The surrounding hills are [still] used for foraging and other traditional gathering activities.\u201d<\/p>\n\n\n\n<p>The hills are aquifers that <a href=\"https:\/\/epaper.navhindtimes.in\/PageImages\/pdf\/2026\/02\/01\/011025-md-ga-14.pdf\">feed<\/a> into the lake and create natural springs in the nearby villages, including Chimbel. The lake supports local farming, recharges wells and groundwater systems in the area, acts as a flood control zone, and sustains wild bird and boar <a href=\"https:\/\/gswa.goa.gov.in\/wp-content\/uploads\/2024\/02\/Toyaar-Lake.pdf\">populations<\/a>.<\/p>\n\n\n\n<p>It is also a <a><\/a>\u201cnotified wetland\u201d, meaning its use is subject to government regulations. But controversial demarcation of its boundaries allowed construction work to begin on what would have been <a href=\"https:\/\/www.thegoan.net\/goa-news\/%EF%BB%BFprashashan-stambh-to-come-up-at-chimbel\/129345.html\">Goa\u2019s tallest building<\/a><a href=\"about:blank\">,<\/a> as well as a sprawling <a href=\"http:\/\/instagram.com\/reel\/DTFTbgKE4ny\/?hl=en\">mall<\/a> for local art and crafts, on one of its surrounding hills.<\/p>\n\n\n\n<p>The structures will no longer be built following one of the state\u2019s longest and largest peaceful public agitations in recent years \u2013 a 44-day <a href=\"https:\/\/timesofindia.indiatimes.com\/city\/goa\/chimbel-residents-end-stir-after-govt-order-to-relocate-unity-mall-prashasan-stambh\/articleshow\/128127729.cms\">action<\/a>, which ended in early February and included a chain hunger strike. Over 1,000 locals from Chimbel were involved in the push to relocate the projects, says Gracias.<\/p>\n\n\n\n<p>\u201cThe government ultimately decided to shift the project, keeping villagers\u2019 sentiments in mind,\u201d Pradip Sarmokadam tells Dialogue Earth.\u00a0He is the head of nodal agency for the Goa State Wetland Authority (GSWA), which is responsible for regulating wetlands.<\/p>\n\n\n\n<p>The Toyyar Lake action is just one in a wave of recent protests against the threat of development in eco-sensitive parts of Goa. Villagers in nearby Santa Cruz have been demanding clear demarcations of a lake boundary. Authorities have now announced the project will be moved elsewhere (Image: Lisann Dias)<\/div><\/div><\/div><meta itemprop=\"contentUrl\" content=\"https:\/\/dialogue.earth\/content\/uploads\/2026\/03\/20260210_India_Goa_Project-site-in-Goa_LisannDias.jpg\"\/><meta itemprop=\"contentSize\" content=\"2 MB\"\/><meta itemprop=\"height\" content=\"1707\"\/><meta itemprop=\"width\" content=\"2560\"\/><meta itemprop=\"author\"\/><meta itemprop=\"representativeOfPage\" content=\"true\"\/><\/div>\n<\/div>\n<\/div>\n\n\n\n<p>Behind this rampant construction, protestors say, is the desire to accommodate more tourists, settlers and <a href=\"https:\/\/restofworld.org\/2023\/goa-india-digital-nomads-locals\/\">digital nomads<\/a> in the area, which is famed for its beaches.<\/p>\n\n\n\n<p>Goa\u2019s wetlands are particularly vulnerable to this push for concretisation. The national <a href=\"https:\/\/moef.gov.in\/uploads\/2020\/01\/final-version-and-printed-wetland-guidelines-rules-2017-03.01.20.pdf\">Wetlands Rules<\/a> of India\u2019s <a href=\"https:\/\/www.indiacode.nic.in\/bitstream\/123456789\/4316\/1\/ep_act_1986.pdf\">Environment Act<\/a> prohibit the conversion of wetlands and the setting up or expanding of industries. But authorities often fail to enforce these protections. In the case of Toyyar Lake, the relevant authority set boundaries for the wetland area that were significantly smaller than those recommended by a research body.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-unclear-boundaries\">Unclear boundaries<\/h2>\n\n\n\n<p>Across Goa, even when wetlands are notified, authorities <a href=\"https:\/\/timesofindia.indiatimes.com\/city\/goa\/bondvoll-lake-gets-200m-buffer-till-status-cleared\/articleshow\/128434760.cms\">do not clearly demarcate<\/a> their boundaries, and permissions are granted for construction activities close by. But these boundaries are vital to protect the recharge zones for water supplies.