{"id":74356,"date":"2021-12-21T09:50:05","date_gmt":"2021-12-21T09:50:05","guid":{"rendered":"https:\/\/chinadialogue.net\/?p=74356"},"modified":"2022-01-05T09:56:11","modified_gmt":"2022-01-05T09:56:11","slug":"climate-litigation-up-in-2021-with-private-sector-now-exposed","status":"publish","type":"post","link":"https:\/\/dialogue.earth\/en\/climate\/climate-litigation-up-in-2021-with-private-sector-now-exposed\/","title":{"rendered":"Climate litigation up in 2021, with private sector now exposed"},"content":{"rendered":"\n<p class=\"has-drop-cap\">The global surge in legal action on climate change has shown no signs of slowing this year, with more than 1,800 cases completed or in process, up from 1,500 last year.<\/p>\n\n\n\n<p>While the vast majority of lawsuits are still from the United States, they are increasingly being filed in other jurisdictions, from Guyana to South Africa. The focus is beginning to broaden from governments to include the private sector, and there were some notable successes this year. These could provide a powerful tool to force more ambitious <a href=\"https:\/\/dialogue.earth\/en\/tag\/climate-action\/\">climate action<\/a>, although there is still a long way to go to hold states and companies accountable for their emissions.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-european-states-in-the-dock\">European states in the dock<\/h2>\n\n\n\n<p>Europe was a hotspot for successful litigation this year. In April, Germany\u2019s top constitutional court <a href=\"http:\/\/climatecasechart.com\/climate-change-litigation\/non-us-case\/neubauer-et-al-v-germany\/\">ruled<\/a> the government\u2019s efforts to cut emissions not strong enough to protect future generations, thereby breaching the fundamental rights of its young people. In response, outgoing German chancellor Angela Merkel pushed through a new version of the national climate law, <a href=\"https:\/\/apnews.com\/article\/europe-germany-business-environment-and-nature-government-and-politics-0095de00226f0727559dcb7f2daa8ff7\">bringing forward<\/a> the target date for net zero by five years to 2045.<\/p>\n\n\n\n<p>The French government was twice ordered to honour its climate commitments. An unprecedented <a href=\"https:\/\/www.theguardian.com\/world\/2021\/jul\/01\/french-court-orders-government-to-act-on-climate-in-next-nine-months\">injunction<\/a> from the country\u2019s highest administrative court in July said it must take \u201call necessary additional steps\u201d to meet targets. Another gave it a <a href=\"https:\/\/www.reuters.com\/world\/europe\/french-court-orders-state-honour-its-climate-commitments-oxfam-2021-10-14\/\">deadline<\/a> of 31 December 2022 to \u201crepair\u201d an overshoot of its emissions.<\/p>\n\n\n\n<a class=\"wp-block-cd-related-news alignright block--related-news loading\" data-post-id=\"73081\"><div class=\"block--related-news__image\"><\/div><div class=\"block--related-news__content\"><span class=\"block--related-news__heading\">Recommended<\/span><span class=\"block--related-news__title\"><\/span><\/div><\/a>\n\n\n\n<p>Not all rulings were wholesale victories for climate campaigners. A court in Brussels said Belgium\u2019s failure to meet its climate targets <a href=\"http:\/\/climatecasechart.com\/climate-change-litigation\/non-us-case\/vzw-klimaatzaak-v-kingdom-of-belgium-et-al\/\">had violated<\/a> its citizens\u2019 human rights, but refused to impose on the government a binding target to cut emissions, on the grounds this would breach the separation of powers between state and judiciary.<\/p>\n\n\n\n<p>As these proceedings closed, a number of similar European cases began this year, most notably in <a href=\"https:\/\/www.theguardian.com\/world\/2021\/jun\/05\/italian-climate-activists-sue-government-over-inaction\">Italy<\/a> and <a href=\"https:\/\/www.theguardian.com\/world\/2021\/jun\/05\/italian-climate-activists-sue-government-over-inaction\">Poland<\/a>.