{"id":66073,"date":"2020-07-08T14:03:46","date_gmt":"2020-07-08T14:03:46","guid":{"rendered":"https:\/\/chinadialogue.net\/?p=66073"},"modified":"2021-02-15T10:16:32","modified_gmt":"2021-02-15T10:16:32","slug":"is-the-environment-still-a-priority-for-china-in-the-post-pandemic-era","status":"publish","type":"post","link":"https:\/\/dialogue.earth\/en\/nature\/is-the-environment-still-a-priority-for-china-in-the-post-pandemic-era\/","title":{"rendered":"Is the environment still a priority for China in the post-pandemic era?"},"content":{"rendered":"\n<p class=\"has-drop-cap\">China faces a turbulent economic and geopolitical landscape, with most of the world still battling Covid-19, relations with the US at a new low, and the global economy hard hit.<\/p>\n\n\n\n<p>So is the environment still a priority in its political and economic agenda?<\/p>\n\n\n\n<p>Immediately after the lockdown was partially lifted in March, China\u2019s president, Xi Jinping, visited <a href=\"http:\/\/www.xinhuanet.com\/politics\/leaders\/2020-03\/30\/c_1125790529_11.htm\" target=\"_blank\" rel=\"noreferrer noopener\">Anji County<\/a> in east China\u2019s Zhejiang province and <a href=\"http:\/\/www.xinhuanet.com\/politics\/leaders\/2020-04\/23\/c_1125896472.htm\" target=\"_blank\" rel=\"noreferrer noopener\">Niubeiliang National Nature Reserve<\/a> in Shanxi, two important locations where his idea of ecological conservation developed. The visits sent strong signals that the environment still mattered for the leadership. Premier Li Keqiang\u2019s <a href=\"https:\/\/www.chinadialogue.net\/article\/show\/single\/en\/12019-All-eyes-on-China-s-post-lockdown-Twin-Sessions\" target=\"_blank\" rel=\"noreferrer noopener\">work report for 2020<\/a>, delivered to the National People\u2019s Congress at its post-lockdown <a href=\"https:\/\/dialogue.earth\/en\/business\/all-eyes-on-chinas-post-lockdown-twin-sessions\/\" target=\"_blank\" rel=\"noreferrer noopener\">Twin Sessions convention<\/a> in late May, also highlighted environmental protection. Moreover, Huang Runqiu, the newly appointed minister of ecology and environment, stressed that ecological protection and green development shall remain priorities and acknowledged that work is still needed to achieve China\u2019s 2020 environmental goals.<\/p>\n\n\n\n<p>Beyond visits and statements from top leaders, China has been rolling out a series of policy and legislative items since March with far-reaching implications for its environmental governance system. We take stock of four major developments in this area to demonstrate how they will bear out the leadership\u2019s vision for ecological civilisation in the post-pandemic era.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-modernising-environmental-governance\">\u2018Modernising\u2019 environmental governance<\/h2>\n\n\n\n<p>In March, the Party Central Committee and the State Council issued the \u201cGuiding Opinions on Building a Modern Environmental Governance System\u201d, which specifies the roles of various stakeholders in environmental protection, and reaffirms key priorities, such as rule of law, multi-stakeholder governance, transparency and market mechanisms. <a href=\"https:\/\/www.chinadialogue.net\/article\/show\/single\/ch\/11918-Ma-Jun-We-re-at-a-crossroads-for-environmental-protection-\" target=\"_blank\" rel=\"noreferrer noopener\">The document<\/a> includes the objective of setting up a green governance system that is \u201cclear in its direction\u201d, \u201cscientific in decision making\u201d, \u201cstrong in enforcement\u201d, \u201ceffective in its incentives\u201d and \u201cwide in participation\u201d by the year 2025.<\/p>\n\n\n\n<p>While most of the systems have been announced in previous documents, the Guiding Opinions document goes further by providing a convenient to-do list for environmental governance reform in the <a href=\"https:\/\/dialogue.earth\/en\/climate\/11434-the-14th-five-year-plan-what-ideas-are-on-the-table\/\" target=\"_blank\" rel=\"noreferrer noopener\">14<sup>th<\/sup> Five Year Plan<\/a> period (2021-2025).<\/p>\n\n\n\n<a class=\"wp-block-cd-related-news alignright block--related-news loading\" data-post-id=\"61646\"><div class=\"block--related-news__image\"><\/div><div class=\"block--related-news__content\"><span class=\"block--related-news__heading\">Recommended<\/span><span class=\"block--related-news__title\"><\/span><\/div><\/a>\n\n\n\n<p>Importantly, the roles of the Party Central Committee and National Development and Reform Commission (NDRC) are specified, as well as the role of the Ministry of Ecology and Environment (MEE). This matters, because issues like climate change must be addressed by integrating climate considerations into broader economic policies, such as industrial restructuring, power generation and transportation. The MEE recently established a \u201cgeneral department\u201d tasked with this type of integration, among other things.<\/p>\n\n\n\n<p>Multi-stakeholder participation will be the key feature of the modern environmental governance system. The Guiding Opinions document stresses the importance of businesses and civil society participating, and clarifies their responsibilities as well as government\u2019s. Moreover, it explicitly mentions strengthening judicial support for environmental protection and encouraging prosecutors in bringing environmental public interest lawsuits.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-a-green-civil-code\">A \u2018green\u2019 Civil Code<\/h2>\n\n\n\n<p>The Civil Code, passed at the latest <a href=\"https:\/\/dialogue.earth\/en\/business\/all-eyes-on-chinas-post-lockdown-twin-sessions\/\" target=\"_blank\" rel=\"noreferrer noopener\">Twin Sessions<\/a> on 28 May, is the only Chinese legislation officially called a \u201ccode\u201d. It contains ambitious goals for state governance, including 18 \u201cgreen articles\u201d dedicated to safeguarding the environmental rule of law, with many more newly added provisions aimed at promoting environmental protection.