<\/p>\n\n\n\n<p>Shirodkar is chairperson of two village-level statutory bodies formed to promote conservation \u2013 Chimbel\u2019s committees to manage <a href=\"http:\/\/nbaindia.org\/uploaded\/pdf\/Guidelines_BMC_1.pdf\">biodiversity<\/a> and wetlands.<\/p>\n\n\n\n<p>Both committees were blindsided by the announcement in early 2025 of the proposed tower and mall near Toyyar Lake, he says, noting they were not consulted about the projects. In January of this year, a North Goa court ordered a halt to construction work after Shirodkar filed a <a href=\"https:\/\/timesofindia.indiatimes.com\/city\/goa\/court-directs-gtdc-to-stop-work-on-chimbel-unity-mall\/articleshow\/126312330.cms\">petition<\/a> challenging the validity of the construction permissions granted for the projects. Villagers had begun their peaceful agitation and hunger strikes a few days before the ruling.<\/p>\n\n\n\n<p>Sarmokadam of the GSWA says the land around the lake where the projects were to be built belongs to the government.<\/p>\n\n\n\n<p>He told Dialogue Earth that, \u201cafter following due process and conducting surveys\u201d, the proposed construction sites were determined to fall \u201cwell beyond\u201d the 50-metre buffer zone <a href=\"https:\/\/moef.gov.in\/uploads\/2022\/02\/2-Goa-Notifications.pdf\">required<\/a> by Goan state law for wetlands. The buffer zone starts from a water body\u2019s high water mark. He notes that GSWA <a href=\"https:\/\/moef.gov.in\/uploads\/2022\/02\/2-Goa-Notifications.pdf\">mapped<\/a> Toyyar Lake\u2019s zone of influence <a href=\"about:blank\">more tightly<\/a> than the National Institute of Oceanography (NIO), which conducts scientific assessments of areas proposed for wetland notification. Dialogue Earth has found the difference in the zones mapped by the two organisations amounts to a 33% decrease in size.<\/p>\n\n\n\n<p>Both mappings were undertaken before the announcement of the construction projects. Noronha points out that the wetland authority has the mandate to adopt NIO\u2019s recommendations in full, in part, or reject them. At Toyyar Lake the discrepancy between the two maps show they were accepted in part, he says.<\/p>\n\n\n\n<p>He adds that a large portion of the land parcel which includes the site of the two projects, was included in NIO\u2019s zone of influence but left out of GSWA\u2019s map. According to his assessment, the site of the mall was on the fringe of NIO\u2019s zone of influence, making it difficult to determine with certainty whether the site was in or out of the map, he says.<\/p>\n\n\n\n<p>Noronha says around the same time the recommendations were accepted, the land was transferred to the tourism department that proposed the projects, citing a deed of conveyance Shirodkar obtained via a <a href=\"https:\/\/cic.gov.in\/sites\/default\/files\/RTI-Act_English.pdf\">Right to Information<\/a> request. In October 2025, the GSWA issued a clearance document, seen by Dialogue Earth, for the mall stating the site was outside the notified wetland area.<\/p>\n\n\n\n<p>The villagers of Chimbel thought otherwise, insisting the projects were within Toyyar Lake\u2019s zone of influence. They pushed for a new survey to be <a href=\"https:\/\/timesofindia.indiatimes.com\/city\/goa\/surveyors-finish-mapping-area-around-toyyar-lake\/articleshow\/127644945.cms\">conducted<\/a> in late January this year measuring the lake\u2019s zone of influence and features like vegetation cover and sub-surface water flows. Just days after the survey was complete, the government announced the projects would be moved elsewhere.<\/p>\n\n\n\n<p>Sarmokadam notes that under the Wetlands Rules, a zone of influence only covers part of a catchment and not its entirety. \u201cThough activities in the catchment can influence the wetland, this can be mitigated with the right technology to prevent contamination,\u201d he insists.<\/p>\n\n\n\n<p>He adds that despite the wetland authority\u2019s jurisdiction not extending beyond the 50-metre buffer, it \u201cstill imposed conditions like proper sewage and waste management, and measures such as groundwater development to offset the area being concretised\u201d.