<\/p>\n\n\n\n<p>In the United Kingdom, there were several attempts to force climate action through the courts, none yet successful. These included actions by campaigners to try to <a href=\"https:\/\/www.theguardian.com\/world\/2021\/jun\/05\/italian-climate-activists-sue-government-over-inaction\">block<\/a> an enormous road-building strategy and the <a href=\"https:\/\/www.theguardian.com\/environment\/2020\/dec\/16\/top-uk-court-overturns-block-on-heathrows-third-runway\">expansion<\/a> of London\u2019s Heathrow Airport, which both failed in court.<\/p>\n\n\n\n<p>A separate <a href=\"https:\/\/www.theguardian.com\/environment\/2021\/apr\/30\/uk-students-sue-government-human-rights-climate-crisis\">lawsuit<\/a>, brought by three young people who claim the UK government is breaching their human rights, is waiting to see if it can proceed to a full hearing.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-us-and-australia-top-the-charts\">US and Australia top the charts<\/h2>\n\n\n\n<p>Although the US is still where most lawsuits have been filed \u2013 over 1,300 at the last count \u2013 many of them have become bogged down in procedural hurdles. Plaintiffs in the most prominent national case, <a href=\"http:\/\/climatecasechart.com\/climate-change-litigation\/case\/juliana-v-united-states\/\">Juliana v the United States<\/a>, in which 21 young people argue the government\u2019s climate inaction breaches their constitutional rights, attempted and failed to reach a settlement with the justice department this year. In a case brought by bushfire survivors, a court in New South Wales <a href=\"https:\/\/www.smh.com.au\/environment\/climate-change\/really-big-win-nsw-environmental-watchdog-ordered-to-address-climate-change-20210826-p58m37.html\">ordered<\/a> the state\u2019s environmental protection authority to \u201cdevelop environmental quality objectives, guidelines and policies to ensure environment protection from climate change\u201d.<\/p>\n\n\n\n<p>Next year is likely to see the final outcome in a major case brought by student activist Anjali Sharma and seven other teenagers against the expansion of a coal mine in New South Wales. While this year, the federal court found environment minister Sussan Ley had a \u201cduty of care\u201d to protect children in Australia from personal injury or death resulting from climate change. It was a landmark decision, but one the government has appealed.<\/p>\n\n\n\n<p>East of Australia in the South Pacific, the tiny island nation of Vanuatu made history this year by <a href=\"https:\/\/edition.cnn.com\/2021\/09\/26\/asia\/vanuatu-climate-change-protection-rights-intl\/index.html\">seeking<\/a> an advisory opinion from the International Court of Justice on the issue of climate change and human rights.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-human-rights-in-focus\">Human rights in focus<\/h2>\n\n\n\n<p>With climate litigation cases increasingly referring to breaches of human rights \u2013 and judges making the link explicit \u2013 a new legal avenue has opened itself up for campaigners. The European Court of Human Rights, which is responsible for interpreting the European Convention on Human Rights, accepted cases from two different groups and has given them priority status.<\/p>\n\n\n\n<p>The first involves young <a href=\"https:\/\/www.theguardian.com\/law\/2020\/sep\/03\/portuguese-children-sue-33-countries-over-climate-change-at-european-court\">activists<\/a> from Portugal who want the court to order 33 states in Europe to adopt collective emissions cuts consistent with the Paris Agreement\u2019s 1.5C warming target. The second is by a <a href=\"https:\/\/www.greenpeace.org\/international\/press-release\/47031\/european-court-of-human-rights-greenlights-swiss-seniors-climate-case\/\">group<\/a> of elderly women against the government of Switzerland who say their health is at risk from heat waves exacerbated by climate change.