<\/p>\n\n\n\n<p>To be more specific, the Civil Code makes sustainable utilisation of resources and environmental protection a prerequisite for exercising land-use rights. It has a dedicated chapter on environmental pollution and damage liabilities, with some major revisions to environmental tort liability: &nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Responsible parties are no longer called \u201cpolluters\u201d but \u201ctortfeasors\u201d, meaning they have committed a tort \u2013 a civil offence. Anyone causing ecological damage, not just narrowly defined \u201cpollution\u201d as stipulated in the Tort Law, must assume tort liabilities.&nbsp;<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Punitive compensation for ecological damage is introduced, which increases liability if conduct was malicious, raising the cost of breaking the law.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>If the tortfeasor is slow to remediate, government may conduct remediation by itself or by entrusting others at the expense of the tortfeasor.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>The code expands the scope of compensation, including losses from permanent ecological damage and loss of ecological service functions during remediation;&nbsp; expenses related to investigating, authenticating and assessing ecological and environmental damage, pollution clean-up, and ecological and environmental remediation; as well as expenses to prevent the occurrence and aggravation of damage. This implies that the expenses to be paid by the tortfeasor may include preventive costs arising from the adoption of precautionary, preventive and control measures.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>More elements are accounted for in determining the liability when multiple parties are jointly liable. This will facilitate adjudication in such cases, which can be common in environmental problems, such as air or water pollution.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-preventive-public-interest-litigation\">Preventive public interest litigation <\/h2>\n\n\n\n<p>The system for environmental public interest litigation has quickly taken shape since the introduction of China\u2019s revised Environmental Protection Law in 2015, with hundreds of cases brought by public prosecutors and NGOs. In May, the Environmental and Resource Tribunal of the Supreme People\u2019s Court released its \u201cWhite Paper on China\u2019s Environmental and Resources Adjudications\u201d in 2019, and the \u201cGreen Paper on China\u2019s Environmental Justice Development\u201d in 2019. This year\u2019s edition of the white paper provides much more detail than before, and for the first time defines climate change cases in their own category.<\/p>\n\n\n\n<p>The white paper instructs Chinese courts to handle cases concerning greenhouse gas emissions and ozone-depleting substances that directly or indirectly contribute to climate change in accordance with the law, and that these cases should be adjudicated with the aim of reducing greenhouse gas emissions or strengthening climate resilience, depending on the type of case. Creating a separate category for cases related to climate change has paved the way for furthering environmental judicial practice in response to the changing climate. Very few climate cases have been adjudicated before in China, in part due to the difficulty in bringing preventive litigation.<\/p>\n\n\n\n<div class=\"wp-block-cd-pull-quote block--pull-quote block--pull-quote--no-citation\"><div class=\"block--pull-quote__wrapper\"><blockquote class=\"block--pull-quote__quote\">The pandemic has triggered a wide-ranging conversation about the relationship between human beings and nature<\/blockquote><cite class=\"block--pull-quote__cite\"><\/cite><\/div><\/div>\n\n\n\n<p>At the Twin Sessions recently concluded, proposals to support <a href=\"https:\/\/www.chinadialogue.net\/article\/show\/single\/en\/11846-China-should-allow-lawsuits-before-environmentally-risky-projects-begin\">preventative environmental public interest litigation<\/a> have been submitted by delegates. Moreover, both the Supreme People\u2019s Court and Supreme People\u2019s Procuratorate have signalled support for further development of systems for preventive litigation.<\/p>\n\n\n\n<p>A recent joint study completed by the Supreme People\u2019s Procuratorate and ClientEarth concluded that preventive environmental public interest litigation is an important area for future development.&nbsp;<\/p>\n\n\n\n<p>By allowing interventions at an earlier stage before environmental damage takes place, the environment can be better protected, according to Judge Wang Xuguang, president of the Environmental and Resource Adjudication Tribunal of the Supreme People\u2019s Court, at an interview during the Twin Sessions.<\/p>\n\n\n\n<a class=\"wp-block-cd-related-news alignright block--related-news loading\" data-post-id=\"35939\"><div class=\"block--related-news__image\"><\/div><div class=\"block--related-news__content\"><span class=\"block--related-news__heading\">Recommended<\/span><span class=\"block--related-news__title\"><\/span><\/div><\/a>\n\n\n\n<p>Multiple signals, from the progress of the <a href=\"https:\/\/mailchi.mp\/chinadialogue\/covid-19-and-china-dialogue-an-update?e=%5bUNIQID%5d\">Green peafowl case<\/a>, to the proposals by delegates at the Twin Sessions, and to the support from the Procuratorate and the Court, also show that the system for preventive environmental litigation is now a priority. And with Covid-19\u2019s suspected link to wildlife, the entire chain of illegal wildlife trade (illegal killings, capture, smuggling, trade, sales and purchases) have also become a top priority for China\u2019s public interest prosecutors.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-a-truly-green-transition\">A truly green transition?<\/h2>\n\n\n\n<p>Despite heavy turbulence caused by Covid-19 and the economic downturn, recent developments show that environmental issues remain a key focus area in China. The impacts of the pandemic, rather than halting the development of environmental rule of law, have triggered a wide-ranging conversation about the relationship between human beings and nature, leading to further progress in the strengthening of environmental governance in China.<\/p>\n\n\n\n<p>One big outstanding point to watch is whether China will actively \u201cgreen\u201d its post Covid-19 stimulus measures, unveiled at the Twin Sessions by Premier Li.