<\/p>\n\n\n\n<p>In North Goa, it is not just Toyyar Lake facing boundary irregularities. Villagers in nearby Santa Cruz <a href=\"https:\/\/timesofindia.indiatimes.com\/city\/goa\/bondovoll-lake-protest-on-hold-as-cm-assures-resurvey\/articleshow\/128082686.cms\">are demanding<\/a> clear demarcation of the zone of influence around the protected Bondvoll Lake before any construction is allowed. Dialogue Earth found a 77% decrease in the size of the lake\u2019s zone of influence in the <a href=\"https:\/\/gswa.goa.gov.in\/wp-content\/uploads\/2022\/10\/Final-Notification-of-Bondvol-Lake-dated-20th-October-2022.pdf\">official notification<\/a> for the lake compared to the NIO\u2019s recommendation <a href=\"https:\/\/gswa.goa.gov.in\/wp-content\/uploads\/2024\/02\/Bondvol-Lake.pdf\">report<\/a>. Alongside the demarcation, they are seeking the suspension of construction licences issued without ecological assessment or consultation with local biodiversity management committees.<\/p>\n\n\n\n<p>The government has <a href=\"https:\/\/timesofindia.indiatimes.com\/city\/goa\/bondvoll-lake-gets-200m-buffer-till-status-cleared\/articleshow\/128434760.cms\">instructed<\/a> the Town and Country Planning Department not to permit any construction activity within a 200-metre radius of the lake until the wetland authority clarifies the official status of the zone.<\/p>\n\n\n\n<p>Pushback has been successful in the past, with the lake being <a href=\"https:\/\/timesofindia.indiatimes.com\/city\/goa\/st-cruz-locals-seek-review-of-bondvol-lake-buffer-area\/articleshow\/127645095.cms\">designated<\/a> a wetland in 2022 after <a href=\"https:\/\/india.mongabay.com\/2021\/01\/a-community-movement-saves-a-goan-heritage-lake-and-brings-hope\/\">sustained public pressure<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-rezoning-another-threat-to-wetlands\"><strong>Rezoning: another threat to wetlands<\/strong><\/h2>\n\n\n\n<p>As <a href=\"https:\/\/www.thehindu.com\/news\/national\/goa\/goa-sees-overall-6-rise-in-tourist-arrivals-international-inflow-up-by-29-minister\/article70228671.ece\">more people<\/a> visit Goa, short holidays turn into extended stays and second homes, incentivising the construction of additional hotels, resorts, villas and <a href=\"https:\/\/one-goa.com\/\">residential colonies<\/a>.<\/p>\n\n\n\n<p>\u201cThe biggest crisis in Goa is rampant, indiscriminate construction, with absolutely no regard for the people who live here,\u201d says Noronha.<\/p>\n\n\n\n<div This 2024 amendment to Goa\u2019s Town and Country Planning Act <a href=\"https:\/\/thebetterindia.com\/environment\/section-39a-goa-land-use-explained-11151394\">allows<\/a> the chief town planner to modify land-use zoning even for areas marked as not for development, with a 30-day window for public objection.<\/p>\n\n\n\n<p>In February, hundreds of villagers in <a href=\"https:\/\/scroll.in\/latest\/1090970\/goa-protesters-march-to-ministers-home-demand-removal-of-land-use-change-law\">Palem-Siridao<\/a> took to the streets to demand the scrapping of the amendment. They claim it is allowing the authorities to rezone <a href=\"https:\/\/indianexpress.com\/article\/india\/protesters-gherao-ministers-house-in-goa-demand-scrapping-of-contentious-land-use-change-law-10548308\/\">over 84,000 square metres<\/a> in their area as settlement land, permitting construction.<\/p>\n\n\n\n<p>Protestors say the amendment could enable the conversion of Goan orchards, hills and even wetlands, into construction-ready land, all without sufficient community consultation.<\/p>\n\n\n\n<p>Wetlands in Goa are actively being threatened. For instance, rezoning under Section 39A is also being proposed around <a href=\"https:\/\/timesofindia.indiatimes.com\/city\/goa\/20k-sqm-pilerne-hill-conversion-risks-landslides-threatens-lake\/articleshow\/122771363.cms\">Savlem<\/a> and <a href=\"https:\/\/www.instagram.com\/p\/DShcdcGjK96\/?img_index=1\">Zuari<\/a> lakes, respectively a notified wetland and one being proposed for notification.