<\/p>\n\n\n\n<a class=\"wp-block-cd-related-news alignright block--related-news loading\" data-post-id=\"72493\"><div class=\"block--related-news__image\"><\/div><div class=\"block--related-news__content\"><span class=\"block--related-news__heading\">Recommended<\/span><span class=\"block--related-news__title\"><\/span><\/div><\/a>\n\n\n\n<p>The European court is still deciding whether to accept a third case, brought by six climate activists and two environmental NGOs against the government of Norway. The group had tried to take action in their domestic courts against Norway\u2019s approval of new licences for <a href=\"https:\/\/dialogue.earth\/15675-arctic-oil-drilling-norway-supreme-court\/\">offshore oil drilling in the Arctic<\/a>, but the country\u2019s top court rejected their arguments this year.<\/p>\n\n\n\n<p>However, attempts by campaigners to bring a lawsuit, dubbed the <a href=\"https:\/\/peoplesclimatecase.caneurope.org\/\">People\u2019s Climate Case<\/a>, in the Court of Justice of the European Union failed in March on the grounds that the claimants did not have a right to challenge EU law.<\/p>\n\n\n\n<p>Nor did the UN\u2019s Committee on the Rights of the Child agree with a <a href=\"https:\/\/www.reuters.com\/business\/environment\/un-panel-says-it-cant-rule-climate-case-brought-by-greta-thunberg-2021-10-11\/\">petition<\/a> brought by children from around the world, who accused Argentina, Brazil, France, Germany and Turkey of breaching the <a href=\"https:\/\/www.ohchr.org\/EN\/ProfessionalInterest\/Pages\/CRC.aspx\">Convention on the Rights of the Child<\/a> by failing to act decisively enough on climate change. The group, led by Swedish activist Greta Thunberg, has since <a href=\"https:\/\/www.theguardian.com\/environment\/2021\/nov\/10\/youth-activists-petition-un-to-declare-systemwide-climate-emergency\">filed<\/a> a legal petition to the UN secretary-general, Ant\u00f3nio Guterres, urging him to declare a \u201csystem-wide climate emergency\u201d.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-litigation-on-the-up-in-global-south\">Litigation on the up in global south<\/h2>\n\n\n\n<p>While the overwhelming majority of cases continue to take place in the global north, climate litigation is growing in the global south too.<\/p>\n\n\n\n<p>This year saw the first constitutional climate case in the Caribbean, challenging fossil fuel production on climate and human rights grounds. Two citizens are <a href=\"https:\/\/www.theguardian.com\/world\/2021\/may\/31\/guyanese-citizens-challenge-exxon-mobil-offshore-drilling-on-climate-grounds\">taking on<\/a> Guyana\u2019s government, seeking an end to a huge offshore drilling <a href=\"https:\/\/dialogue.earth\/en\/extractive-industries\/48832-guyanas-oil-discoveries-environment-versus-development-debate-china\/\">project<\/a> run by ExxonMobil and other large oil firms.<\/p>\n\n\n\n<p>Elsewhere, a group of indigenous Amazonian people took a local arm of one of China\u2019s biggest oil firms to court in Ecuador\u2019s first major climate change litigation <a href=\"https:\/\/dialogue.earth\/en\/climate-energy\/40775-amazonian-community-launches-ecuadors-first-climate-lawsuit\/\">case<\/a>. The judge ruled against them.<\/p>\n\n\n\n<p>In South Africa, a national plan to build new coal-fired power stations is currently being <a href=\"https:\/\/www.theguardian.com\/world\/2021\/nov\/19\/climate-campaigners-take-south-africa-to-court-over-coal-policy\">challenged<\/a> in court for breaching the rights of current and future generations.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-the-private-sector-enters-line-of-fire\">The private sector enters line of fire<\/h2>\n\n\n\n<p>To date, most cases have been brought against governments. But 2021 was the year attention broadened to include the private sector, says Joana Setzer, an assistant professor at the London School of Economics specialising in climate litigation.