n\n<p>In 2013, El Salvador&#8217;s then Mining Division of the Hydrocarbons and Mines Regulatory Directorate of the Ministry of Economy (MINEC) prepared a report entitled &#8220;Metallic Mining Resources in El Salvador&#8221;. This was never made publicly available but has been seen by Dialogue Earth.<\/p>\n\n\n\n<p>The report states that the country\u2019s main gold and silver deposits are located in the northern and eastern regions, especially in the departments of Moraz\u00e1n, San Miguel and La Uni\u00f3n.<\/p>\n\n\n\n<p>The approximate area with mining potential is 1,682 square kilometres, according to the study, equivalent to nearly 8% of the national territory. Some of the areas of interest were active mines decades ago, such as the San Sebasti\u00e1n mine \u2013 one of the largest, in operation until the 1990s, and which has been <a href=\"https:\/\/www.elsalvador.com\/noticias\/nacional\/rios-santa-rosa-de-lima-mineria-nayib-bukele-el-salvador\/1204512\/2025\/\">generating<\/a> acid drainage on the river of the same name in the department of La Uni\u00f3n for years.<\/p>\n\n\n\n<p>The Salvadoran government has so far <a href=\"https:\/\/infodemia.com.sv\/el-gobierno-declara-confidenciales-los-estudios-sobre-mineria-en-el-salvador\">refused<\/a> to reveal the studies that supported its decision to reactivate metal mining, declaring them confidential, considering them a \u201ctrade secret\u201d. As they did prior to the passage of the new law, they continue to conduct training on the issue and hold community demonstrations. In early June, the environmentalists\u2019 lawyer <a href=\"https:\/\/diario.elmundo.sv\/nacionales\/el-juicio-del-caso-santa-marta-vuelve-a-reprogramarse-por-cuarta-vez\">requested<\/a> the removal of the judge from the case seeking to prosecute the five activists, arguing that his judgment could be biased following allegations he was in the national guard during the civil war. The request was <a href=\"https:\/\/www.lavanguardia.com\/vida\/20250606\/10763842\/tribunal-salvadoreno-excluye-juez-proceso-sobre-guerra-civil-conflicto-intereses-agenciaslv20250606.html\">approved<\/a> on 6 June.<\/p>\n\n\n\n<p>Speaking to Dialogue Earth at the beginning of April, Morales said a \u201crelative calm\u201d persisted in Santa Marta, but added: \u201cFear is present because we know what they\u2019re capable of, right? We\u2019ve seen it throughout the state of emergency. The fear is that there will be arrests.\u201d<\/p>\n\n\n\n<p>Two years ago, her son was <a href=\"https:\/\/www.swissinfo.ch\/spa\/liberan-a-hijo-de-lideresa-comunitaria-detenido-en-r%C3%A9gimen-de-excepci%C3%B3n-en-el-salvador\/48527232\">arrested<\/a> amid El Salvador\u2019s state of emergency \u2013 a legislative decree launched by the Bukele government in March 2022 that has been repeatedly extended, ostensibly in an attempt to crack down on gangs. In practice, the state of emergency has allowed mass arrests and led to hundreds of <a href=\"https:\/\/www.amnesty.org\/es\/latest\/news\/2024\/12\/el-salvador-mil-dias-regimen-excepcion-modelo-seguridad-a-costa-derechos-humanos\/\">reports<\/a> of human rights violations. The communities of Caba\u00f1as have also suffered sudden <a href=\"https:\/\/www.revistafactum.com\/el-cerco-militar-revive-los-viejos-fantasmas-de-cabanas\/\">military sieges<\/a> under the regime\u2019s justification.<\/p>\n\n\n\n<a class=\"wp-block-cd-related-news alignright block--related-news loading\" data-post-id=\"60017402\"><div class=\"block--related-news__image\"><\/div><div class=\"block--related-news__content\"><span class=\"block--related-news__heading\">Recommended<\/span><span class=\"block--related-news__title\"><\/span><\/div><\/a>\n\n\n\n<p>In mid May, the Salvadoran government arrested more <a href=\"https:\/\/beta.elfaro.net\/el-salvador\/el-resumen-arrestos-e-impuestos-contra-criticos-de-bukele\">activists<\/a> and human rights defenders, while congress <a href=\"https:\/\/www.amnesty.org\/en\/latest\/news\/2025\/05\/el-salvador-profundiza-el-asedio-a-la-sociedad-civil\/\">passed<\/a> a law that imposes tax rises on civil society organisations and independent media. These measures could make it virtually <a href=\"https:\/\/latamjournalismreview.org\/articles\/bukele-escalates-crackdown-as-salvadoran-press-faces-critical-moment\/\">impossible<\/a> for some to operate. The organisations have continued to resist.<\/p>\n\n\n\n<p>For this article, interviews were requested with the Ministry of the Environment, the General Directorate of Hydrocarbons, Energy and Mines,