<\/p>\n\n\n\n<p>Section 39A is currently being <a href=\"https:\/\/www.thegoan.net\/editorial\/%EF%BB%BFlegislators-flatter-to-deceive-on-39a-in-legislative-assembly\/144884.html#google_vignette\">discussed<\/a> in Goa\u2019s legislative assembly. In the meantime, the Town and Country Planning Department has <a href=\"https:\/\/timesofindia.indiatimes.com\/city\/goa\/tcp-notifies-14-proposals-for-zone-change-under-39a\/articleshow\/129594461.cms\">reportedly<\/a> offered to convert over a dozen tracts of land across Goa for settlement use. Among the proposals is an application by a construction company seeking conversion of land partly classified as orchard and natural cover, including a section marked as being not for development, reported the Times of India.<\/p>\n\n\n\n<p>The Goan government has <a href=\"https:\/\/www.facebook.com\/DrPramodPSawant\/posts\/pleased-to-attend-and-address-the-state-level-celebration-of-worldwetlandsday-20\/1443701187118120\/\">commemorated<\/a> World Wetlands Day and participated in nationwide wetlands conservation <a href=\"https:\/\/www.pib.gov.in\/Pressreleaseshare.aspx?PRID=1896301&amp;reg=3&amp;lang=2\">campaigns<\/a>. Yet its actions suggest different priorities. <a><\/a><\/p>\n\n\n\n<p>As of May 2025, Goa had <a href=\"https:\/\/epaper.navhindtimes.in\/PageImages\/pdf\/2025\/05\/31\/3105025-md-ga-02.pdf\">34 notified wetlands<\/a>, according to the Navhind Times, but several ecologically critical areas remain unprotected. One example is Torda Creek in the village of Salvador do Mundo, parts of which fall under <a href=\"https:\/\/sd2.tourism.gov.in\/DocumentRepoFiles\/MasterPlan\/MP353addb8-ecdb-4942-8cff-6f71e069304a.pdf\">CRZ-I<\/a>, the <a href=\"https:\/\/crz.elaw.in\/crz2019.html\">highest level<\/a> of protection within India\u2019s coastal regulation framework.<\/p>\n\n\n\n<p>Under a national tourism ministry <a href=\"https:\/\/tourism.gov.in\/sites\/default\/files\/2023-04\/Swadesh%20Darshan%20%20Guideline%20Booklet.pdf\">project<\/a>, this site has been <a href=\"https:\/\/sd2.tourism.gov.in\/DocumentRepoFiles\/DPRReport\/DPR12438c19-aa31-4074-9476-6aa82c9a8090.pdf\">proposed<\/a> for development as a tourist promenade. Locals and campaigners fear such concretisation will choke mangroves, disrupt tidal flow and damage the wetland\u2019s natural flood-control functions.<\/p>\n\n\n\n<p>\u201cThe proposed beautification is neither sustainable nor eco-friendly,\u201d says Anthony D\u2019Souza, an activist pushing for official wetland notification for the creek with the group <a href=\"https:\/\/www.goaworthafight.org\/about\">Goa Worth A Fight<\/a>. He fears the project, which estimates tourist footfall in the proposed tourism area that includes Torda Creek to grow from just over 72,000 this year to 111,000 in 2029, does not account for the ecological limits of the land.<\/p>\n\n\n\n<p>Dialogue Earth reached out to the tourism ministry on this matter but received no response. <\/p>\n\n\n\n<p>While talking about the long-term ecological impacts of construction on wetlands in Goa, D\u2019Souza points to the mangroves along the Panaji-Merces highway, which, he says, \u201chave died because highway construction and related concretisation blocked the natural flow between creeks and rivers\u201d.<\/p>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-9d6595d7 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<div class=\"wp-block-cd-article-image aligncenter block--article-image href=\"https:\/\/sandrp.in\/2018\/02\/03\/india-wetlands-review-2017-important-court-orders\/\">compelled<\/a> state governments to identify and protect wetlands. \u201cIf not for this judgment, states would not be required to identify and notify wetlands at all,\u201d he says. \u201cState governments do not necessarily prioritise wetland protection, but they also cannot afford to be in contempt of court.\u201d <a><\/a><\/p>\n\n\n\n<p>There are also larger interests shaping the decisions of the wetland authority, he notes. \u201cPlanning is built on assumptions, and almost any decision can be justified through a set of assumptions,\u201d Noronha says. \u201cIt is important to view regulatory bodies through a political lens alongside power structures that shape it to