<\/p>\n\n\n\n<p>In May, Shell became the first company in history held legally liable for contributing to climate change, when a Dutch court <a href=\"https:\/\/www.reuters.com\/business\/sustainable-business\/dutch-court-orders-shell-set-tougher-climate-targets-2021-05-26\/\">ordered<\/a> it to cut its global CO2 emissions 45% by 2030, and ruled it was responsible for its customers\u2019 emissions too. Shell is appealing but the court made clear it should start acting on the decision immediately. Then, in November, Shell made the surprise announcement it was moving its headquarters to the UK, although it has said this will not affect the ruling. (Image: Piroschka van de Wouw \/ Alamy)<\/div><\/div><\/div><meta itemprop=\"contentUrl\" content=\"https:\/\/dialogue.earth\/content\/uploads\/2021\/12\/20211220_Dutch-NGO-Milieudefensie-director-Donald-Pols_Piroschka-Van-der-Wouw_Alamy_2FX9WYK.jpg\"\/><meta itemprop=\"contentSize\" content=\"499 KB\"\/><meta itemprop=\"height\" content=\"1705\"\/><meta itemprop=\"width\" content=\"2560\"\/><meta itemprop=\"author\"\/><meta itemprop=\"representativeOfPage\" content=\"true\"\/><\/div>\n\n\n\n<p>The following month, German NGO Deutsche Umwelthilfe <a href=\"https:\/\/www.reuters.com\/business\/autos-transportation\/bmw-daimler-sued-refusing-tighten-carbon-emissions-targets-handelsblatt-2021-09-21\/\">filed a lawsuit<\/a> against car manufacturers BMW and Daimler for refusing to tighten their goals to cut carbon emissions, with a similar case brought against VW by Greenpeace Germany and Fridays for Future activist Clara Mayer in November.<\/p>\n\n\n\n<p>Setzer says this is a sign that litigation is diversifying from a focus on the fossil fuel industry towards other sectors, a trend she expects to continue.<\/p>\n\n\n\n<p>Others are taking a different approach. In August, the Australian NGO Environmental Defenders Office <a href=\"https:\/\/www.edo.org.au\/2021\/08\/26\/world-first-federal-court-case-over-santos-clean-energy-net-zero-claims\/\">filed a suit<\/a> under consumer protection law against oil and gas firm Santos for falsely claiming to produce clean energy and having a pathway to net zero emissions.<\/p>\n\n\n\n<div class=\"wp-block-cd-pull-quote block--pull-quote block--pull-quote--no-citation\"><div class=\"block--pull-quote__wrapper\"><blockquote class=\"block--pull-quote__quote\">As more companies make net-zero commitments, Setzer expects to see far more cases on greenwashing and misrepresentation<\/blockquote><cite class=\"block--pull-quote__cite\"><\/cite><\/div><\/div>\n\n\n\n<p>As more companies make net-zero commitments, Setzer expects to see far more cases on greenwashing and misrepresentation, as well as corporate adherence to due diligence rules. \u201cWhatever commitment is made now, there is always that consideration of \u2018Can we really deliver?\u2019 I think this is an area where the risk of litigation is very effective in creating behavioural change,\u201d she told China Dialogue.<\/p>\n\n\n\n<p>The financing of the fossil fuel industry is increasingly in the legal spotlight. Environmental law firm ClientEarth is <a href=\"http:\/\/climatecasechart.com\/climate-change-litigation\/non-us-case\/clientearth-v-belgian-national-bank\/\">taking legal action<\/a> against the Belgian National Bank for failing to fulfil environmental protection and human rights requirements when buying corporate assets, many of which are from companies fuelling the climate crisis. Further cases against banks and other financial institutions are likely in future.<\/p>\n\n\n\n<a class=\"wp-block-cd-related-news alignright block--related-news loading\" data-post-id=\"70751\"><div class=\"block--related-news__image\"><\/div><div class=\"block--related-news__content\"><span class=\"block--related-news__heading\">Recommended<\/span><span class=\"block--related-news__title\"><\/span><\/div><\/a>\n\n\n\n<p>State support for the industry is also under scrutiny. And in December, the UK\u2019s High Court heard a case brought by three climate campaigners against the government and its Oil and Gas Authority, challenging the spending of public money in support of the oil and gas industry. A judgment is expected in early 2022.<\/p>\n\n\n\n<p>It will be one of several heavily anticipated decisions in a field that is expanding fast, employing diverse and creative legal strategies against
